AN ORDINANCE approving and confirming the re- assessments
and re- assessment roll de novo in Local Improvement District
No. 76, created under Ordinance No, 637, approved June 2nd, 1920,
which said re- assessments and re- assessment roll was ordered and
provided for by and under Ordinance No, 686,.adopted by the City
Commission and approved by the Mayor the 27th day of April, 1921,
and which said re- assessments and re- assessment roll is for 'that
portion of the cost of said improvement based upon the Engineer's
estimate plus ten per cent thereof; for the impreversent.of _Lincoln._;
Street in the City of Port Angeles, from the South End of the
Bridge between Fourth Street and Fifth Street to the South Margin
of Front Street, all in accordance with Resolution No. 76, and
plans and specifications adopted by the then City Council of the
City of Port Angeles; ordering the levy and collection of such
re- assessments and creating and establishing a special fund for
said District No, 76.
TiE CITY COMMISSION of the City of Port Angeles Do Ordain As
Follows:
Section 1, That the re- assessments and re- assessment roll of
Local Improvement District No, 76, created by Ordinance No, 637,
approvers June 2nd, 1920, and which said re- assessments and re- assess-
ment roll comprises that portion of the cost of said improvement
based upon the Engineer's estimate plus ten per cent thereof, and
which said re- assessments and re- assessment roll were ordered and
authorized by Ordinance No 686, adopted by the City Commission and
approved by the Mayor on the 27th day of April, 1921, and which
consisted in the improvement of Lincoln Street in the City of Port
Angeles, from the South End of the Bridge between Fourth and Fifth
Streets to the South Margin of Front Street, by removing old plank,
replacing and removing old sidewalks, removing all lumber of any
description from either embankment or excavations, extending
trestle between Third Street and Fifth full width of the street,
placing asphaltum covering entire length and width of trestle,
repairing said trestle, bringing subgrade of roadway to proper
line, excavation, embankment, drains, dtorm sewers, sanitary sewers,
concrete retaining walls, concrete curbs, concrete gutters, concrete
roadway from retaining wall to retaining wall and from curb to curb
on either side nine inches thick, and such other work as was
necessary in connection therewith, all in accordance with plans
and specifications prepared by the City Engineer, filed with the
City Clerk, and approved and adopted by the then City Council, as
said re- assessments and re- assessment roll now stands, as the
same comprises and consists of that portion of the cost of said
improvement based upon the Engineer's estimate plus ten per cent
thereof, and which was regularly heard and fully considered by the
City Commission sitting as a Board of Equalization thereon on the
let day of June, 1921, according to regular notice thereof and
according to law and the ordinances of said City, and in accordance
with the findings and order of said Board of Equalization at said
meeting in said City, be and the same are hereby in all respects
approved and confirmed in all things,
Section 2 That each said lot, trgct, or parcel of land shown
upon said re- assessment -'roll isihexneby declared to be especially
benefitted by said improvement in at least the amount charged against
the same, and that the re- assessment appearing against the same is
in proportion to 'the several' re- assessments appearing on said roll,
and there is hereby levied and assessed against each said lot, tract
or parcel of land appearing on said roll,.the amount actually charged
and re- assessed against the same,
Section 3, That there is hereby created and established for
said Local Improvement District No 76, a special fund to be known
and designated as Local Improvement District No 76 for the uses and
purposes provided by law and the ordinances of the city,
Section 4. Said re- assessments or any of them may be paid
Swithout interest at any time within thirty-(30) days from the date
of the first publication of the City Treasurer's notice to pay the
same as required by law to be given, and all re- assessments not paid
within said thirty (30) day period shall Hereafter be paid in ten
equal annual installments with interest thereon at the rate of seven
(7) per cent per annum.
Section 5. That immediately upon the taking effect of this
ordinance said re- assessment roll shall be turned over to the City
Treasurer for the collection of said first annual installment, who
will thereupon proceed to collect the same according to law.
• ` Section 6. This ordinance shall be in full force and effect
when it shall have been passed by the City Commission, approved and
signed by the Mayor, attested by the City Clerk, approved by the City
Attorney, and from and after five (5) days from its publication in
the official newspaper of the City of Port Angeles, and the Clerk is
hereby directed to cause the same to be so published,
