AN ORDINANCE of the City of Port Angeles
vacating a portion of Peabody Street south
of Viewcrest Avenue
WHEREAS, a petition is on file with the City of Port
Angeles to vacate the westerly portion of Peabody Street abutting
Lot 1 and the north 20 feet of Lot 2, Block 27, Grant's Addition;
and
WHEREAS, the requirements of Chapter 43.21C RCW, the
State Environmental Policy Act, have been met and a public hear-
ing has been held by the City Council following public notice
pursuant to Chapter 35.79 RCW; and
WHEREAS, said vacation appears to be of benefit to and
in the interest of the public; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT
ANGELES as follows:
Section 1. Vacation. Subject to the terms and condi-
tions of this Ordinance, the following described portion of
Peabody Street is hereby vacated:
All that portion of Peabody Street abutting Lot 1 and
the north 20 feet of Lot 2, Block 27, of Grant's
Addition to Port Angeles as recorded in Volume 1 of
Plats, page 32, Records of Clallam County, Washington,
being more particularly described as follows:
Beginning at the northeast corner of Lot 1, Block 27,
of Grant's Addition, thence easterly along a line of
Lot 2 extended 22 feet; thence southerly 70 feet along
a line parallel to Lot 1 and the north 20 feet of Lot
2, to a point 25 feet easterly of the southeast corner
of said north 20 feet of Lot 2 extended; thence
westerly along said south line extended 25 feet to the
southeast corner of the north 20 feet of said Lot 2;
thence northerly along the easterly line of said south
20 feet of Lot 2 and all of Lot 1 a distance of 70 feet
to the point of beginning.
Section 2. Condition. That a 10 -foot easement
adjacent to Viewcrest Avenue be granted for the construction,
repair and maintenance of utilities and streets.
Section 3. Quit Claim Deed. Upon compliance with the
terms and conditions of this Ordinance, the owner of abutting
property entitled to the vacated street, pursuant to RCW
35.79.040, may present a quit claim deed to the City of Port
Angeles for execution by the Mayor, who is hereby authorized and
directed to execute such quit claim deed. Such quit claim deed
shall include all reservations, conditions, or other qualifica-
tions upon the title established by this Ordinance.
Section 4. Effective Date. This Ordinance shall be
effective only upon the satisfaction of the terms and conditions
of this Ordinance, and the Clerk is hereby directed to file,
record and publish this Ordinance upon that satisfaction.
