ORDINANCE NO. 02/09
AN ORDINANCE of the City of Port Angeles
amending Ordinance No. 1709 and the
Municipal Code by adoption of a new
chapter containing procedures and
standards for the Office Commercial
District; and repealing Article IV,
Section 5, Ordinance No. 1709.
WHEREAS, the necessary public hearings have been held;
and
WHEREAS, the requirements of Chapter 35A.63 RCW and
Chapter 43.21C RCW have been met and a public hearing has been
held by the City Council following public notice; and
WHEREAS, the Planning Commission has recommended to the
City Council that the Zoning Ordinance (Ordinance No. 1709) and
the Municipal Code be amended by adopting a new chapter containing
procedures and standards for the Office Commercial District; and
WHEREAS, the City Council finds it to be in the best in-
terests of the City of Port Angeles; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT
ANGELES as follows:
Section 1. There is hereby created a new chapter of the
Zoning Ordinance (Ordinance No. 1709) and a new chapter of the
Port Angeles Municipal Code, to be known as Chapter 17.20, Office
Commercial District.
Section 2. Section 17.20.010 PURPOSE OF THE OFFICE
COMMERCIAL ZONE. It is for those business, office, administrative
or professional uses which do not involve the retail sale of goods,
but rather provide a service to clients, the provision of which
does not create high traffic volumes, involve extended hours of
operation, or contain impacts that would be detrimental to adjacent
residential areas.
Section 3. Section 17.20.040 PERMITTED USES:
A. SERVICES
1. Professional, such as dentists, doctors, lawyers, archi-
tects, engineers.
2. Banks, financial institutions, insurance and real estate
services.
3. Medical- dental clinics and offices and laboratories.
B. RESIDENTIAL
1. Those residential uses permitted in the RMF District, at
the RMF density requirements.
Section 4. Section 17.20.080 ACCESSORY USES. Those uses
incidental and accessory to the primary use as defined in Ordinance
No. 1709 as amended, are permitted.

Section 5. Section 17.20..160. CONDITIONAL USES
A. Uses requiring review and approval by the Planning Commission
and City Council and compliance with Ordinance No. 1709 as
amended:
Churches
Buildings or development necessary for the
operation of a public utility
Business colleges; music, art and dance schools
Child nurseries, day care centers
Rest, retirement and convalescent homes
Detoxification centers.
Section 6. Section 17.20.200 AREA AND DIMENSIONAL RE-
QUIREMENTS:
A. AREA - 7,000 square feet for non - residential uses. Residen-
tial uses shall comply with the RMF area requirements.
B. LOT WIDTH - 50 feet for non - residential and residential uses.
C. SETBACKS:
Front - 25 feet from property line.
Rear - 25 feet from property line. Detached accessory build-
ings shall not be permitted closer than 10 feet to the
rear property line.
Side - 7 feet from the property line. Detached accessory
buildings only on the rear one -third of the lot may be
permitted to within 3 feet of the side line. On corner
lots the side yard abutting the street shall have a
building line setback of 13 feet.
D. MAXIMUM LOT COVERAGE - 45%
E. MAXIMUM BUILDING HEIGHT - 30 feet.
Section 7. Section 17.20.210 PARKING. Parking spaces
shall be provided as required in Ordinance No. 1588 as amended.
Section 8. Section 17.20.220 SIGNS. Signs shall not
exceed 50 square feet. Signs may be lighted, but shall not be the
intermittent or flashing type. All freestanding signs shall not
exceed five feet in height. All other signs shall not exceed 30
feet in height.
Section 9. Section 17.20.230 DESIGN AND LANDSCAPING
A. All outdoor storage areas shall be screened from public view.
B. All lighting on the site shall be so directed as to reflect
away from adjoining property.
C. The side yard abutting a residentially zoned lot shall be land
scaped in a manner that is complementary or similar to residen
tial landscaping: shrubs of 3' to 6' mature height inter-
spersed with evergreen and /or deciduous and /or ornamental

trees. Five feet of the rear yard setback area abutting a
residentially zoned lot shall be landscaped in a similar man-
ner.
The unused space resulting from the design of parking space
arrangements or accessory structures which is over 24 square
feet shall be landscaped.
All landscaping shall comply with the vision clearance require-
ments of Ordinance No. 1709 as amended.
All non - residential structures shall be designed to be com-
patible with the residential environment.
One tree of a mature height of at least 20' per 10 parking
spaces.
All parking lots shall be screened by 3' to 6' vision obscur-
ing fence or vegetation on the sides adjacent to residentially
zoned property.
Section 10. Section 17.20.300 REPEALER: Article IV,
Section 5, of Ordinance No. 1709 is hereby repealed.
Section 11. Section 17.20.310 SEVERABILITY: If any pro-
visions of this Or inance, or its application to any person or cir-
cumstance, is held invalid, the remainder of the Ordinance, or ap-
plication of the provisions of the Ordinance to other persons or
circumstances, is not affected.
Section 12. Section 17.20.320 EFFECTIVE DATE: This Or-
dinance shall be effective five (5) days after publication.
PASSED by the City Council of the City of Port Angeles at
a regular meeting of the Council held on the jgk day of
1980.

RE: Zoning Code Amendment -- Office Commercial Zone

Attached is a copy of the new Office Commercial Zone amendment
to the Zoning Ordinance. This Ordinance will replace the Resi-
dential Buffer Zone in our current Zoning Ordinance.
As noted in the memorandum distributed for the November 4th
meeting, the new zone eliminates many of the problems contained
in the old zone. The Commission unanimously recommended adop-
tion of this new zone at its October 22nd meeting.

Therefore, a simple motion is sufficient.)
