AN ORDINANCE of the City of Port Angeles, Washington,
providing for the improvement of a certain area
within the City by the construction and installation
of storm trunk sewers, storm lateral sewers and storm
sub - sewers, including manholes, catch basins and all
other work necessary in connection therewith and in-
cidental thereto, pursuant to Improvement Resolution
No. 177 of the City, passed and approved January 16,
1958; creating an enlarged local improvement district
therefor, and providing that the payment for said
improvements be made by special assessments upon
the property in said district payable by the mode
of "payment by bonds."
WHEREAS, on January 16, 1958, the Council of the City of
Port Angeles, Washington, adopted its Improvement Resolution No. 177,
declaring its intention to order the improvement of a certain area
within the City by the construction and installation of storm trunk
sewers, storm lateral sewers and storm sub- sewers, including manholes,
catch basins and all other work necessary in connection therewith and
incidental thereto, and fixing a time for the hearing on such resolution;
and
WHEREAS, such resolution was duly published in the manner
required by law and notice of said hearing was duly given to the
owners or reputed owners of all lots, tracts and parcels of land or
other property to be specially benefited by the proposed improvement
as shown on the rolls of the County Treasurer directed to the address
shown thereon; and
WHEREAS, said hearing was held on February 20, 1958, as
provided in said resolution and notice, and after hearing all protests
and after due consideration of the same the Council determined to order
11/1 the construction of said improvements as set forth and described in
said Improvement Resolution No. 177 and determined that an enlarged
local improvement district be created therefor with the boundaries as
set forth in said resolution and as herein provided;
NOW, THEREFORE, BE IT ORDAINED by the Council of the City
of Port Angeles, Washington, as follows:
Section 1. The area described in Section 2 hereof shall
be improved by the construction and installation of the following
described improvements:
A. Trunk Sewers
1. An 18" trunk storm sewer on the northerly side of 12th
Street to the center line of "B" Street, from "C" Street.
2. A 21" trunk storm sewer on "B" Street from 12th Street to
the southerly side of llth Street.
3. A 21" trunk storm sewer on the southerly side of llth Street
from "B" Street to approximately 125 feet easterly of "A"
Street.
4. A 15" trunk storm sewer on llth Street from approximately
125 feet easterly of "A" Street easterly to the culvert at
the Tumwater Access Road.
B. Lateral Sewers
1. An 8" lateral storm sewer on the westerly side of "C" Street
from 9th Street to 10th Street.
2. A 10" lateral storm sewer on the westerly side of "C" Street
from 10th Street to 16th Street.
3. An 8" lateral storm sewer on the westerly side of "C" Street
from 16th Street to Lauridsen Boulevard.
Together with the necessary manholes, interconnecting sewers, sub -
sewers, catch basins'on "C" Street and all necessary appurtenances
for such improvements, and by doing all work as may be necessary in
connection therewith and incidental thereto, all in accordance with
Ammaps, plans and specifications prepared by the City's engineer and
now on file with the City Clerk, which maps, plans and specifications
are hereby adopted as those necessary and required for these improve-
ments.
Section 2. That there be and is hereby established an
enlarged local improvement district of the City to be known as
"Local Improvement District No. 177," which said district shall

include all the property within the following described area:
Beginning in the alley between 10th Street and
llth Street at the westerly brink of Tumwater
Creek valley in Block 321 Townsite; thence
westerly along said alley to the westerly line
of Lot 5, Block 319 Townsite; thence northerly
along said westerly lot line produced through
Block 300 Townsite to the southerly margin of
9th Street; thence westerly along said southerly
margin of 9th Street to the westerly line of Lot
5, Block 301 Townsite; thence southerly along
said westerly lot line to the alley between 9th
Street and 10th Street; thence westerly along
said alley to the westerly line of Lot 16, Block
302; thence southerly along said lot line produced
through Block 317 Townsite to the southerly margin
of llth Street; thence westerly to the easterly
margin of "E" Street; thence southerly to the al-
ley between llth Street and 12th Street; thence
westerly along said alley to the easterly margin
of "F" Street; thence southerly along said easterly
margin of "F" Street to the northerly margin of
15th Street;.thence easterly along said northerly
margin of 15th Street to the easterly margin of "E"
Street; thence southerly along said easterly margin
of "E" Street to the northerly margin of Lauridsen
Boulevard which is the southwest corner of Block
457 Townsite; thence easterly along said northerly
margin of Lauridsen Boulevard to the westerly right -
of -way line of the Tumwater Access Road; thence
northerly along the westerly brink of Tumwater
Creek Valley to the place of beginning.
Section 3. The entire cost and expense of said improvements,
including all necessary expenses incidental thereto, shall be borne
by and assessed against the property included in the local improvement
district hereinabove created. The City of Port Angeles shall not be
liable in any manner for any portion of the cost and expense of said
improvements.
Approximately 58% of such entire cost shall be charged to
• the properties lying between the termini of such proposed improvements
and extending back from the marginal lines thereof to the middle of
each block (or at least 90 feet back) on each side thereof which are
specially benefited by the construction and operation of said trunk
and lateral storm sewers and appurtenances. Except as hereinafter pro-
vided in this section, such assessments shall be computed by the zone

and termini method.
Approximately 42% of such entire cost, representing the
40 remainder of the cost and expense of such improvements, shall be
charged to and distributed over and assessed against all the prop-
.
erties within the district in accordance with special benefits de-
rived from such improvements without regard to the zone and termini
method of computing assessments.
Section 4, Bonds of said local improvement district bear-
ing interest at the rate of 4 -1/2% per annum, payable on or before
12 years from date of issuance, shall be issued in payment of the
cost and expense of the improvements provided for herein, which
bonds shall be redeemed by the collection of special assessments to
be levied and assessed upon the property within the district payable
in 10 equal installments with interest at a rate of 4 -1/2% per annum
under the mode of "payment by bonds" as defined by law and ordinances
of the City of Port Angeles.
Any assessments or installments thereof when delinquent,
and the interest due thereon, shall bear a penalty of 5% of the total
amount thereof from the date,of such delinquency.
That there be and is hereby created a fund of the City to
be known as "Local Improvement District No. 177 Fund ". Warrants bear-
ing interest at a rate of 4 -1/2% per annum shall be drawn on said Fund
based on estimates of the City's engineer in payment of the cost of
construction of.said improvements and all costs incidental thereto.
Said bonds shall be delivered to the owner and holder of
said Local Improvement District No. 177 Fund warrants in redemption
of the same.

Section 5. This ordinance shall be effective five days
from and after its passage, approval and publication as required by
law.
PASSED by the Council of the City of Port Angeles, Washing-
ton, and approved by its Mayor at a regular meeting of said Council
held this 20th day of March, 1958.
