AN ORDINANCE stating the facts of an emergency affecting
the safety and preservation of the intake and screen house of the
{
Industrial Water Supply System of the Water Department of the City
of Port Angeles, and the protection of said property from flood
waters of the Elwha River requiring the unforeseen expenditures
or funds, providing for the issuance and payment of emergency
'warrants and declaring an emergency, as follows:
WHEREAS, by reason of an unprecedent flood in the Elwha
River during the winter or early spring of 1950, the flood waters
of the Elwha River overran its banks and endangered the screen
house, intake and c.,nal of the Industrial Water Supply System of
the City of Port Angeles; and
WHEREAS, it is necessary that a jetty be constructed and
the former channel of the river cleared so that the waters of the
river will be directed away from said canal and screen house, and
that the work be done during the low water and prior to the winter
months so as to remove the danger prior to the next flood waters,
and
t;hEhEAS, the Industrial Water Supply System of the City of
Port Angeles is now under lease to tiayonier Incorporated ana said
lessee has agreed to reimburse the City of Port Angeles for the
cost of the construction of a jetty, clearing channel and of other
work necessary for the protection of said screen house and canal.
ECM THEi;EFORE, THE CITY COM1 ISSION OF THE CITY OF PORT ANGELES
DOES OiiDAIN as follows:
Section 1. That because of the unforeseen and unexpected
floods in the Elwha River, changing the course of said river so as
to endanger the canal and screen house of the industrial .ter
Supply System.of the City of Port Angeles and by reason of the
conditions now existing, it is necessary that work be done to
confine the waters of said river and change the course so as to
remove the danger to said Industrial dater Supply System before
the winter months or next high waters, all of which expenses and
II expenditures could not be reasona,,ly foreseen at the time of
making the budget for the Water Department of the City of Port
Angeles for the year 1950, and the amount provided in said

1 budget and various funds thereof is not sufficient to meet
such expenses, that the amount required to meet such expenses
is in excess of funds available in said budget by the amount
of yp30, 000.00.
Section 2. That the expenditures to be made will be in
excess of the funds provided in the budget for the Water Depart-
ment of the City of Port Angeles and hot provided for therein
and will be for the protection and preservation of the public
health and safety of the inhabitants of the City of Port Angeles.
Section 3. That by reason of the fact stated an emergency
exists which requires the issuance of emergency warrants to pay
for the work of constructing the necessary jetty and other work
required for the protection of said Industrial dater Supply, such
warrants to be paid from any monies on hand in the City Treasurer
in the fund properly chargeable with such expenditure, the amounts
thereof to be immediately repaid to said City by the lessee of the
Industrial Water System: That the Mayor and City Clerk arW hereby
'authorized to issue, sign, and deliver, and the City Treasurer
!to pay such emergency warrants.
Section 4. That this ordinance is necessary and urgent
for the preservation anu protection of the public peace, health,
and safety of the people of the City of Port Angeles, and for the
restoration and protection of the public property of said City,
that an emergency exists and t_iis ordinance shall take effect
and be in force immediately upon its passage, approval, and
publication in the manner provided by law.
