AN ORDINANCE of the City Council of the
City of Port Angeles, Washington,
revising water rates and related fees
and amending Ordinance No. 2181 as
amended and Chapters 13.36, 13.40,
and 13.44 of the Port Angeles Municipal
Code.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT
ANGELES, as follows:
Section 1. Chapter 6 of Ordinance No. 2181, as most
recently amended by Ordinance No. 2541, and Chapter 13.44 of the
Port Angeles Municipal Code are hereby amended to read as
follows:
13.44.010 Monthly Residential Flat Rate. Each service
shall be eleven thirteen dollars and thirty fifteen cents.
13.44.020 Monthly Residential Metered Rate - Within City.
A. The following monthly minimum charges are applicable to
water service to single- family residences within the corporate
limits of the City of Port Angeles. For the purposes of this
section, "single- family residences" are defined as structures
designed for occupancy by a single family only, containing a
complete kitchen unit. Structures which are not "single- family
residences" include, but are not limited to, cinglc family
residences undcr construction, duplexes, fourplexes, apartments,
and roominghouses. The charge is based upon size of the service
line, and not size of the meter, except as specified for the
three - fourths -inch service below. The charges are as follows:

B. Metered consumption shall be forty three fifty cents
for each one hundred cubic feet consumed during the period from
September 1 to and including May 31, regardless of size of
and including August 31, regardless of Size of service.

13.44.05825 Commercial and All Other Monthly Metered Rates
Within City.
A. The following monthly minimum charges are applicable to
commercial and all other water services other than those provided
for under Sections 13.44.010 through 13.44.040 of this Chapter,
within the corporate limits of the City of Port Angeles. The
minimum rate is based upon size of the service line, and not the
size of the meter, except as specified for three - fourths -inch
service below. The rates are as follows:

B. Metered consumption shall be forty ccvcn five cents for
each one hundred cubic feet consumed, regardless of size of
service.
13.44.030 Monthly Industrial Metered Rate - Within City.
A. The monthly minimum charge applicable to water service
to industrial customers within the corporate limits of the City
of Port Angeles shall be four hundred twenty five sixty dollars
per month, regardless of size of service. For the purposes of
this section, "industrial customers" are defined as customers
whose average monthly potable water consumption is in excess of
three hundred fifty thousand cubic feet per month, where such
average is computed by dividing total annual month period by
twelve; provided, that this rate shall not apply to public
wholesale customers of the City, whose rate shall be established
by contract as set forth in PAMC 13.44.060.
B. Metered consumption shall be twenty eight thirty point
four cents for each one hundred cubic feet consumed.
13.44.040 Monthly Residential Metered Rate - Outside City.
A. The following monthly minimum charges are applicable to
residential water service outside the corporate limits of the
City of Port Angeles. The charge is based upon size of the
service line, and not size of the meter, except as specified for
three - fourths -inch services below. The minimum charges are as
follows:

B. Metered consumption shall be ninety seventy -five cents
for each one hundred cubic feet consumed regardless of size of
service.

13.44.045 Monthly Commercial Metered Rate - Outside the
City.
A. The following monthly minimum charges are applicable to
commercial water service outside the corporate limits of the City
of Port Angeles. The charge is based upon the size of the
service line and not the size of the meter, except as specified
for three - fourths -inch service below. The minimum charges are as
follows:

B. Metered consumption shall be sixty -six cents for each
one hundred cubic feet consumed.
13.44.060 Wholesale Rate Rcpealcd. (Ord. 2323 §6,
1 2 85.)The rate for wholesale customers shall be established by
contract of the City Council based on the current cost of service
analysis for this service, which is a monthly minimum charge of
$1,000 and metered consumption at forty -two point eight cents for
each one hundred cubic feet consumed.
13.44.070 - Rates - Temporary Water Use.
A. For billing purposes where two or more premises are
served on a temporary basis through a single meter, each shall be
considered a separate premises.
B. The use of water for construction purposes shall be
allowed, where available, to construct or reconstruct any
building or structure or settle trenches or fills. Before
commencing such usage, application therefor shall be made to the
Department and a twenty -five dollar fee paid. Water used shall
be paid for at a rate described in Section 13.44.050.
13.44.080 Rates - Fire Protection.
A. Where City water is used for fire protection purposes,
no monthly rate will be charged for such service.
B. The customer and /or property owner shall be responsible
for all repairs and maintenance associated with the fire
protection service, beginning at the connection to the City water
main and ending at and including the service within the building.
The Department shall perform all repairs and maintenance
activities on the fire protection service line within City
rights -of -way. All costs associated with such repairs and main-
tenance by the Department shall be paid for by the customer
and /or property owner.
C. If such repairs and maintenance costs (for work
performed by the Department) exceed one thousand dollars, the
customer and /or property owner may arrange a payment schedule
with the Director of Finance to pay for the costs over a period
of time not to exceed twelve months. Interest shall be charged
at the rate of one percent per month on the unpaid balance. The
minimum interest shall be fifty cents.
D. Where such fire service is provided, no charge will be
made for water used in extinguishing fires of incendiary or
accidental origin, if the customer at the location where the fire
occurs gives written notice to the Department within ten days
from the time of such fire. Otherwise, all water used will be

