AN ORDINANCE of the City of Port Angeles providing for the
'improvement of East First Street in said City from the Easterly
curb line of Race Street Easterly to the Westerly margin of Alder
,Street by the construction and installation of curbs and gutters
on the Northerly and Southerly curb lines of East First Street and
driveways wherever such curb lines are intersected by platted pub-
lic a11078,, and doing such other work as may be necessary in con-
nection with such improvement, all'in accordance with the resolu-
tion passed by the Commission of the City of Port Angeles
February 5 , 1951; creating a Local Improvement District
for such improvement;and providing that the payment for said im-
provement be made by special assessments on the property in said
district specially benefited, payable by the mode of "payment by
.bond&, all in accord with maps, plans and specifications pre-
pared by the City Engineer and approved by the City Commission.
WHEREAS, Resolution No. 154 was passed by the Commission of
the City of Port Angeles on Februarr 5
, 1951,
'declaring the intention of the Commission to order the improvement
hereinafter described and fixing a time for hearing thereon; and
WHEREAS, said resolution has been duly published and due
.notice of said hearing was given as required by law; and
WHEREAS, said hearing was held as provided in said notice,
and verbal and written protests of certain property owners were
,heard and received, and after due consideration the Commission of
the City of Port Angeles decided to order the construction and in-
stallation of such improvement; now, therefore,
BE IT ORDAINED by the Commission of the City of Port Angeles
as follows:

Section 1. That the following streets and alleys of the
City of Port Angeles shall be improved by the construction and in-
;
,stallation of curbs, gutters and driveways, together with all
necessary appurtenances thereto and by doing such other work as
may be necessary in connection therewith, including all necessary
labor and materials for the complete construction and installa-
.tion thereof: First Street from the Easterly curb line of Race
Street Easterly to the Westerly margin of Alder Street by the con -
struction and installation, on the Northerly and Southerly curb
lines of First Street between the termini of the Local Improvement
District herein created, of curbs and gutters, and driveways in all
platted public alleys intersecting such Northerly and Southerly
curb lines of First Street.
Section 2. That the cost and expense of such improvement
shall be borne by and assessed sgainst the property situated and
included within the boundaries of the district hereinafter created
and described, and the City of Port Angeles shall not be liable
in any manner for any part of the cost and expense of said im-
.provement, except in so far as said City is made liable by virtue
of the statutes of the State of Washington in such cases made and
provided, particularly the statute providing for a local improve-
ment guarantee fund.
Section 3, That there is hereby created a local improve-
ment district to be called Local Improvement District No. 154
which includes all of the property specially benefited by such im-
provement, which territory is described and fixed as follows, to
wit: That portion of the area of the City of Port Angeles bounded
on the East by the center line of Alder Street, on the North
by the center line of the alley between First and Front Streets,
on the West by the center line of hate Street, and on the
9South by the center line of the alley between First and Second

' Streets.
Section 4. That the property between the termini of said
improvement and within the boundaries of said district comprises
all of the property specially benefited by said improvement, and
said property shall be specially assessed for the cost and expense
of such improvement by the zone and termini method as provided in
Section 13 of Chapter 98 of the Laws of 1911, as amended by Chap-
ter 155 of the Laws of 1947 (Remington's Revised Statutes, Section
9365, 1947 Supplement).
Section 5. Bonds bearing interest at the rate of not to
exceed „15- per cent per annum, payable on or before twelve (12)
years from the date of their issue, shall be issued in payment of
the cost and expense of said improvement, which bonds may be re-
deemed by the collection of special assessments to be levied and
' assessed against the property within said district, payable in
ten (10) equal installments under the mode of "payment by bonds'
as provided by law. Such bonds may be delivered to the contractors
constructing such improvement in redemption of warrants on the
special fund of such local improvement district hereby created on
estimates of the City Engineer, or the City may at its election
sell such bonds and make the redemption in cash or cash warrants.
Section 6. This ordinance shall be in full force and ef-
1 feet immediately after its passage, approval and lawful publica-
tion.
