The City of Port Angeles does hereby grant unto the United States of America, 'epartment of the Interior, acting by and through the Bonneville rower administrator, the non - exclusive •right and privilege to construct, operate and maintain a 6 inch diameter asbestos - cement pipe busied not less than 3 feet below ground, and facilities appurtenant thereto that may be necessary or con- venient for the efficient operation and maintenance of said pipe line across and under certain streets and property of the City of Port Angeles along the course described as follows: beginning at a point on the South line of Lauridsen Boulevard, said point being 10 feet East of the .est line of Lafayette Street in Campbell's Addi- tion to Port Angeles; thence on a line lying 10 feet Easterly of the Jest line of Lafayette Street extended and parallel thereto for a distance of 70 feet more or less to an angle point on the Northerly side of said Boulevard; thence North - westerly on a line parallel with the Northeasterly line of ninth Street and 15 feet distant South- westerly of said northeasterly line, and upon and along Ninth Street for a distance of 400 feet more or less to a point in a 14 inch water main of the City of Fort Angeles located just .esterly of the VJest line of Jones Street. The exact location of said pipe line to be constructed hereunder is set forth in drawing io. 43377 on file in the office of she Clerk of the City of Tort Angeles, ..ashin ;ton. c "3 jt. Section 2. The foregoing; grant is made subject to the follow- ing terms and conditions: (a) All work perfomed in construction, operation and main- tenance of said pipe line and the necessary equipment and facilities shall be in accordance with the applicable laws of the City of ±ort Angeles. (b) All cost of construction, operation and maintenance of said pipe line shall be paid by the United States of America. (c) If at any time it becomes necessary in the opinion of the ,City of Port Angeles to change the location of the pipe line, such change will be made by and at the expense of the United States of America. (d) Any and all damage or injury done or caused to any of the property of the City of Port Angeles in the construction, operation and maintenance of the said pipe line shall be iLwiediately repaired and reconstructed by the United utates of America in a manner satis- factory to the City of Port Angeles. (e) Such pipe line shall be so constructed and installed so as not to interfere with the use by Clallam County Public Utility District No. 1, Rayonier Incorporated and Crown Zellerbach Corpora- tion of the franchises heretofore granted to them by the City of Port Angeles to erect, maintain and use poles or other suitable devices for the support of wires in, over, along and across Lauridson Boule- vard in the City of Port Angeles and at any other point ,There said pipe line may intersect or cross such franchises heretofore granted. Upon the failure, neglect or refusal of the united States of America to immediately make the necessary repairs and reconstruction of the properties of the City of Port Angeles as herein required of the United States of America, the City of tort Angeles may undertake to perform and complete such repairs and reconstruction and the cost thereof will, i,ithin the limits of the appropriation then or there- • • ,after available therefore,-ae paid by the United States of America ,upon the presentation of the properly executed vouchers therefore; provided, however, that the City of Port Angeles shall submit an estimate of the cost of such repairs or reconstruction to the United States of America, .jepartment of the Interior, acting by and through the Bonneville Power Administrator at Portland, Oregon, and shall ob- tain the approval of the Bonneville Feuer Administrator, or r_is authorized representative, of the cost thereof before making any such repairs or reconstruction; provided further, that if in an emergency, the determination of which rests with the City of Fort Angeles, it becomes necessary for the City of Port Angeles to make such repairs or reconstruction without having thus obtained the approval of the cost thereof, the United States of America shall not be required to make any payment therefore unless the sum expended or some lesser reasonable sum shall be later approved by the Bonneville Fower .�d-- ministrator, or his authorized representative, as herein provided. Section 3. This ordinance shall take effect and be in force and effect thirty (30) days from and after its passage and publica- tion.