billed at the applicable rate, as established for the primary
metered service serving the premises, as provided for in this
Chapter.
E. Where the size of a single - family residential service
must be increased to provide capacity for a residential sprinkler
system in a residence and the Fire Department certifies that the
fire sprinkler system has been installed, the residential water
rate for the residence may be that of a three - quarter -inch
service with a five - eights -inch meter as established in Section
13.44.020.
13.44.090 Service Charge. Whenever the Department responds
to a request outside of regular working hours for assistance to
investigate a deficiency in water service to any premises and it
is determined that the deficiency is the result of improper
operation or maintenance of the customer's plumbing, a twcnty two
one hundred dollar charge will be made to defray a portion of the
cost of responding to the request.
Section 2. Chapter 4 of Ordinance 2181 and Chapter
13.36 of the Port Angeles Municipal Code are hereby amended by
adding a new section to read as follows:
Section 13.36.080 Water Quality Test. The Department will
conduct a water quality test of a customer's water at the request
of the customer. If as a result of the test, the Department
determines that there is a problem within the City water system
that needs to be corrected by the City, the cost of the test
shall be waived by the Department. If as a result of the test
the Department determines that there is no problem within the
City water system that needs to be corrected by the City, the
customer shall be charged fifty dollars plus the cost of the
laboratory tests.
Section 3. Section 3 of Chapter 4 of Ordinance 2181,
as amended by Section 1 of Ordinance 2289, PAMC 13.36.030, are
hereby amended to read as follows:
13.36.030 Special or Emergency Turnon or Turnoff Fees.
Whenever a request is made of the Department for an emergency
turnoff or turnon or temporary discontinuance of water service to
any premises, which necessitates immediate action, the following
charges shall be made therefor:
A. Emergency turnoff, turnon during
regular hours $50.00 deposit per call
with $25.00 to be refunded upon satisfactory proof that
the resident /home owner has installed an appropriate
shutoff, otherwise full fee is charged; except that the
fee may be waived by the Director if the turnon- turnoff
can be accomplished during the normal course of
business and schedules of the crews;
B. Emergency turnoff, turnon outside
of regular working hours. . $100.00 per call.
Section 4. Section 6 of Chapter 5 of Ordinance No.
2181 and PAMC 13.40.060 are hereby amended to read as follows:

13.40.060 Water Meter Test Deposit.
A. The amount of the deposit shall be as follows:
1. For testing five - eighths -inch to one and one -half
inch meters, cixtccn fifty dollars;
2. For tc3ting thrcc fourths-inch mctcr3, twcnty
dollars;

Shall be fifty seventy dollars.
B. The person requesting the test shall be billed the
actual cost for the meter test minus the deposit made.
Section 5 - Effective Date. The Finance Department
shall apply the water rates as amended in this Ordinance to all
customer bills prepared after March 31, 1992. This Ordinance
shall be effective five days after the date of publication.
Section 6 - Severability. If any provisions of this
Ordinance, or its application to any person or circumstance is
held invalid, the remainder of the Ordinance, or application of
the provisions of the Ordinance to other persons or
circumstances, is not affected.
PASSED by the City Council of the City of Port Angeles
at a regular meeting of said Council held on the 4th day of
February, 1992.

This Ordinance of the City of Port Angeles amends Ordinance No. 2181 as
amended and Chapters 13.36, 13.40, and 13.44 of the Port Angeles Municipal
Code by revising water rates and related fees, to be applied to all customer bills
prepared after March 31, 1992.
The full text of the Ordinance is available at City Hall in the City Clerk's office or will be
mailed upon request. Office hours are Monday through Friday from 8:00 a.m. to 5:00 p.m.
The Ordinance will take effect five (5) days after publication of this summary.
