ORDINANCE NO. /2 3 '
AN ORDINANCE of the City of Port Angeles, Washington,
providing for the improvement of certain streets
in the area generally known as "Cherry Hill" by
the construction and installation of storm sewers,
and by the surfacing thereof, and doing such other
work as may be necessary in connection therewith,
all in accordance with a resolution of the Commission
of the City of Port Angeles passed and approved May
8, 1950; creating a local improvement district
therefor; and providing that the payment for said
improvements be made by special assessments on
property in said district payable by the mode of
'payment by bonds" excepting the certain portion
thereof to be paid from other funds available
therefor.
WHEREAS, Resolution No. 153 was passed by the Commission of the
City of Port Angeles on May 8, 1950, declaring the intention of the
Commission to order the improvements hereinafter described and fixing
the time for the hearing thereon; and
WHEREAS, said resolution has been duly published and due notice
of said hearing was given as required by law; and
WHEREAS, the said hearing was held as provided in said notice,
and after hearing the verbal protests of certain property owners the
Commission of the City decided to order the construction and installa-
tion of said improvements;
NOW, THEREFORE, BE IT ORDAINED by the Commission of the City of
Port Angeles, Washington, as follows:
Section 1. That the following streets of the City of Port Angeles
shall be improved by the construction and installation of storm sewers
and all necessary appurtenances thereto and by doing such other work as
may be necessary in connection therewith, including all necessary labor
and materials for the complete construction and installation thereof
sufficient to adequately drain said streets:

Laurel Street from a point approximately in the center of the
intersection of Laurel Street and Second Street, thence southerly
along the center line of Laurel Street to approximately the southerly
margin of Eighth Street;
Third Street from approximately the center line of Laurel Street,
,thence westerly along Third Street to the approximate center line of
Oak Street;
Oak Street from approximately the center of the intersection of
said street with Third Street, southerly along said Oak Street to the
southerly margin of Seventh Street;
Second Street from a point at the approximate center of the inter-
section of Second Street and Valley Street easterly along said Second
Street to approximately the center of Cherry Street;
Cherry Street from the approximate center of the intersection of
said street with Second Street, southerly along Cherry Street to the
southerly margin of Seventh Street;
Third Street from a point approximately at the intersection of
said street with Oak Street, westerly to the approximate center of the
intersection of said street with Cherry Street;
Oak Street from a point at the approximate center of the intersec-
tion of Oak Street and Third Street, northerly along the center line of
said street to a point adjacent to the northerly margin of Lot Eleven
(11) in Block 53 of Norman R. Smith's Subdivision of the Townsite of
Port Angeles;
Fourth Street from Peabody Street to Chase Street.
Section 2. That the following named and described streets of the
City of Port Angeles shall be improved by the laying and constructing
thereon of a 2" compressed mat of Type 1 -I asphaltic concrete pavement,
including a crushed stone or gravel foundation and ballast therefor,
and by doing such other work as may be necessary in connection therewith,

including all necessary labor and materials for the complete con-
struction and laying thereof:
Second Street from the westerly margin of Lincoln Street to the
10 westerly margin of Oak Street;
Third, Fifth, Sixth, Seventh, Ninth, Tenth, Eleventh, Twelfth
and Thirteenth Streets from the westerly margin of Lincoln Street
westerly to the crest of the hill on each of said streets lying between
Cherry and Valley Streets;
Fourth Street from the westerly margin of Peabody Street westerly
to the crest of the hill lying between Cherry and Valley Streets;
Fourteenth Street and Fifteenth Street from the northerly margin
of Lauridsen Boulevard westerly to the crest of the hill lying between
Cherry Street and Valley Street;
Laurel Street from the center line of the alley running through
Blocks 31 and 32 of Norman R. Smith's Subdivision of the Townsite of
Port Angeles southerly to the northerly margin of Eighth Street;
Oak Street from the southerly margin of Second Street southerly
to the northerly margin of Eighth Street.
Section 3. That the following named and described streets of the
City of Port Angeles shall be improved by the construction and installa-
tion of a 1/2" wearing surface Type 1 -1 asphalt on existing asphalt mat,
and by doing such other work as may be necessary in connection there-
with, including all necessary labor and materials for the complete
ilk construction and laying thereof:
Laurel, Oak and Cherry Streets from the southerly margin of Eighth
Street southerly to the intersection of State Highway No. 101 on
Lauridsen Boulevard.
Section 4. That all the costs and expenses of said improvements,
including all necessary and incidental expenses, except as expressly

