AN ORDINANCE of the City of Port Angeles repealing certain
sections of the Code of the City of Port Angeles with
reference to gambling and enacting a new ordinance with
reference to the same subject.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PORT ANGELES, as follows:
Section 1. Sections 18.32, 18.33, 18.34, 18.35,
18.36, 18.37, 18.38, 18.39, 18.40 and 18.41 of the Code of the
City of Port Angeles are hereby repealed.
Section 2.
(1) No person shall conduct or operate, whether
as owner, manager or agent, and whether for hire or not, any
gambling game or game of chance, or any scheme or device whereby
any money or property or any representative of either, may be
;bet, wagered or hazarded upon any chance, or uncertain or con-
tingent event.
(2) Every person who shall bet or hazard any
money or property or any representative of either, upon any
'game, scheme or device operated in violation of Section 2, (1)

of this ordinance shall be guilty of misdemeanor.
(3) Every person who shall have in his possession
or shall permit to be placed or kept in any building, vessel
or vehicle owned, leased or occupied by him, any table, slot
bmachine, or any other article, device or apparatus of a kind
commonly use for gambling, or operated for the losing or winning
of any money or propertS, or any representative of either, upon
!any chance or uncertain or contingent event, shall be guilty of
!a misdemeanor.
(4) No person shall sell any pool, make any
Ilbook, or receive, record, register, transmit or forward any
(`bet or wager, or any money or property or thing of value de-
signed or intended to be bet, wagered or hazarded upon the

result of any contest or trial of skill, speed or endurance or
qupon the result of any lot, chance, casualty or uncertain or
contingent event whatsoever.
(5) Every person being in possession or control
of any premises, vessel or vehicle, who shall knowingly permit
the same to be used for the purpose of gambling or swindling
,shall be guilty of a misdemeanor.
(6) It shall be the duty of all police officers
of the City to search for and seize all tables, slot machines
or other articles or devices of the kind commonly use for gam-
bling and take the same before the Police Judge of the City.
If in the judgment of such Police Judge any of such articles
may be useful as evidence in the trial of any case, he may order
'the same held for such trial, or delivered to the City or County
Prosecutor; otherwise, he shall order the same destroyed. After
the final hearing and disposition of any case in which any of
such articles may be held or used as evidence, whether such case
results in conviction or acquittal, the Police Judge shall forth-
with order all such articles destroyed.
(7) It shall be unlawful to sell, distribute,
(lend, lease, operate, use or play or permit to be operated, used
or played any slot machine.
(8) It shall be unlawful for any person under
the age of twenty -one years to use, operate or play any gambling
'device, and it shall be unlawful for any owner, agent or other
person in charge or control of any premises, vessel or vehicle
4111 where any such devices are kept or operated to permit or allow
Ilany person under the age of twenty -one years to use, operate or
play such device.

(9) Notwithstanding any other provisions of this
ilordinance, it shall not be a violation of this ordinance:

1 -a For any person to have in his possession, or
(permit to be placed in any building, vessel or vehicle owned or
leased or occupied by him, or to conduct, carry on or operate,
,whether as owner, agent, whether for hire or not, or for any
person to participate in the use of any machine or mechanical
device which is not manufactured or equipped with automatic pay-
off mechanism, registers free plays and permits the playing of
:additional games, the operation of which depends in any part
'upon the skill or manual dexterity of the player.
2 -a It shall, however, be unlawful for the user
of any device described in the preceding paragraph to receive
any money, credit, allowance or thing of value, or any check,
slug, token or memorandum, whether of value or otherwise, which
may be exchanged for any money, credit, allowance or thing of
'value or which may be given in trade.
b To own, operate or conduct or permit to be
operated or conducted, or to participate in the operation of any
public card room not to exceed eight tables wherein persons en-
gage in games of skill, in which success depends upon knowledge,
lattention, experience, and the skill of the player whereby ele-
hlments of chance in any such game are overcome, improved or turned
to the advantage of said player, except for poker, blackjack, and
faro.
c To sell, operate or use, or permit to be opera -
Ited or used, or to participate in the use thereof, or to possess,
exhibit or display any sales board intended for trade simulation
purposes where tobacco products or confections only are the prizes:
Provided that said board contains not over three- thousand holes
plat a maximum charge of ten cents each, is not graduated and all
merchandise available on the board is displayed with the board.

d To sell, operate or use, or permit to be
operated or used, or participate in the use thereof, or to
possess, exhibit or display any cards, slips, discs, markers,
spheres or cages intended for use in the game of bingo, pro-
vided, that such use is conducted by and for the benefit of
a bona fide and non - profit charitable, religious, veteran,
fraternal, civic, athletic or other non - profit organization
duly existing under the laws of the State of Washington, and
that the proceeds thereof are not to inure to the profit of any
individual.
e For any business, club or association en-
gaged in the selling of goods, wares and merchandise, including
beverages to allow its customers to determine between themselves
and with the establishment to determine who shall pay for the
product being sold, and it shall not be unlawful for a customer
to engage in such determination.
f For any business, club or association to
allow its customers to conduct a pool among themselves upon the
result of any contest or trial of skill, speed or endurance,
and it shall not be unlawful for any customer to engage in such
;pool: Provided that, the business, club or association receives
no money or thing of value from said pool.
2 To sell, possess, exhibit or display any
'raffle ticket: Provided that, such raffle is conducted by and
for the benefit of a bona fide non - profit charitable, religious,
veteran, fraternal, civic, athletic or other non-profit organi-
zation duly existing under the laws of the State of Washington,
and that the proceeds thereof are not inure to the profit of any
individual.
PASSED by the City Council of the City of Port
Angeles and approved by its Mayor at a regular meeting of the
'Council held on this 4/1% day of , 1965.
