AN ORDINANCE of the City of Port Angeles, Washington,
providing for regulation of water system cross -
connections, amending Ordinance No. 2181 and
Chapters 13.24 and 13.28 of the Port Angeles
Municipal Code, and repealing PAMC 13.24.050 and
Chapter 1, Section 5 of Ordinance No. 2181.
WHEREAS, the City of Port Angeles is a public purveyor
of potable water to all areas within the boundaries of the City
of Port Angeles and to certain surrounding areas; and
WHEREAS, contamination of the potable water system by
its users is and can potentially be caused by inadvertent cross -
connections; and
WHEREAS, there is a need to protect from such present
and potential contamination the water system and the health and
safety of the public;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT
ANGELES DOES HEREBY ORDAIN as follows:
Section 1 - Purpose. The purpose of this Ordinance is
to protect the potable water supply of the City of Port Angeles
from contamination or pollution by the elimination of existing
cross - connections and the control of potential cross - connections.
Section 2. Chapter 1 of Ordinance 2181 and Chapter
13.24 of the Port Angeles Municipal Code are hereby amended by
adding the following sections:
13.24.014 Airqap. "Airqap" means a backflow prevention
device that provides an unobstructed vertical distance of at
least twice the inside diameter of the supply line, but never
less than one (1) inch, through the free atmosphere between a
supply line outlet and the overflow rim of a receiving vessel.
13.24.015 Backflow. "Backflow" means the flow of water or
other liquids, mixtures, or substances into the distribution

pipes of a potable supply of water from any source or sources
other than its intended source.
13.24.016 Backflow Prevention Device. "Backflow prevention
device" means a device assembly or means to prevent backflow
into the potable water system either by back - siphonaae or back
pressure.
13.24.017 Back Pressure. "Back pressure" means the
backflow of used, contaminated, or polluted water from a plumbing
fixture or vessel into a water supply pipe due to pressure
created by booster pumps toilets pressure vessels, or elevated
plumbing that exceeds the main pressure or operating pressure of
the water supply pipe.
13.24.018 Back - siphonaae. "Back- siphonaae" means the
backflow of used, contaminated or polluted water from a plumbing
fixture or vessel into a water supply pipe due to a negative
pressure in such pipe.
13.24.019 Cross - Connection. "Cross- Connection" means any
physical arrangement whereby the public water supply system is
connected, directly or indirectly, with any non - potable or
unapproved water supply system, sewer, drain, conduit, pool,
storage reservoir plumbing fixture or other device which
contains or may contain contaminated water. liquid, gases,
sewage, or other waste of unknown or unsafe auality, which may
be capable of imparting contamination to the public water supply
as a result of backflow.
Section 3. Section 7, Chapter 2 of Ordinance 2181 and
Section 13.28.070 PAMC are each amended to read as follows:
13.28.070 Cross - Connections Prohibited:
A. The installation or maintenance of a cross - connection
is prohibited.
B. Any such cross - connection now existing or hereafter
installed is declared a nuisance and shall be abated immediately.

The standards for control or elimination of cross - connections
shall be in accordance with the State of Washington Administra-
tive Code (WAC 248 -54 -285) as now enacted or hereafter amended
((, together with any future manuals of standard practice
pertaining to cross connection control approved by the Director
of the State of Washington Department ef Social and IIealth

)). The policies, procedures. and criteria for
determining appropriate levels of protection shall be in
accordance with the accepted procedure and practice in Cross
Connection Control Manual - Pacific Northwest Section - American
Water Works Association, fourth edition or any superseding
edition. which is hereby adopted by reference.
C. Water service will be discontinued to any premises for
failure to comply with the provisions of this Section.
D. Furnishing of water service shall be contingent upon
the customer providing cross - connection control approved by the
appropriate Health Authority and the Director for protecting the
City water supply from backflow.
Section 4. Section 3, Chapter 2 of Ordinance 2181 and
Section 13.28.030 PAMC are each amended to read as follows:
13.28.030 Inspection.
A. Authorized employees of the City, properly identified,
ohall have access, at reasonable hours of the day, to all parts
of a premises or buildings to which water is supplied by the
tion3. Right of entry by City employees for inspection shall be
governed by PAMC 1.20.010.
B. Whenever the owner of any premises supplied by the
Department restrains authorized City employees from making such
necessary inspections, a reduced pressure principle backflow
assembly shall be installed at the owner's expense, or water
service may be refused or discontinued.

Section 5. Chapter 2 of Ordinance 2181 and Chapter
13.28 of the Port Angeles Municipal Code are hereby amended by
adding the following section:
13.28.075 Procedure for Abatement of Unlawful Cross -
Connections and Installation of Backflow Prevention Devices.
A. In the event the Director determines that a cross -
connection exists, written notice shall be sent to the person in
whose name the water service is established under the records of
the City of Port Angeles Department of Public Works.
B. The notice shall provide that the cross - connection
described therein shall be corrected within thirty (30) days of
the date said notice is mailed to the customer.
C. In the event said cross - connection is not abated within
the prescribed time, water service to said premises shall be
discontinued or disconnected from the main at the customer's
expense provided that if the customer leases or rents the
premises, this provision shall not preclude the customer from
obtaining reimbursement for such expense from the lessor or
landlord, nor shall it preclude the lessor or landlord from
paving the expense in the first instance.
D. In the event the cross - connection in the opinion of
the Director, presents an immediate health hazard or a danger of
contamination to the public water supply, service from the City's
water supply system to the premises may be terminated without
prior notice; provided however, notice will be posted on the
premises at the time said service is terminated.
E. If a backflow prevention device has been installed
prior to the updated approved list from the Department of Social
and Health Services and can no longer meet testing requirements
or be repaired, said assemblies or devices shall be replaced with
a new, approved device upon order of the Director.

Section 6. PAMC 13.24.050 and Chapter 1, Section 5 of
Ordinance 2181 are hereby repealed.
Section 7 - Effective Date. This Ordinance shall be
effective five (5) days after date of publication.
