ORDINANCE NO.
AN ORDINANCE of the City of Port Angeles
adopting regulations of the Port of
Port Angeles regarding traffic, parking,
and trespassers; and adding new sections
to Title 9 and 10 of the •Port Angeles
Municipal Code.
WHEREAS, the Board of Commissioners of the Port of Port
Angeles, Washington, has adopted, by Commissioners' Resolution
No. 523, traffic, parking, and trespassing regulations at a
regular meeting held at least ten days after notice was published
in a legal newspaper of general circulation in the port district,
pursuant to RCW 53.08.220; and
WHEREAS, the said Commissioners of the Port of Port
Angeles have passed a resolution, No. 524, respectfully requesting
the City of Port Angeles to adopt the said regulations as part of
the ordinances of the City of Port Angeles; and
WHEREAS, said regulations are consistent with other
ordinances of the City of Port Angeles; and
WHEREAS, adopting and enforcing the regulations of the
Port of Port Angeles will benefit the citizens of the City of Port
Angeles by helping to regulate and control persons and vehicular
traffic in and on Port property within the city limits of the City
of Port Angeles; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT
ANGELES, as follows:
Section 1. There is hereby added to Title 10 of the Port
Angeles Municipal Code, a new section, to be placed in Chapter
10.08, as follows: •
' 10.0'8.010 Traffic Regulations for the Port of fort Angeles.
(A) No person shall drive a vehicle on any Port of Port
Angeles roadway or access area at a speed greater than is
reasonable and prudent under the conditions and having regard to
the actual or potential hazards then existing. In every event the

speed shall be so controlled as may be necessary to avoid collid-
ing with any person, vehicle or other conveyance on or entering
roadways or access areas in compliance with state motor vehicle
laws and the duty of all persons to use due care and caution.
(B) No person shall drive a vehicle on Port of Port Angeles
roadways or access areas at a speed in excess of maximum limits
clearly posted by the Executive Director of the Port of Port
Angeles.
(C) Any speed limits authorized and established hereunder
shall be effective when signs giving notice thereof are erected.
Section 2. There is hereby added to Title 10 of the Port
Angeles Municipal Code, a new section to be placed in Chapter
10.08, as follows:
10.08.020 Parking Regulations for the Port of Port Angeles.
(A) The Executive Director of the Port of Port Angeles shall
designate areas in which parking is allowed, freely or by author-
ization, or not allowed, by appropriate markings on the ground
and /or signs posted on or about the areas, clearly giving notice
thereof.
(B) No parking or stopping of vehicles shall be allowed in
roadways or areas designated for access, except in the areas
designated for loading and /or unloading freight, boats and /or
passengers.
(C) Vehicle parking without a permit shall be allowed in all
designated parking areas unless clearly marked as restricted
parking areas. Restricted areas shall include, but are not
limited to, areas marked "PERMIT PARKING ONLY," "PORT OF PORT
ANGELES VEHICLES ONLY," "LOAD - UNLOAD ONLY," "DISABLED PARKING
ONLY," or such other areas as the Executive Director of the Port
of Port Angeles may determine.
(D) Vehicles authorized to park in restricted areas are as
follows:
(1) PORT OF PORT ANGELES VEHICLES
Port owned vehicles with. insignias.

(2) LOAD /UNLOAD ONLY
Trucks, licensed commercial vehicles, and attended
vehicles loading and /or unloading freight, boats, and /or passen-
gers, for a reasonable period of time necessary to accomplish the
loading and /or unloading, but in no event over fifteen (15)
minutes.
(3) PERMIT PARKING ONLY
Vehicles which clearly display parking permits
obtained from an employee of the Port authorized to issue such
permits. Such permits shall be as follows:
(a) Permanent numbered parking permits clearly
attached to the front window or bumper;
(b) Temporary parking permits clearly displayed
face upwards on the dash board or other area of the car there-
abouts.
(4) DISABLED PARKING ONLY
Vehicles which clearly display, attached to the
back window, windshield or bumper, disabled parking permits
issued by a state, county, city, or other local government, or an
employee of the Port authorized to issue disabled parking permits.
(5) OTHER RESTRICTED PARKING
The Executive Director of the Port of Port Angeles
may designate other restrictions on parking, including but not
limited td the following; employee parking only, rental car
parking only, no overnight camping, and attached boat trailers
only.
(E) The Executive Director of the Port of Port Angeles
shall determine procedures for issuing parking permits, including
types and forms of permits, fees for obtaining permits, employees
authorized to issue permits, locations for the issuance of permits
or any other rules reasonably necessary to issue permits in a fair
and reasonably efficient manner.

