for the contracted not -to- exceed maximum value of $35,000., including sales tax, and make minor modifications to the

K. FINANCE
1. 8`h & Francis Sewer Trestle Repair and Retrofit, Project WW05 -06 / ITEM PULLED K -1
EXECUTIVE SESSION — under authority of RCW 42.30.110(1)(i) to discuss potential litigation with legal counsel, for 20
minutes with action expected to follow. Began at 7:01 p.m. Ended at 7:23 p.m. Return to Open Session at 7:23 p.m.
2. Ranney Well - Performance Testing, Project WA -13 -023 / Moved by Collins, second by Downie to sign professional
services agreement with Layne Christensen, Inc., of Columbus, Ohio, in an amount not to exceed $50,000, including
taxes, and to make minor modifications to the agreement, if necessary; and continue to work with the National Park
Service to ensure an adequate, safe, and consistent supply of water to the City, and if necessary, to invoke the dispute
resolution processes outlined in the August 6, 2004 Memorandum of Understanding between the National Park
Service and the City and the Lower Elwha Klallam Tribe and outlined in the Transfer Agreement, in an attempt to
reach an agreement. Carried 6 -0 K -3
L. COUNCIL REPORTS - Councilmember Nelson — attended the Ciry softball game and BBQ, attended Chamber meeting
to hear Director Cutler's presentation, and thanked him for 14 years of work and projects. Councilmember Downie spoke
attending the Canada Day celebration in Victoria, and the AWC Annual Conference in Kennewick. Mayor Kidd — attended
the AWC Conference, last Saturday's ONP 7? anniversary celebration events, went with delegation to Victoria for Canada
Day with coverage on several Victoria media outlets. Deputy Mayor Collins - attended the AWC Conference and suggested a
worksession with the entire council to go over resources from the conference. Councilmember Bruch noted the designing
livable cities conference in the past, and pleased with helpfulness of Parks & Recreation seasonal worker. Councilmember
Di Guilio stated he did not attend any conferences and has no report.

PUBLIC HEARINGS
Public hearings are set by the City Council in order to meet legal requirements In addition, the City Council may set a public
hearing in order to receive public input prior to making decisions, which impact the citizens. Certain matters may be
controversial, and the City Council may choose to seek public opinion through the public hearing process
