AN ORDINANCE relating to emergency management,
creating an Emergency Management Council,
establishing the office of Director of Emergency
Management, fixing their powers and duties,
repealing prior inconsistent ordinances, and
codifying this ordinance in Chapter 2.24 of the
Port Angeles Municipal Code.
THE CITY COUNCIL OF THE CITY OF PORT ANGELES, WASHINGTON,
DOES HEREBY ORDAIN as follows:
Section 1 - PURPOSES. The declared purposes of this
Ordinance are to provide for the preparation and carrying out of
plans, including mock or practice drills, for the protection of
persons and property within the City in the event of a disaster,
and to provide for the coordination of the emergency management
functions of the City with all other public agencies and affected
private persons, corporations and organizations. Any expenditures
made in connection with emergency management activities, including
mutual aid activities, and mock or practice drills, shall be deemed
conclusively to be for the direct protection and benefit of the
inhabitants and property of the City of Port Angeles.
Section 2 - DEFINITIONS.
A. Emergency Management means the preparation for
and the carrying out of all emergency functions, other than
functions for which the military forces are primarily responsible,
as necessary to mitigate, prepare for, respond to, and recover from
emergencies and disasters, and to aid victims suffering from injury
or damage, resulting from disasters.
B. Disaster means actual or threatened enemy attack,
sabotage, extraordinary fire, hazardous material incident, flood,
storm, epidemic, riot, earthquake or other similar public calamity.
Section 3 - EMERGENCY MANAGEMENT COUNCIL. The City of Port
Angeles Emergency Management Council is hereby created and shall
consist of the following:
A. The Mayor, who shall be the chairman.
B. The Director of Emergency Management, who shall be
vice - chairman.
C. Such City officials, employees and citizens as may be
ppointed by the Mayor with the advice and consent of the City
ouncil.
It shall be the duty of the Emergency Management Council,
and it is hereby empowered, to review and recommend for adoption by
the City Council, emergency management and mutual aid plans and
agreements and such resolutions, rules and regulations as are
Necessary to implement such plans and agreements. The Emergency
Management Council shall meet upon call of the chairman or, in his
absence from the City or inability to call such meeting, upon the
call of the vice - chairman.
Section 4 - EMERGENCY MANAGEMENT ORGANIZATION.
A. All officers and employees of the City, the civilian
auxiliary police force, volunteer fire department, and any other
volunteer groups designated by the Emergency Management Director
and registered as emergency management workers with the Emergency
Management Council, together with those volunteer forces enrolled
to aid them during a disaster, and all groups, organizations, and
persons who may be by agreement or operation of law, including
persons pressed into service under the provisions of Section 6 C of
this Ordinance, charged with duties incident to the protection of
life and property in the City during a disaster, shall constitute
the emergency management organization of the City of Port Angeles.
B. The functions and duties of the City of Port Angeles
emergency management organization shall be distributed among such
ivisions, services, and special staff as directed by the Emergency
anagement Director. Insofar as possible, the form of organiza-
ion, titles and terminology shall conform to the recommendations
f the Federal Emergency Management Agency and the Emergency
ivision of the State Department of Community Development.
Section 5 - EMERGENCY MANAGEMENT DIRECTOR. There is hereby
reated the office of Director of Emergency Management. Such
fficer shall be the City Manager of the City of Port Angeles, or
is designee. The Director is hereby empowered and directed:

A. To prepare an emergency response operating plan of the
City conforming to the County and State Comprehensive Emergency
Management plans and programs.
B. To control and direct the effort of the emergency
management organization of the City for the accomplishment of the
purposes of this Ordinance.
C. To direct coordination and cooperation between
divisions, services, and staff of the emergency management
organization of the City, and to resolve questions of authority and
responsibility that may arise between them.
D. To represent the emergency management organization of
the City in all dealings with public or private agencies pertaining
to emergency management.
Section 6 - DISASTER RESPONSE. In the event of a disaster,
the Director is hereby empowered:
A. To make and issue rules and regulations on matters
reasonably related to the protection of life and property as
affected by such disaster; provided, however, that such rules and
regulations must at the earliest practicable time be reviewed by
the Emergency Management Council and adopted by the City Council.
B. To obtain vital supplies, equipment and such other
properties found lacking and needed for the protection of the life
and property of the people, and bind the City for the fair value
thereof, and if required immediately, to commandeer the same for
public use.
C. To require emergency services of any city officer or
employee, and in the event of a proclamation by the Governor of the
existence of a disaster, to command the services and equipment of
as many citizens of this community as he considers necessary in the
execution of his duties; such persons shall be entitled to all
privileges, benefits and immunities as are provided by State law
for registered emergency management workers.
D. To execute all of the special powers conferred upon
him by this Ordinance or by resolution adopted pursuant thereto,