stated in the proviso of this paragraph, shall be borne by and
assessed against the property included in the assessment district
hereinafter created in the manner provided by law; provided, however,
that a portion of the cost and expense of constructing the storm
sewers along Cherry Street from Second Street to Seventh Street to
the approximate amount of $4,000 shall be provided by other funds
available therefor which shall be specifically appropriated by the
City Commission for such purpose.
The nature of the improvement herein is such that the special
benefits conferred on the property by the construction of the aforesaid
storm sewers are not fairly reflected by the use of the termini and
zone method of assessing the cost of such storm sewers and the special
benefits therefrom. The assessments which shall be made against
property within the local improvement district created by this ordinance
shall be in accordance with the special benefits which said property
shall derive from the said construction of storm sewers, without regard
to the termini and zone method. The cost of that portion of the
improvement which shall consist of ballasting and surfacing the streets
specifically described in Sections 2 and 3 of this ordinance shall be
assessed upon all of the property so benefited in accordance with the
special benefits to be conferred thereon according to the termini and
zone method of assessment.
Section 5. That there be and there is hereby created a local
improvement district, to be known as "Local Improvement District No.
/5-3 11, which said district is described as follows:

Commencing at a point approximately at the center
of the intersection of the alley between First Street
and Second Street with Lincoln Street; thence south
along Lincoln Street to a point where the said Lincoln
Street intersects the alley between Third Street and
Fourth Street; thence east on a line consisting of an
extension of said alley between Third Street and Fourth
Street to a point where said line as extended Intersects
Peabody Street; thence south along Peabody Street to a
point where the alley between Fourth Street and Fifth
Street intersects said Peabody Street; thence west along
said alley to a point where said alley intersects Lincoln
Street; thence south along Lincoln Street to the northerly
margin of Lauridsen Boulevard; thence west along Lauridsen
Boulevard to the crest of the hill lying between Cherry
Street and Valley Street; thence north along the crest
of the hill lying between Cherry Street and Valley Street
to a point where such crest intersects the alley between
Second Street and Third Street; thence west along said
alley to the easterly margin of Valley Street; thence
north along said easterly margin of Valley Street to a
point where the same intersects the alley between First
Street and Second Street; thence east along said alley
to Cherry Street; thence south along Cherry Street to
Second Street ; thence east along Second Street to Oak
Street; thence north along Oak Street to the alley between
First and Second Streets; thence east along said alley to
the point of beginning.
Section 6. That all or any portion of the assessment levied as
hereinabove provided may be paid in cash within thirty days after
notice of collection thereof Is given by the City Treasurer as re-
quired by law. Any balance not so paid may be paid in ten equal annual

or any portion of such assessment may be paid at any annual interest
paying date with interest to such date. Assessments, or installments
of assessments not paid when due shall be delinquent, and there shall
be added to the same a penalty of 6 % of the amount of the overdue
All, installments and interest, and such penalty shall become a part of the
lien upon the property assessed. Bonds bearing interest at the rate
not to exceed
of/ 4� per annum payable on or before twelve years from the date of
issuance shall be issued in payment of the cost and expense of this

improvement, and shall be retired by the collection of the special
assessments hereinbefore described. These bonds shall be delivered
0 to the contractor in redemption of warrants of the Local Improvement
District Fund issued on estimates of the city engineer, or the City
of Port Angeles may, at its election, sell said bonds and make such
redemption in cash.
Section 7. This ordinance shall take effect immediately upon
its passage, approval and publication as required by law.
