AN ORDINANCE of the City of Port Angeles
amending procedures for the disposal of
surplus real and personal property of
the City of Port Angeles, and amending
Ordinance 2168 and Chapter 2.60 of the
Port Angeles Municipal Code.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PORT ANGELES, as follows:
Section 1. Section 5 of Ordinance 2168 and PAMC 2.60.050
are hereby amended to read as follows:
SECTION 5. Sale at Public Auction. All sales of city
property, not otherwise exempt from the provisions of this ordi-
nance, shall may be sold at public auction. The City Council
may determine whether such auction shall be by closed bid, or
by public auction. If the Council determines that the sale is
to be by public auction, the City Council shall determine the
time and location of such public auction.
Section 2. Effective Date. This ordinance shall become
effective in the manner provided by law.

SUBJECT: Amendment to Surplus Property Ordinance
ISSUE: Should the City's Surplus Property Ordinance be amended
to clarify that the disposition of surplus property by auction
is optional?
BACKGROUND /ANALYSIS: State law requires only that intergovern-
mental property disposition over $5,000 be preceded by public
hearing and declaration that the property is surplus. City ordi-
nance requires this procedure for disposition of property worth
over $5,000 to all persons or entities except in emergencies.
After property has been declared surplus, there is no requirement
in State law as to how it is sold or otherwise transferred.
City ordinance, however, clearly requires personal property to
be put up for public auction or sealed bid and is ambiguous as
to whether or not real property must be auctioned off.
The proposed amendment to the ordinance would allow for more
flexibility in property transfers and would resolve the existing
ambiguity by making it optional to dispose of all surplus property
by auction or bid.
RECOMMENDATION: It is recommended that the City's Surplus Property
Ordinance be amended to clarify that the disposition of surplus
property is optional.
