HomeMy WebLinkAbout0796011, ORDINANCE No. 1 + 19 AN ORDINANCE authorizing the issuance and sale of Local Improvement Bonds of Local Improvement Distriet No.104 to pay the cost and expenses of the improvements in said district as ordered and pro- vided for in and by Ordinance No.762, approved and adopted July 30, 1924, entitled "An Ordinance ordering and providing for the improve- ment of the following described portions of streets and real _property in the_Ctty'of Port Angeles, Washington, and in the manner following, to -wit: Beginning at a point approximately 318 feet westerly from the center line of A street and extending thence along Third Street, westerly a distance of approximately 2321 feet to the intersection of said Third street with the easterly boundary of the Sampson Donation Land "laim, by removing all old lumber in the present bridge structure situated in and upon said portion of said Third Street, removing all piling that cannot be protected and saved, construction of a new trestle or bridge, driving a minimum of three and a maximum of six piles per bent, such piles to be peeled Douglas fir, capping such piles with 12x12 timbers and 4x12 stringers and with decking sufficiently strong to support a reinforced concrete slab, five inches in thickness, divided into sections eleven feet by eleven feet in size, which concrete slab or pavement as aforesaid, shall be so con- structed thereon; a four foot sidewalk to be constructed along the south side of the roadway; 225 feet of the westerly end of the above described portion of the said Third street to be filled to grade with suitable earth and a concrete slab or pavement nine inches thick placed thereon; the said peeled Douglas fir piles to be pro- tected by Portland cement two inches in thickness to be applied by the "Gunite" process; together with all necessary guard rails, hand railing, bulkheads,. retaining walls, and doing. such other work as may be necessary in connection therewith. Also the improvement of Second Street beginning at the easterly end of the said Third Street bridge, which is the easterly end of the above described portion of Third Street; thence in a northeasterly and easterly direction along said Second Street to the easterly margin of Cherry Street; thence southerly along Cherry street to the northerly margin of Third Street; by clearing, grubbing, draining and all necessary trunk sewer connections; by raising Second Street between the said Third street bridge and Valley street to a permanent grade, by filling with earth mostly obtained in that part of Second Street between Valley and Cherry streets, by building sidewalks and graveling road- way thirty feet in width. Also the improvement of Cedar street from the northerly margin of Sixth Street, northerly along said Cedar Street to the southerly margin of Second street; by bringing said portion of said Cedar street to a permanent and even grade between said Sixth street and Second street; by gravelling a roadway thirty feet in width, together with all necessary drainage, and construction of wooden sidewalks. Also the improvement of all that portion of streets and alleys and of Blocks 35 and 36 of the Townsite of Port ' Angeles lying between and contained within lines parallel with and forty feet distant or either side from a center line described as follows, to -wit: Beginning at a point on the center line of First street, which point is five feet easterly from the westerly margin of Valley street; and running thence southwesterly a distance of approximately 816 feet to a point on the center line of Second street, which point is 150 feet westerly from the westerly margin of Pine street (being a strip of land 80 feet in width); by the removal of all old buildings and refuse and debris; the filling of said right - of -way with a suitable earth or sand and gravel fill; together with all necessary road gravel, rip -rap, guard rails, and wooden sidewalks; all as may be necessary to make a complete and finished street and roadway forty feet in width on the top of such fill; together with all such other work in connection therewith as may be necessary to properly carry out the construction and. making of the contemplated improvement, all in accordance with maps, plans and specifications prepared by the City Engineer and adopted by the City Commission, and in accordance with Local Improvement Resolution No.104; provid- ing for an enlarged Local Improvement District and providing for payment of the cost and expense of said improvement by special assessment upon the property within said district, according to law and. by the mode -of "payment -by bonds ". THE CITY COMMISSION OF THE CITY OF PORT ANGELES DO ORDAIN AS POLLOWo: Section I. That the Mayor and City Clerk be and they are now hereby authorized and directed to issue Local Improvement Bonds for Local Improvement District No.104 of the City of Port Angeles created under Ordinance No.762, approved July 30, 1924, and in accord- ance with the laws of the State of Washington and the ordinances of the City of Port Angeles in the sum of /34:7%2440 S1I Section .II. That said bonds4be made payable on or before twelve years from the date of issuance thereof , and shall -bear interest at the rate of seven for- Sd-; term- tvn - /CSS (7' ;) per centum per annum payable annually., Said boncj,5 sdall be issued in denominations as follows: Bond numbered one shall^in the denomina- tion. of`K Z.1 6° • bonds numbered two to one hundred twenty -on.e inclusive shall be issued it the denomination of i,p500.00 each; bonds numbered one hundred twenty-&io to one hundred seventy- op:e_inclusive shall be issued in the denomination of $100.00 each; and bonds numbered one hundred seventy -two to 314 inclusive shall be issued in the denomination of ¢500.00 each; they shall be each numbered consecutively from me upward, and each of said bonds shall have attached thereto interest coupons for each interest payment, and each such bond and coupon shall be signed by the Mayor and attested by the City Clerk, who shall affix the seal of the City to eacl of said bonds: pro- vided, that said coupons in lieu of being signed, may have printed thereon the facsimile of the signatures of the Mayor and City Clerk; and each such bond shall refer to the improvement and the ordinance orderin7 the improvement, to pay for which said bonds shall be issued; -2- mor 'to and each of said bonds shall provide and state that the principal sum therein named, and the interest thereon, shall be payable only out of the special fund created for the payment of the cost and expense of said improvement, and that no other fund of the City of Port Angeles shall ever be liable therefor. That the form and mode of issuafte- 7M8 t%e execution of said bonds shall be as prescribed by the laws of the State of Washington and the ordinances of the City of Port Angeles, as in such case made and provided, and that said bonds when so lawfully executed and issued shell be placed in the custody of the City Treas'!rer and by d A elivered to the purchaser or purchasers upon receipt by her of the amount contracted to be paid for the same, not less than their par value and accrued interest. Section IV. Said bonds or any part of them may be sold or exchanged for the warrants issued in payment for the improvement for which they am shall be issued, or may be sold to any purchaser for cash at not less = than- teir?,par -value' and accrued interest, and the proceeds Lherefor shall be applied to the payment of the cost and expense of said im- provement. Section V. That said bonds shall be dated the first day 9 f -te,..�4,4,r-, Section VI. This ordinance shall take effect and be in force after its passage and approval and from and after five days after its lawful publication. Passed first reading by the City Commission, December 9, 1925. Passed second reading by the City Commission, December 16, 1925. Passed third reading and finally passed and adopted by the City commission, December 16, 1925. Approved and signed by the Mayor this 16th day of December, 1325.
