ORDINANCE NO. /2S7
An Ordinance of the City of Port Angeles, pro-
viding for the improvement of Twelfth Street
in the City of Port Angeles, by excavating,
grading, ballasting and surfacing w ith asphaltic
concrete certain portions thereof, and construct-
ing concrete curbs and gutters in connection there-
with where needed, doing such other work as may
be necessary in connection with said improvement,
all in accord with a Resolution passed by the City
of Port Angeles Jt1.1�( /lam , 1951; creating a
Local Improvement Dist±'.ct for such improvement;
and providing that payment for said improvement be
made by special assessments on the property in said
District especially benefited, payable by the mode
of payment by bonds, all in accord with maps, plans
and specifications prepared by the City Engineer and
approved by the City Commission.
WHEREAS, Resolution No. 158 was passed by the Commission
of the City of Port Angeles on j44- )j /4 , 1951, declaring the
intention of the Commission to order the improvement hereinafter
described, and fixing a time for hearing thereon; and
WHEREAS, said Resolution has been duly published and due
notice of said hearing has been given as required by law; and
WHEREAS,• said hearing was held as provided in said notice
and written protests of certain property owners were received and
I! after due consideration, the Commission of the City of Port Angeles
decided to order the construction and installation of such improve-

ment; now, `therefore
BE IT ORDAINED by the Commission of the City of Port
Angeles as follows:
SECTION 1. That the following streets and alleys of the
City of Port Angeles, to -wit: Twelfth Street from the Westerly
margin of Peabody Street to the Easterly margin of Lincoln Street
shall be improved by excavating to sub- grade, ballasting with
crushed rock to grade and laying thereon an asphaltic concrete
surface and constructing in connection therewith where necessary,
1 concrete curbs and 3--utters on that portion of Twelfth Street, lying

`between the ':.esterly margin of Peabody Street and the center line
of Chase Street, and by excavating to sub -grade and ballasting to
grade and surfacing with gravel, that portion of Twelfth Street,,ly-
ing between the centerline of Chase "Street and the Easterly margin
lof Lincoln Street, together with all necessary labor and material
to completely construct, erect and lay, such improvement.
SECTION 2. That the cost and expense of such improvement
shall be borne by and assessed against the property situated and in-
cluded within the boundaries of the district hereinafter created and
'described. That the City of Port Angeles shall not be liable in
any manner for any part of the cost and expense of said improvement,
except, in so far as said City is made liable by virtue of the
statutes of the State of b"Jashington, in such cases made and provided,
particularly the statute providing for a local improvement guarantee
fund.
SECTION 3. That there is hereby created a Local Improve-
ment District to be called Local Improvement District No. 158, which
,includss all of the property specially benefited by such improvement,
which territory is described and fixed as follows, to -wit:
That portion of the area of the City of Port Angeles,
bounded on the North by the Southerly margin of the alley running
through blocks 341 and 342 of the Townsite of Port Angeles; on the
South'by the Northerly margin of the alley running through Blocks

381 and 382 of the Townsite of Port Angeles; on the East by the
westerly margin of Peabody Street; and on the West by the Easterly
margin of Lincoln Street, all in the City of Port Angeles.
SECTION 4. That the property between the termini of said
'improvement, and within the boundaries of said district, comprises
all of the property specially benefited by said improvement, and
said property shall be specially assessed for the costs and expense
ii of such improvement by the zone and termini method, as provided in
Section 13 of Chapter 98 of the Laws of 1911, as amended by Chapter
153 of the Laws of 1947 (Remington's Revised Statutes, Section 9365
it 1947 .Supplement) .

SECTION- 5. bonds bearing interest at the rate of not
to exceed 9, 5 per cent per annum, payable on or before twelve
(12) years from the date of their issue, shall be issued in payment
of the costs and expense of said improvement, which bonds • may be
redeemed by the collection of special assessments to be levied and
assessed against the property within said district, payable in ten
(10) equal installments, under the mode of payment by bond, as
provided by law. Such bonds may be delivered to the contractors
constructing such improvement in redemption of the warrants on the
special fund of such Local Improvement District, hereby created,
on estimates of the City Engineer, or the City may at its election,
sell such bonds and make a redemption in cash or cash warrants.
SECTION 6. This ordinance shall be in full force and
' effect immediately after its passage, approval and lawful publication.

Passed third and final reading and finally passed by the
City Commission, August 27th, 1951.