11 powers conferred upon him by statute, by agreement approved by
he City Council, or by any other lawful authority.
E. To requisition necessary personnel or material of any
own or agency.
F. To direct and provide for the evacuation of all or
art of the population of the City from any stricken or threatened
isaster area within the City to locations providing relative
afety and shelter.
Section 7 - DISASTER DECLARATION. In the event that the
ity's resources have or soon may be exhausted, or special
ssistance is required, in responding to a disaster, the Director
y issue a declaration of disaster as an indication to the
overnor of the State of Washington that state and /or federal
assistance is required to meet the needs of the disaster; provided,
however, that in issuing such declaration the Director shall
consult with the City Council at the earliest practicable time.
The request for assistance in the form of a declaration of disaster
will include the following:
A. the nature of the disaster;
B. a description of the impact to the local area;
C. a description of the local efforts in responding to
the disaster;
D. a statement that local capabilities are exceeded; and
E. a description of the assistance needed from the state
and /or federal government.
Section 8 - PUNISHMENT OF VIOLATIONS. It shall be a
misdemeanor, punishable by a fine of not to exceed $500.00, or by
imprisonment for not to exceed six months, or both, for any person
during a disaster:
A. To wilfully obstruct, hinder or delay any member of
the emergency management organization in the enforcement of any
lawful rule or regulation issued pursuant to this Ordinance, or in
the performance of any duty imposed upon him or her by virtue of
this Ordinance.
B. To do any act forbidden by any lawful rules or

egulations issued pursuant to this Ordinance, if such act is of
uch a nature as to give, or be likely to give assistance to the
nemy, or to imperil the lives or property of inhabitants of this
City, or to prevent, hinder or delay the defense or protection
hereof.
C. To wear, carry or display, without authority, any
eans of identification specified by the City's Director of
Emergency Management.
Section 9 - REPEAL OF CONFLICTING ORDINANCES. All
ordinances and parts of ordinances of this City in conflict
herewith are hereby repealed, including but not necessarily limited
to Ordinance 1600 and Ordinance 1701.
Section 10 - CODIFICATION. This Ordinance shall be
codified as Chapter 2.24 of the Port Angeles Municipal Code and
shall be entitled "Emergency Management ".
Section 11 - SEVERABILITY. If any provision of this
Ordinance or the application thereof to any person or circumstances
is held invalid, such invalidity shall not affect other provisions
or applications of the ordinance which can be given effect without
the invalid provision or application, and to this end the
provisions of this Ordinance are declared to be severable.
Section 12 - EFFECTIVE DATE. This Ordinance shall become
effective five days after the date of publication by summary.
PASSED by the City Council of the City of Port Angeles at
a regular meeting of said Council held on the 15th day
September , 1992.

Summaries of Ordinances Adopted by the

Ordinance No. 2712
This Ordinance of the City of Port Angeles amends the requirements for building -
mounted signs so the signs may be placed on any wall not facing an adjacent residential
zone. Building - mounted signs may not extend above the top of the eaves or parapet and
may not be located on a roof. This Ordinance amends Section 1 of Ordinance No. 2293,
as most recently amended by Section 1 of Ordinance No. 2689, and Section 17.26.220
of the Port Angeles Municipal Code.
Ordinance No. 2713
This Ordinance of the City of Port Angeles deals with the disposal of dead animals and
re- enacts Chapter 8.24 of the Port Angeles Municipal Code. The carcasses of dead
animals shall be removed and disposed of by burial, incineration or other proper method
within twenty -four hours after death. If the carcass is buried, it shall be so placed that
every part thereof shall be covered by at least two feet of earth and at a location not less
than one hundred feet from any well, spring, or stream and in a place not subject to
overflow by the surface waters. In all cases of death from communicable disease, the
carcass, if disposed of by burial, shall first be enveloped in unslackened lime.

Emergency Management Council, establishes the office of Director of Emergency
Management, fixes its powers and duties, repeals prior inconsistent ordinances, and
codifies this ordinance in Chapter 2.24 of the Port Angeles Municipal Code.
The full texts of the Ordinances are available at City Hall in the City Clerk's office or will be mailed
upon request. Office hours are Monday through Friday from 8:00 a.m. to 5:00 p.m.
These Ordinances shall take effect five days after the date of publication of these summaries.
