ORDINANCE NO. /1'4/7
AN ORDINANCE of the City of Port Angeles
amending Ordinance No. 1180 as to power
driven wheelchairs.
WHEREAS it is the policy of the City of Port Angeles to
encourage and enable the physically handicapped to participate
fully in the social and economic life of the City; and
WHEREAS the physically handicapped should have the same
rights as the ablebodied to the full and free use of the streets,
highways, walkways, and other public places, subject only to the
conditions and limitations established by law and applicable alike
to all persons;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT
ANGELES DOES ORDAIN AS FOLLOWS:
Section 1. There is hereby added to Section 1 of Ord-
inance No. 1180 the following language: "Provided further that the
term 'Pedestrian' shall, in addition to the definition and use set
out in the said Motor Vehicle Act, include and be construed to apply
to physically handicapped persons operating power- driven wheelchairs
or similar devices incapable of speeds in excess of five (5) miles
per hour, it being the intention of the City Council that such
devices shall not be construed to be motor vehicles nor be required
to comply with those sections applicable to motor vehicles."
Section 2. Pursuant to RCW 35A.12.130 a copy of Ordin-
ance No. 1180 is attached hereto and by this reference is incorpor-
ated herein.

AN ORDINANCE Relating to and regulating traffic and travel
and their incidents upon the streets, avenues, alleys and public
highways of the City of Port Hn;eles; providing for vehicle
equipment and devices and the inspection thereof; limiting and
restricting certain uses of the _public highway of the City;
prescribing rules of the road for vehicular and other traffic on
the public highways of the City; providing for the conduct in
the event of vehicle accident and for making reports thereof;
Prescribing the powers and duties of peace officers and other
persons in relation thereto; defining offenses;' providing pen-
alties; repealing certain ordinances relating to the subject of
this ordinance; saving certain acts performed; providing for
the adoption by ordinance of the Washington Motor Vehicle Act
and amendments and additions thereto, being Chapter •139 of the
Session Laws of 1937, and amendments and additions thereto; and
declaring an emergency.
THE CITY COMMISSION OF THE CITY OF PORT ANGELES DOES ORDAIN
AS F0LL0 as :
Section 1. The Washington Motor Vehicle Act, being Chap-
ter 189 of the Session Laws of 1937, and all amendments and addi-
tions thereto, is hereby adopted by reference, as provided by
Chapter 213 of the Session Laws of 1943; as an ordinance for the
City of Port Angeles; provided, that not less than three copies
of said Chapter 189-of the Session Laws of 1937, and amendments
and additions thereto, be filed for use and examination by the
public in the office of the City Cleric of the City of Port Angeles.
Section 2. All ordinances in conflict herewith are hereby
repealed.
Section 3. This ordinance,is necessary for the immediate
preservation of the public peace, health and safety, and having been
passed by unanimous vote of the Commission, shall take effect imme-
diately upon its passage, approval and lawful publication.
Passed first reading by the City Commission the s 26th day
March, . 1947.
Passed second reading by the City Commission this 26th day
of March, 1947.
Passed third reading and finally passed and adopted this
day of April, 1947.
