AN ORDINANCE of the City of Port Angeles
vacating that portion of West 18th Street
abutting Blocks 449 and 456, TPA.
WHEREAS, a petition and a request are on file with the
City of Port Angeles to vacate that portion of West 18th Street
abutting Lots 11 through 20, Block 449, and Lots 1 through 8,
Block 456, Townsite of Port Angeles; and
WHEREAS, the City Council initiated said vacation by
Resolution No. 26 -89; and
WHEREAS, the requirements of Chapter 43.21C RCW, the
State Environmental Policy Act, have been met and a public hear-
ing has been held by the City Council following public notice
pursuant to Chapter 35.79 RCW; and
WHEREAS, said vacation appears to be of benefit to and
in the interest of the public; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT
ANGELES as follows:
Section 1 Vacation. Subject to the terms and condi-
tions of this Ordinance, the following described street is hereby
vacated:
That portion of West 18 Street abutting Lots
11 through 20, Block 449, and Lots 1 through
8, Block 456, Townsite of Port Angeles,
Clallam County, Washington.
Section 2 Compensation. Pursuant to RCW 435.79.030,
the compensation required for the vacation of this street is
$ 6,237.00
Section 3 Easement Retained. An easement for existing
utilities over the portion of West 18th Street, is hereby retained
by the City of Port Angeles and shall be formally granted to the
City by written easement from the owners of the property adjacent
to said street.

Section 4 Quit Claim Deed. Upon compliance with the
terms and conditions of this Ordinance, including the conditions
set forth in the July 26, 1989, letter from the Washington State
Department of Transportation, which letter is attached hereto as
Exhibit "A" and is incorporated herein by this reference, the
owners of abutting property entitled to the vacated street,
pursuant to RCW 35.79.040, may present a quit claim deed to the
City of Port Angeles for execution by the Mayor, who is hereby
authorized and directed to execute such quit claim deed. Such
quit claim deed shall include all reservations, conditions, or
other qualifications upon the title established by this Ordinance.
Section 5 Effective Date. This Ordinance shall be
effective only upon the satisfaction of the terms and conditions
of this Ordinance, and the Clerk is hereby directed to file,
record, and publish this Ordinance upon that satisfaction.
PASSED by the City Council of the City of Port Angeles
at a regular meeting of said Council held on the 17th day of
October, 1989.

This is to advise you that the Washington State Department of Transportation has
no objection to your vacation of that part of 18th Street lying between B and C
Streets. We have no objection to vacating the entire width in favor of
Mr. Burt Reid, so long as the following conditions are made part of your vacation
ordinance:
1. The proponent is to pay all fees and costs associated with the vacation.
2. The proponent is to prepare and grant the state an easement to an improved
access along and within a 25 -foot wide strip adjacent to the state property.
3. The easement will be maintained by the proponent and his sucessors in
interest.
4. There shall be no barrier to the state at either end of this strip except for
such intermittent uses as may be normal and customary for access to the
adjoining mini- storage facility.
It is our understanding that the proponent has already agreed to the above
conditions. For this reason, we feel that it is not necessary for the state to join
the vacation action. This letter expresses our wishes and demands in this matter.