Section 3. There is hereby added to Title 10 of the Port
Angeles Municipal Code, a new section to be placed in Chapter 10,
as follows:
10.08.030 Violation's of Port of Port Angeles Traffic and
Parking Regulations.
(A) Violation of any Port of Port Angeles traffic or
parking regulation adopted and executed according to and under
the authority of this chapter shall be civil traffic or parking
infractions punishable to the same extent and under the same
procedures as other similar civil traffic and parking ordinances,
codes, and statutes of the City of Port Angeles, including but not
limited to the provisions of Title 10 of the Port Angeles Munici-
pal Code.
Section 4. There is hereby added to Title 9 of the Port
Angeles Municipal Code, a new section to be placed in Chapter 9.16,
as follows:
9.16.065 Unauthorized Persons /Trespassers on the Port of
Port Angeles.
(A) The Executive Director of the Port of Port Angeles may
designate 'certain areas to which access by members of the public
is restricted and /or prohibited, unless authorized herein.
Restricted areas shall be clearly designated by markings on the
ground and /or signs clearly posted in and about the areas so
designated. Restricted areas may also, where practical, be
separated from unrestricted areas by fences, barriers, gates, or
other appropriate obstructions to free passage.
(B) Restricted areas - shall be marked "RESTRICTED AREA /NO
TRESPASSING; Authorized personnel only."
(C) Authorized persons shall include:
(1) Employees of the Port.
(2) Stevedores and stevedore employees in the perfor-
mance of their operations.

(3) Agents, employees, or guests of vessels berthed at
the marine terminal.
(4) Owners of vessels moored in the Port Angeles boat -
haven or their guests or visitors. Visitor hours may be limited
as deemed necessary by the Executive Director of the Port of Port
Angeles. Visitor hours shall be posted at ramps, walkways, or
other access areas.
(5) Owner's or operators of aircraft, stopped, parked,
or tied down in the Port Angeles airport or their guests.
(D) Violation of this section shall be a Class I misdemeanor
if the trespass occurs in or on a building, boat or plane. Each
violation occurring in or on any other area shall be a Class II
misdemeanor.
Section 5. If any provision of this ordinance, or of the
codes referred to herein, or its application to any person or
circumstance is_held invalid, the remainder of the ordinance, or
the application of the provision to other persons or circumstances
is not affected.

Adoption of Port or Port Angeles
Traffic, Parking and Pedestrian
Regulations
The Board of Commissioners of the Port of Port Angeles has
adopted traffic, parking and trespassing regulations and
requested that the City of Port Angeles adopt those same
regulations.
RCW 53.08.220 gives the City the authority to adopt such
regulations or amend or appeal the regulations in accordance
with the terms of the request. The regulations then become
ordinances of the City and enforceable by the City's law
enforcement officers.
Adoption of these ordinances will essentially give the -Port
Angeles Police Department the authority to go onto Port
property and issue tickets for violations of these traffic,
parking and trespassing regulations. Tickets written by the
Port Angeles Police Department will be enforced in Municipal
Court and fines will be collected by the City to compensate
it for the extra duties.
Both the Port Angeles Police Department and the City Attorney's
Office recommend adopting these regulations in order to give
the City a uniform basis to enforce traffic, parking and
trespassing regulations throughout our city. There have been
numerous instances of improper use of vehicles on the runway
at the airport and other Port property, persons trespassing
on boats and docks at the boathaven and other Port areas, and
problems with congestion wherever parking is allowed on Port
property. These regulations were drafted by the Port's
attorney and redrafted by our office to insure that they are
consistent with state law and city traffic regulations already
in effect. Adoption of these regulations and this ordinance
will make enforcement of traffic and parking regulations, as
well as the authority of the Police Department, more uniform
throughout the City.
