AN ORDINANCE of the City of Port Angeles
annexing approximately 6.91 acres into
the City of Port Angeles.
WHEREAS, pursuant to RCW 35A.14.120, the necessary
petition has been filed with the City of Port Angeles requesting
annexation of the following described area to the City of Port
Angeles which is contiguous to said City; and
WHEREAS, the necessary legal steps in connection with
said petition have been completed, including the holding of a
public hearing on said petition after due and legal notice
thereof; and
WHEREAS, the requirements of Chapter 43.21C RCW have
been met; and
WHEREAS, the Council of the City of Port Angeles
believes that it is in the best interests of the City and its
residents that said petition for annexation be granted; NOW,
THEREFORE,
THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES
ORDAIN as follows:
Section 1. The following described area, which is
shown in the attached Exhibit "A ", is hereby annexed to the City,
provided the conditions described in Sections 2, 3, and 4 are
met:
The south half of Block 9, and all of Blocks 10 and 15
in Fogarty and Dolan's Second Addition to the Townsite
of Port Angeles as recorded in Volume 3 of plats, page
65, records of Clallam County, Washington, together
with those portions of Albert Street, Eunice Street,
"D" Avenue, "E" Avenue, and "F" Avenue abutting said
south half of Block 9, and Blocks 10 and 15 which would
attach by operation of law upon vacation.
TOGETHER WITH the north 30.00 feet of the west 60.00
feet of Parcel Number 1 as shown on a map of Peabody
Park recorded in Volume 6 of surveys, page 75, records
of Clallam County, Washington, in the east half of
Section 22, Township 30 North, Range 6 West, W.M., of
said Clallam County.

Section 2. The annexed area shall bear the outstanding
indebtedness of the city contracted prior to or existing at the
effective date of this Ordinance.
Section 3. Pursuant to Article X, Section 11,
Ordinance 1709, as amended, the annexed area zoning shall be RS-
9, Residential Single - Family District.
Section 4. The annexed area shall be replatted in
accordance with the Annexation Agreement, attached hereto as
Exhibit "B ".
Section 5. This Ordinance shall take effect five days
after date of publication.
PASSED by the City Council of the City of Port Angeles
at a regular meeting of said Council held on the 5th day of
February, 1991.

EXHIBIT "B"
ANNEXATION AGREEMENT
This Annexation Agreement is entered into this s.43 day of
L11, .A,iAaAo , 199/-, by and between the City of Port Angeles, a
municipal prporation_, hereinafter referred to as the "City ", and
Toseph E. Freeman, the owner of the annexed area, hereinafter
referred to as "Owner ".
REPRESENTATIONS
1. Joseph E. Freeman is the owner of property contiguous to
the City of Port Angeles, which property is described as follows
and is hereinafter referred to as the "annexed area ":
The south half of Block 9, and all of Blocks 10 and 15
in Fogarty and Dolan's Second Addition to the Townsite
of Port Angeles as recorded in Volume 3 of Plats, page
65, records of Clallam County, Washington, together with
those portions of Albert Street, Eunice Street, "D"
Avenue, "E" Avenue, and "F" Avenue abutting said south
half of Block 9 and Blocks 10 and 15 which would attach
by operation of law upon vacation.
TOGETHER WITH the north 30.00 feet of the west 60.00 feet
of Parcel Number 1 as shown on a map of Peabody Park
recorded in Volume 6 of Surveys, page 75, records of
Clallam County, Washington, in the east half of Section
22, Township 30 North, Range 6 West, W.M_, of said
Clallam County.
2. The Owner is desirous of connecting to City water, sewer
and light systems, and the City is willing that the Owner be
allowed to do so under certain conditions.
3. The annexed area was originally platted on February 29,
1892, and contains lots that are substandard under the City's
zoning Code and several rights -of -way that have been vacated.
4. The City is willing to take the annexed area into the City
as Gong as the annexed area is replatted in conformance with
current City requirements, including the necessary street rights -
of -way and utility easements_

NOW, THEREFORE, in consideration of the above representations
and the mutual covenants herein contained, it is agreed as follows:
1. Prior to any development or issuance of building permits
within the annexed area, Cwner will replat the annexed area in
accordance with the requirements of Chapter 58.17 RCW and all
applicable City ordinances, specifications and policies, which may
inci e but not necessarily be limited to sanitary sewers, water,

electric power, paved streets, curbs, gutters, sidewalks and storm
sewers. Owner shall dedicate by Quit Claim Deed to City the
necessary rights -of -way and easements required by said replat.
2. City will allow annexation of the annexed area and provide
*rater, light and sewer connection to presently existing and
presently located City utilities. Owner will comply with all
requirements of the annexation ordinance and all other ordinances
and regulations of the City of Port Angeles.
a. This annexation agreement shall be binding on Owner, his
heirs, assigns and successors in interest and shall be recorded
with the Clallam County Auditor's Office.
IN WITNESS WHEREOF, the parties hereto have hereunto set their
hands the day and year first above written.
