HomeMy WebLinkAbout1389OM NANCE NO. /eV 7 AN ORDINANCE of the City of Port Angeles, Washington providing for the improvement of a certain area within the City of Port Angeles by the construction and installation of lateral and sanitary sewers therein, including Wyes to serve each lot and by doing all work necessary in connection therewith and incidental thereto pursuant to a petition for the construction of sewer in Block 67 of Leighton's Subdivision of the Townsite of Port Angeles, and providing that the payment of said improvement be made by special assessments on the property of said district, payable by the mode of payment by bonds, and creating a local improvement district therefor and setting forth the property in said district. WHEREAS, a petition has been presented to the City Council of the City of Port Angeles praying for the improvement of that certain hereinafter described area within the City of Port Angeles by the construction and installation of the necessary trunk and lateral sewers, together with all necessary appurtenances to said improvement, and all work necessary in connection therewith; and, WHEREAS, by an examination and survey of said area it is found that said petition was signed by all of the owners of the property to be included in said district and that said sewers will be of special benefit to each of the properties in said dis- trict and that said sewers as constructed will be for the special benefit of said particular lots and of no further general benefit to the City; and, WHEREAS, by said petition the parties on said petition have specifically specified that Lot 18 and the Westerly 18 feet of Lot 17 bear an assessment of $369.40 and that the Easterly 32 feet of Lot 17 and all of Lot 16 in Block 67 of Leighton's Subidivision be assessed in the .sum of $1145.4.5, and it being found that said assessment is sufficient for the purpose of cars tructing said sewer and sufficient for the payment thereof by the method of payment by bonds; and, WHEREAS, the signers of said petition further specifically waived all hearings and notices to be given or required to be given pursuant to statute and specifying for the formation of a local improvement district and agreeing that said local improvement district may be immediately formed without further notice and 1 • • • each of said lots assessed for the cost and expense of the improve- ment in accordance with the statutes of the State of Washington and further specifically agreeing that the construction of said sewer may be made either by competitive bids or dh ne by the forces of the City of Port Angeles without calling for bids in accordance with the determination of the Council; now, therefore, BE rT ORDAINED by the City Council of the City of Port Angeles as follows: Section 1: That the area herein described and consisting of Lot 18 and the Westerly 18 feet of Lot 17 and the Easterly 32 feet of Lot 17 and all of Lot 16 in Block 67 of Leighton's Sub- division of the Townsite of Port Angeles, Clallam County, Washington shall be improved by the construction and installation of the following described improvements: A. By the construction of a sanitary sewer commencing at the manhole located at Fourth and Chase Streets; thence easterly on Fourth Street to a point 5 feet easterly of the westerly line of Lot 18 in said Block 67, together with the necessary Wyes and laterals to bring said sewer to the property line of the petitioners, and including all manholes, lampholes, wyes and appurtenances in accordance with the plans and specifications as originally prepared by the City Engineer. Section 2: That there be, and is hereby established a local improvement district of the City of Port Angeles to be known as Local Improvement District No. 176, which district shall include Lots 16, 17 and 18 in Block 67 of Leighton's Subdivision of the Townsite of Port Angeles. Section 3: That the entire cost and expense of said improve- ment, including all necessary expenses incidental thereto, shall be borne by and assessed against the property included in the local improvement district hereinbefore created. The City of Port Angeles -2- • • shall not be liable in any manner for any portion of the cost and expense of said improvement and the entire cost shall be charged to the parties specially benefitted by said installation of sewers and other work and abutting upon such improvement in accordance with the zone and termini method as established by the statutes and the laws of the State of Washington. Section !J.: Bonds of said local improvement district bearing interest at the rate of not to exceed 6% per annum, payable on or before twelve years from date of issuance, shall be issued in pay- ment of the cost and expense of the improvements provided for herein, which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within the district, payable in ten equal installments with interest at a rate of not to exceed 6% per annum under the mode of "payment by bonds" as defined by law and ordinances of the City of Port Angeles. Any assessments or installments thereof when delinquent, and the interest due thereon, shall bear a penalty of 5% of the total amount thereof from the date of such delinquency. That there be, and is hereby created, a fund of the city to be known as "Local Improvement District No. 176 Fund." Warrants bearing interest at a rate of not to exceed 6% per annum shall be drawn on said Fund based on estimates of the City Engineer in pay- ment of the cost of construction of said improvements and all costs incidental thereto. The money received from the sale of said warrants shall be placed in Local Improvement District No. 176 Construction Fund of the City, to be hereafter created, and shall be used to pay all of such costs. Said bonds shall be delivered to the owner and holder of said Local Improvement District No. 176 Fund warrants in redemption of the same. The rate of interest to be borne by said warrants, bonds and installments of said assessments shall be as hereafter fixed by resolution of the City Council. -3- • • • Section 5: The City Council of the City of Port Angeles do hereby specifically ordain that the construction of said sewers in the area is necessary for the public health of said area and for the health and sanitation of the district and the inhabitants thereof. Section 6: This ordinance shall be effective five days from and after its passage, approval and publication as required by law. PASSED by the Council of the City of Port Angeles, Wash- ington and approved by its Mayor at a regular meeting held this 18th day of April, 1957.
