AN ORDINANCE ORDERING and providing for the improvement of
Portions of Eighth, Ninth, Tenth, and Eleventh Streets East of
Lincoln Street, and Twelfth Street from Chase to Vine Streets,
and Chase, ?eabody and Eunice Streets South of Eighth Street, as
more particularly hereinafter described, by the construction of
concrete sidewalks on both sides of said streets, excepting that
property in front of which there now exists concrete sidewalks of
such construction and dimensions as to conform to the proposed im-
provements herein provided for; creating Local Improvement Dis-
trict iJo. 148, and providing for the payment of the cost and expense
thereof by special assessment upon the property benefited, according
to law, and by the mode of "Payment by bonds ", all in accordance
with Improvement Resolution No. 148 of the City of Port Angeles, and
in conformity with maps, plans and specifications prepared by the
City Engineer and approved by the City Commission.

Section 1. That there is hereby ordered the following de-
scribed improvements alone; the portions of streets in the City of
Port Angeles in this section described: The construction of con-
crete sidewalks thereon five feet in width on both sides of said
streets, excepting therefrom those portions whereon there are now
existing concrete sidewalks of such construction and dimension as
to conform to the improvements herein provided for:
8th Street from East Margin of Lincoln Street to
best Margin of Race Street.
9th Street from East Margin of Lincoln Street to
`.'Test Margin of Francis Street;
10th Street from East Margin of Lincoln Street to
Fast Margin of Eunice Street.
llth Street from East Margin of Lincoln btreet to
East Margin of Eunice Street.
12th Street from ;+est :argin of Chase Street to the
"'est Margin of tii ne Street.
Chase Street from the South Margin of 8th Street to
the North Margin of 12th Street.
Peabody Street from the South Margin of 8th Street
to the North Margin of llth Street.
Eunice Street from the South :'argin of 8th Street
to the North '. iargin of llth Street.
All of said improvements shall be done in accordance with maps,
plans and specifications prepared by the City Fngineer and adop-
ted and approved by the City Commission, and in accordance with
Improvement Resolution :To. 1/S of the City of Port Angeles.
Section 2. That the cost and expense of said improve-
ments, including all necessary and incidental expenses, shall be
borne by and assessed against the property situated and included
within the boundaries of the district hereinafter created and
described in accordance with law and the ordinances of the City of
Tort Angeles, and the city shall not be liable in any manner for
any part of the cost and expense of said improvement, except so far
as the city is made liable by virtue of the statutes of the State
of mashington, and particularly those statutes providing and dir-
ecting that the city create a local Improvement Guarantee Fund for
the purpose of guaranteeing to the extent of such fund, and in the
manner provided by law, the payment of }Local Improvement Bonds is-
sued to pay for local improvements ordered by said city.
Section 3. That there is hereby created a local improve-
ment district to be called Local Improvement District No. 118, which
said district is described as follows: All the -property ^*hich may
be benefited by the said improvement, which ?ronerty is hereby de-
clared to be the property abutting on, proximate, vicinal, adjacent
and contiguous to the above described portions of Finhth, Ninth,
`renth, Eleventh and Twelfth, an,1 Chase, Peabody and '"unite Streets
to be improved, as herein provided., includin3 the property

measured back to the median line of the abutting blocks.

Section 4. Bonds bearing interest at the rate of 25--
per annum, payable on or before ten (10) years from the date of
their issue, shall be issued in payment of the cost and expense of
said improvement, which bonds may be redeemed by the collection of
ispecial assessments to be levied against the property witnin said
district payable in ten (10) annual installments under the mode of
"payment by bonds ", as provided by law. These bonds may be deli-
vered to the contractor in redemption of warrants on the special
fund of the local improvement district herein created on esti-
mates of the City 'Engineer, or the said city, at its election, may
sell said bonds and make such redemption in cash or cash warrants.
Section 5. This ordinance shall take effect and be in
force after its passage and approval and from and after five (5)
days after its lawful publication.
Passed first reading by the City Commission September 25,
1D46. Passed second reading by the City Commission September 25,
1946. Passed third reading and finally passed and adopted by the
City Commission October 2, 1946.
