ORDINANCE NO.
An Ordinance of the City of Port Angeles, pro-
viding for the improvement of certain streets
in the City of Port Angeles by the construction
of curbs, gutters and such storm sewers and
catch basins as may be required and incidental
thereto, all in accordance with Improvement
Resolution No. 165 of the City of Port Angeles;
creating a local improvement district for such
improvement; and providing that payment for said
improvement shall be by special assessments on the
property of said district specially benefited,
payable by mode of "payment by bonds ", all in
accordance with the maps, plans and specifications
prepared by the City Engineer and approved by the
City Council.
WHEREAS, Improvement Resolution No. 165 was adopted by the
City Council of the City of Port Angeles on the 7th day of

lJanuary, 1954, declaring the intention of the Council to order
the improvement hereinafter described and fixing a time for the
hearing thereon; and,'
WHEREAS, said Resolution has been duly published and due
notice of said hearing has been given as required by law; and,
WHEREAS, said hearing was held as provided in said notice
on the 18th day of February, 1954; and said hearing was at that
,date regularly continued to the 4th day of March, 1954 at the
hour of 7:30 o'clock P.M.; and no written protests of property
owners were received; and, after due consideration, the Council
of the City of Port Angeles by unanimous vote decided that it was
'necessary for the protection of the public health and safety to
order the construction and installation of such improvement; now,
therefore,
THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES ORDAIN
as follows:
Section 1. That the following streets of the City of Port
Angeles be improved by the construction of curbs, gutters and such
storm sewers and catch basins as may be required and incidental
thereto, to wit: Eighth Street from the easterly line of Lot Eight
(8) in Block Two Hundred Sixty -One (261) and Lot Thirteen (13) in
Block Two Hundred Thirty- Eight (238) of the Townsite of Port
Angeles, Westerly to the Easterly margin of "E" Street, and "C"
Street from the Southerly margin of Eighth Street to the Northerly
margin of Ninth Street, all within the Townsite of Port Angeles,
Clallam County, State of Washington, by the construction of
curbs and gutters on both the North and South sides of Eighth
Street and by the construction of curbs and gutters on both the
East and West sides of "C" Street, together with all curb and
gutter returns at street intersections and such storm sewers and
catch basins as may be required and incidental. thereto.
Section 2. That the cost and expense of such improvement
shall be borne oy and assessed against the property situated and
included within the boundaries of the district hereinafter created
and described; that the City of Port Angeles shall not be liable
in any manner for any part of the cost and expense of said
improvement, except insofar as said City is made liable by virtue
of the statutes of the State of Washington in such case made and
provided and particularly the statutes providing for a local
improvement guarantee fund.
Section 3. That there is hereby created a local improvement
district, to be called Local Improvement District No. 165, which
includes all of the property especially benefited by such
improvement and which territory is described as follows, to wit:
that portion of the area of the City of Port Angeles contained
within the following boundaries:
Commencing at the Northeast corner of Lot Thirteen (13),
Block Two Hundred Thirty -Eight (238) of the Townsite
of Port Angeles; thence running Westerly along the
Southerly line of the alley in and through Blocks
Two Hundred Thirty -Eight (238), Two Hundred Thirty -Nine
(239), Two Hundred Forty (240), Two Hundred Forty -One
(241) and Two Hundred Forty -Two (242) to the Easterly
margin of "E" Street; thence Southerly along the
Easterly margin of "E" Street to the Northerly line of
the alley in Block Two Hundred Fifty - Seven (257); thence
Easterly along the Northerly line of the alley running
through said Block Two Hundred Fifty -Seven (257) to the
Southwest corner of Lot Five (5) in said block; thence
northerly along the west line of said Lot Five (5) to
the Northwest corner thereof; thence Easterly along the
Northerly line of said lot to the Northeast corner

thereof; thence Southerly along the Easterly line
of said Lot Five (5) to the Northerly line of the
alley in said Block Two Hundred Fifty -Seven (257);
thence Easterly along the Northerly line of said
alley through Blocks Two Hundred Fifty Seven (257)
and Two Hundred Fifty -Eight (258) to the Westerly line
of Lot Sixteen (16) in said Block Two Hundred Fifty -
Eight (258); thence Southerly across the alley and
along the Westerly line of Lot Sixteen (16) in said
Block Two Hundred Fifty -Eight (258) to the Southwest
corner thereof; thence Easterly along the Northerly
margin of Ninth (9th) Street to the Southeast corner
of Lot Fifteen (15) in Block Two Hundred Fifty -Nine
(259); thence Northerly along the Easterly line of
said Lot Fifteen (15) across the alley to the Southeast
corner of Lot Six (6) in said Block Two Hundred Fifty -
Nine (259); thence Easterly along the Northerly line of
said alley through said Block Two Hundred Fifty -Nine
(259) and Blocks Two Hundred Sixty (260) and Two Hundred
Sixty -One (261) to the Easterly line of Lot Eight (8)
in said Block Two Hundred Sixty -One (261); thence
Northerly along the Easterly line of said Lot Eight (8)
across Eighth (8th) Street and along the Easterly
line of Lot Thirteen (13) in Block Two Hundred Thirty -
Eight (238) to the point of beginning and containing
the specifically described property which is abutting
upon, adjacent, vicinal and proximal to the streets to
be improved and which constitutes all of the property
to be specially assessed in the improvement district
hereby created, to wit:
Lots Eleven (11), Twelve (12) and Thirteen (13) in
Block Two Hundred Thirty -Eight (238); the South half
of Blocks Two Hundred Thirty -Nine (239), Two Hundred
Forty (240), Two Hundred Forty -One (241) and Two Hundred
Forty -Two (242); Lots One (1), Two (2), Three (3), Four
(4) and Six (6), Seven (7), Eight (8), Nine (9)and Ten
(10) in Block Two Hundred Fifty -Seven (257); the North
half of Blocks Two Hundred Fifty -Eight (258), Two Hundred
Fifty -Nine (259) and Two Hundred Sixty (260); Lots
Eight (8), Nine (9) and Ten (10) in Block Two Hundred
Sixty -One (261); Lots Sixteen,(16), Seventeen (17),
Eighteen (18), Nineteen (19) and Twenty (20) in Block
Two Hundred Fifty -Eight (258); and Lots Eleven (11),
Twelve (12), Thirteen (13), Fourteen (14) and Fifteen
(15) in Block Two Hundred Fifty -Nine (259), all in the
Townsite of Port Angeles, County of Clallam, State of
Washington.
Section 4. That the property specifically described in the
preceding section lies between the termini and within the boundaries
of said district and comprises all of the property especially
benefited by said improvement and said property shall be specially
assessed for the cost and expense of such improvement by the zone
and termini method in accordance with the ordinances of the City
of Port Angeles and the laws of the State of Washington.

Section 5. That bonds bearing interest at the rate of not
to exceed Six (6 %) per cent. per annum, payable on or before
twelve (12) years from the date of their issue, shall be issued
for the payment of the cost and expense of such improvement, which
bonds may be redeemed by the collection of special assessments to
be levied and assessed against the property within said district,
payable in ten (10) annual installments under the mode of "payment
Eby bonds" as provided by law. Said bonds may be delivered to the
j contractors constructing such improvement in redemption of warrants
'on a special fund of the local improvement district herein created
on estimates of the City Engineer, or said City may at its election
sell such bonds and make redemption in cash or cash warrants.
Section 6. This ordinance shall become effective five days
after its passage, approval and publication as required by law.

PASSED BY THE COUNCIL of the City of Port Angeles and approved
by its Mayor this 4th day of March, 1954.
