AN ORDINANCE Granting permission to install metal paper receptaoles
on certain street corners in the City of Port Angeles; Providing for the main-
tenance, control and handling of Sams.
THE CITY COMMISSION OF THE CITY OF PORT ANGELES DOES ORDAIN AS FOLLOWS:
Section 1. There is hereby granted to J. R. McDonald, his successors or as-
signs the right and privilege for a period of five (5) years to maintain upon
the sidewalk on certain streets in the City of Port Angeles metal receptacles
for waste paper and rubbish conforming generally to the following specifications:
Twenty -four (24) inches square by forty -four (44) inches high,
constructed of at least twenty -eight (28) gauge galvanized steel
with strong channel iron frame.
The container shall rest upon legs or supports which shall elevate the bottom
of the container at least six (6) inches from the ground which shall be at all
• times of sufficient strength to support the container firmly when filled. The
containers shall be tight at all joints so that no refuse can escape and shall
have convenient method of opening and being emptied and cleaned. The receptacle
shall be equipped with doors or covers Which may be easily opened and which auto-
matically close.
Section 2. The Said receptaoles shall be installed on the side -walks at suit-
able points on the principal business streets in Port Angeles in such a manner
as shall not obstruct the passage of pedestrians or otherwise impede traffics.
The licensee herein shall keep the same repainted and in a clean and satisfactory
condition and maintain the same in accordance with the requirements of the City
Commission.
The licensee shall, at his ova expense, provide for the disposal of the waste
and rubbish from the said receptacles at regular intervals. He shall (seep the
same serviced to the satisfaction of the Commissioner of Streets, and in good re-
pair at all times.
Section 3.
The said licensee shall have the right to place upon said receptaoles
from time to time such advertising matter as he may desire, provided, however,
that no objectionable, unlawful or offensive advertising shall be at any time
placed upon said receptacles.
Section 4. The said receptacles shall be at all times under the control of
the City Commission; if at any time during the life of this franchise it be-
comes necessary to make any change in the location of said receptacles, the City
Commission, after proper hearing on the matter, reserves the right to make such
changes.
Section 5. The construction of the said receptacles shall be in accordance
with the requirements of the Commissioner of Streets and Public improvement, and
The City Engineer, and their maintenance and repair shall be in a000rdance with
the requirements of this department. The street Department shall have the right
to require the removal of any such receptacle not maintained in a neat, san-
itary and serviceable condition.
Location and other control of the receptacles shall be by the Commission on
reoommendations from the Street, Fire and Police Departments.
This grant is made subject to the Police Power of the City to properly regu-
late the movement of traffic, fire protection, neatness and sanitary conditions
of the streets and other hazards.
Section 6. The said licensee aball be required to install three receptacles
approved as herein provided within sixty days from the effective date hereof
and install seven within a year from the effective date hereof.
Seotdon 7. This license shall be subject to cancellation by the City Commis-
sion for cause and after due notice to the licensee.
If at any time it appears to the City Commission that the terms of this ordi-
nance have not been complied with, or that the licensee has failed to observe
other ordinanoes of the City, or if the appearance of the said receptacles is not
maintained in accordance with the requirements of the Street Department or if,
after notice, the requirements of the City Commission in regard to the mainten-
ance of the receptacles or their position in the streets has not been complied
with, the City Commission may, on reasonable notice, require the licensee to
appear before the City Commission and show cause why the license should not be
canceled for a failure to comply with this and other ordinances of the City of
Port Angeles. Such order shall set forth in substance the complaints charged
against the licensee in his operations under this franchise or other ordinances.

After hearing thereon, the Commission shall determine the disposition of the
privileges granted under this Ordinance.

Section 8. The licensee shall maintain with the City Clerk a surety bond n t
in the amount of one thousand 01,000) Dollars running in favor of the City
and conditioned to protect the City of Port Angeles from any damage which may
be finally adjudged to be due any person for and on account of the installation
of the said receptacles.
Failure to maintain such a Bond in good standing shall be sufficient cause
for termination of the privileges granted hereunder.
Section 9. An assignment of the rights and privileges herein granted shall
be effective only on resolution of approval by the City Commission, the filing
of a certified copy of said assignment with the City Clerk together with the
written consent and approval of the assignee to all the provisions and restrict-
ions herein contained.
Section 10. Ordinance No. 826 of the City of Port Angeles is hereby repealed.
Section 11. This ordinance shall be in full force and effect from and after
thirty (30) days from its passage, approval and lawful publication.
