ORDINANCE NO. 1119
AN ORDINANCE of the City of Port Angeles providing for the
2 iadoption by reference of the provisions of Part 6, Book V, Rules and
3 Regulations of the State Board of Health, as revised and adopted
Ilk4 April 24, 1942, and providing for the issuance of permits for the
f roperation of any place for the handling of food within the City
6 ;of Port Angeles, and providing penalties.
7 THE CITY COMMISSION OF THE CITY OF PORT ANGELES DOES ORDAIN
8 :AS FOLLOWS:
9 Section 1. That pursuant to the provisions of Chapter 213,
10 °Laws of Washington, 1943, all of the Rules and Regulations of
11 Part 6, Book V, Rules and Regu.lationsof the State Board of Health
12 of the State of Washington, relative to'Sanitation and Public Food
13 Handling Establishments and Drinking places, as revised and adopted

14 April 24, 1942, and each thereof, be and the same is hereby adopted.
15 i' Section 2. It shall be unlawful for any person to operate
!.
16 ,a restaurant, an itinerate restaurant, or drinking place in the
17 City of Port Angeles, as defined by said Pules and Regulations, who
18' does not possess an unrevoked permit from the health officer of the
19 City of Port Angeles and in whose place of business such permit is
20 :not posted in a conspicuous place. Only persons who comply with the
21 requirements of this ordinance, or of said Rules and Regulations,
22 as herein adopted, shall be entitled to receive and retain such a

23 ,permit.
241 Applications for such permit shall be filed with the Health
25 officer of the City of Port Angeles on such forms as may be desig-
26nated by him. The health officer may decline to issue a permit to
27 any person, firm or corporation where, upon inspection, he finds
28 that the requirements of this Ordinance or of said Rules and Regula-
29 tions have not been complied with provided, however, any person
30 feeling himself aggrieved by, such denial of application by the health
31 ,officer may appeal from such decision within ten days thereafter to

,to affirm or reverse the decision of the city health officer.
5 I Upon the conviction of any person, firm or corporation of a
6 ,violation of any of the terms of,this Ordinance or any of said
7 I' Rules and Regulations the Court shall have authority in addition
8 1,-to any other penalties to suspend or revoke such permit for such
9 :period of time as the Court shall consider proper.

10 Section 3. Any person violating any of the terms of this
the City Commission of the city of Port Angeles and such hearing
before said City Commission shall be held at a date to be designated
by said Commission. Said Commission shall have authority and power
11 :.ordinance shall be deemed guilty of a• misdemeanor and upon conviction
12 shall be punished by imprisonment in the city jail for a period of
13 not to exceed thirty (30) days, or by a fine of not to exceed
14 400.00, or by both such fine and imprisonment.
15 , Section 4. That because of the facts the adoption of.this
16 Ordinance is urgent and necessary for the public peace, health and.
17 .safety of the inhabitants of the City, whichemergency is declared
18 to exist and this Ordinance shall take effect and be enforced from
19 and after its passage, approval and lawful publication.
