AN ORDINANCE of the City of Port Angeles
annexing Federally owned land on Ediz
Hook and adjacent tidelands and harbor
area.
WHEREAS, Substitute House Bill 253, which became effec-
tive July 28, 1985, provides that a code city may annex unincor-
porated Federally owned area contiguous to the City by adopting
an ordinance providing for the annexation and acknowledging an
agreement of the annexation by the government of the United
States; and
WHEREAS, SHB 253 also provides that the City shall pro-
vide written notice of the proposed annexation to the legislative
authority of the county at least thirty (30) days before the city
proposes to adopt the annexation ordinance and precludes adopting
the ordinance if within twenty -five (25) days of receipt of the
notice the county legislative authority adopts a resolution
opposing the annexation and making a finding that the proposed
annexation will have an adverse fiscal impact on the county or
road district; and
WHEREAS the United States Government, acting by and
through the United States Coast Guard, which exercises exclusive
legislative jurisdiction on the land to be annexed, has agreed to
the proposed annexation, provided that the annexation does not
alter Federal ownership of the land or affect Federal jurisdic-
tion over it; and
WHEREAS, the Board of Clallam County Commissioners has
been given thirty (30) days' notice of the proposed annexation
and has not adopted a resolution in opposition; and
WHEREAS, the purpose of the annexation is to allow
consistent regulation of the entire Port Angeles Harbor area and
to allow provision of City services such as Medic I, to the Coast
Guard base; and
WHEREAS, the requirements of Chapter 43.21C RCW have
been met;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT
ANGELES DOES ORDAIN as follows:
Section 1. All of the area described in the attached
Exhibit "A ", which area is contiguous to and east of the present
City limits on Ediz Hook, is owned by the Federal government and
is now occupied by the Coast Guard Base, including all the tide-
lands on each side of said area and the entire Port Angeles
Harbor area from the end of Ediz Hook to the eastern City
boundary on the mainland, is hereby annexed to the City limits of
Port Angeles and shall be subject to the municipal jurisdiction
of the City, provided that said jurisdiction shall neither alter
Federal ownership of the land area hereby annexed nor affect
Federal jurisdiction over said area, in accordance with the terms
of the agreement of the United States to the annexation, which
agreement is hereby acknowledged.
Section 2. This ordinance shall take effect as
provided by law.
PASSED by the City Council of the City of Port Angeles
at a regular meeting of said Council held on the ayik day of
1985.

Annexation of Coast Guard Area
Legal Description
All that tract of land reserved for lighthouse purposes by
Executive Order No. 753 of February 10, 1908, bounded on the west
by that portion of out -lot seven annexed to the City of Port
Angeles by Ordinance No. 483 passed February 2, 1915, and
effective February 10, 1915, and extending easterly to include
the balance of out -lot seven, all of out -lots eight, nine, ten
and eleven, all in Township thirty -one north, range six west,
Willamette Meridian, of the Ediz Hook or False Dungeness Light-
house Reservation, Washington; also all the tidelands on the
Strait of Juan de Fuca and on Port Angeles harbor abutting on
those portions of the Ediz Hook Lighthouse Reservation heretofore
described and including all the tidelands on each side of the
said Ediz Hook and all of Port Angeles Bay or all that part
thereof not now within the city limits.
