AN ORDINANCE stating the facts of an emergency affecting
the public safety, welfare and convenience of the City of Port
Angeles; requiring the unforeseen expenditure of funds; providing
for the issuance and payment of emergency warrants and declaring
an emergency.
THE CITY COMMISSION OF THE CITY OF PORT ANGELES DOES ORDAIN
as follows:
Section 1. That during the year 1948 the City Commission
of the City of Port Angeles ordered the constriction, erection and
fitting up of a building and premises to house a certain diesel
generating plant ordered by the said City Commission to supplement
the supply of electrical energy available to the City of Port
Angeles. That accordingly such building was constructed, erected
and fitted up and certain sums were contracted to be paid there-
fore by the City of Port Angeles. That subsequently the Division
of Municipal Corporations of the office of the Auditor of the
State of Washington ordered and required the City of Port Angeles
cease the expenditure of any funds in the payment of any bills
connected with such building or such diesel electric generating
plant for the reason that no funds had been budgeted for the pay-
ment thereof. That subsequently the Attorney General of the State
of Washington commenced an action for the cancellation of such
contracts and the restoration to the City of Port Angeles of any
funds expended by it upon such project. That such action was sub-
sequently settled and compromised with the mutual consent and ap-
proval of all parties and of the Division of Municipal Corporations
of the office of the Auditor of the State of Washington and the
City of Port Angeles. That the City of Port Angeles is now the
owner and in possession of the building and premises constructed,
erected and fitted up for the purposes aforesaid. That there is
now due and owing to the persons supplying the labor and material
for such building and premises and the fittings and appurtenances
thereof the sum of approximately $5,500.00.
Section 2. That the unpaid cost of such premises, build-
ing, fittings and appurtenances now owned and possessed by the
City of Port Angeles is the sum of approximately $5,500.00, all
of which sum is in excess of any funds now available in the bud-
get of the City of Port Angeles. That the amount provided in the
budget of the City of Port Angeles for the year 1950 is insuffi-
cient to meet the costs of such building and premises, and that by
reason of the actions of the Division of Municipal Corporations
aforesaid and of the Attorney General the necessity for expendi-
tures for such purposes could not reasonably have been foreseen
and provided for at the time of the preparation and adoption of
the budget of the City of Port Angeles for the year 1950.
Section 3. That the expenditures herein described to be
made in excess of the funds provided in the budget of the City of
Port Angeles for the year 1950, for the above purposes, are for
the protection and preservation of the public welfare, safety and
convenience of the inhabitants of the City of Port Angeles.
Section 4. That by reason of the facts above stated an
emergency exists which requires the issuance of emergency warrants
to provide for the cost of such premises, building, fittings and

appurtenances in the sum of $5,500.00. That such emergency
warrants shall be paid from any monies on hand in the treasury of
the City of Port Angeles, properly chargeable with such expendi-
tures, and the Mayor and City Clerk are hereby authorized to exe-
cute, sign and deliver and the City Treasurer to pay such emer-
gency warrants on and from any such funds.
Section 5. That the amount of such emergency warrants shall
be included and provided for in the annual budget of the City of
Port Angeles for the year 1951, and such budget shall include tax
1 levies sufficient to reimburse any fund or funds from which such
emergency warrants or any of them shall be paid.
Section 6. That this ordinance is necessary and urgent for
the preservation of the public safety, welfare and convenience of
the people of the City of Port Angeles, that an emergency exists,
and this ordinance shall be in full force and effect immediately
upon its passage, approval and publication in the manner provided
by law.
