AN ORDINANCE of the City of Port Angeles, Washington, modifying the
definition of "lot coverage" in the Zoning Code, allowing social service
agencies providing 24 -hour residential care as conditional uses in the
RMD and RHD zones, authorizing the Planning Director to grant minor
deviations from set back, lot coverage, and height requirements, and
amending Ordinance No. 1709 as amended and Chapters 17.08, 17.14,
17.15, and 17.94 of the Port Angeles Municipal Code.
THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES HEREBY
ORDAIN as follows:
Section 1. Ordinance No. 1709 as amended and Chapter 17.08 of the Port Angeles
Municipal Code are hereby amended by amending PAMC 17.08.065 to read as follows:
17.08.065 - "L"
A. Landfill, Sanitary - an area devoted to the disposal of refuse, including
incineration, reduction, or dumping of ashes, garbage, combustible and non - combustible refuse,
and industrial solid wastes. (Ord. 2861 §1 (part), 3/17/95)
B. Legal Building, Structure, Land Use - any building, structure or use of the land
that complies with all zoning requirements. (Ord. 2861 §1 (part), 3/17/95; Ord. 2652 §1 (part),

C. Level of Service - an established minimum capacity of public facilities or
services that must be provided per unit of demand or other appropriate measure of need. (Ord.

D. Lot - a lot is a zoning lot, except as the context shall indicate a lot of record,
in which case a lot is a "lot, of record ". (Ord. 2861 §1 (part), 3/17/95; Ord. 2652 §1 (part),

E. Lot Area - the total area within the lot lines of a lot, excluding any primary
access easements or panhandles. (Ord. 2861 §1 (part), 3/17/95; Ord. 2796 §2, 2/11/94)
F. Lot, Corner - a lot situated at the intersection of two or more streets. (Ord.

G. Lot, Reverse Corner - a corner lot in which the rear property line coincides
with the side property line of an abutting lot. (Ord. 2861 §1 (part), 3/17/95; Ord. 2652 §1 (part),

H. Lot, Through - a lot having two opposite lot lines abutting public streets which
are usually more or less parallel to each other; not a corner lot. Both lot lines abutting streets

I. Lot, Zoning - a single tract of land located within a single block, which at the
time of filing for a building permit, is designated by its owner or developer as a tract to be used,
developed, or built upon as a unit, under single ownership or control. A zoning lot may or may

J. Lot Line, Front - that boundary of a lot which abuts a street. When two or
more boundaries abut a street, the boundary with the narrowest width shall be considered the front
lot line, unless otherwise specified on a plat. On a panhandle lot, the front lot line and setbacks
shall be determined during the subdivision approval process, or, if not determined during
subdivision review, shall be determined by the Planning Director. (Ord. 2948 §5 (part), 2/14/97;

K. Lot Line, Rear - that boundary of a lot which is most distant from and is most

L. Lot Line, Side - any boundary of a lot which is not a front nor a rear lot line.

M. Lot Coverage - the amount or percent of the ground area of a lot on which
buildings are located. This amount /percent shall include all buildingsareas which are partially or
totally enclosed and covered by an imperviousweat crtight roof or trellis structure, including any
garages, carports, covered patios. and cantilevered portions of a building, and structures covered
by an impervious watertight -roof or trellis even if not fully enclosed. Lot coverage does not
include the first horizontal 30 inches of the roof overhang nor does it include uncovered decks and

N. Lot of Record - a parcel of land that is registered as a lot or parcel of land
in the records of the County Auditor. (Ord. 2861 §1 (part), 3/17/95; Ord. 2796 §2, 2/11/94;

O. Lot Width - the horizontal distance between side lot lines measured at right
angles to the lot depth at a point midway between the front and rear lot lines, or at the front
setback line, provided the average horizontal distance between side lot lines must also meet or

Section 2. Ordinance No. 1709 as amended and Chapter 17.14 of the Port Angeles
Municipal Code are hereby amended by amending PAMC 17.14.030 to read as follows:
17.14.030 Conditional Uses.
A. Art galleries and museums.
B. Assisted living facility.
C. Child day -care centers and pre - schools.
D. Churches.
E. Group homes and hospices.
F. Libraries.
G. Nursing and convalescent homes.
H. Public parks and recreation facilities.
I. Public and private schools.
J. Residential care facilities.
K. Social service agencies providing 24 -hour residential care.
LK. Utility buildings and structures.
ML. Other uses compatible with the intent of this Chapter.

Section 3. Ordinance No. 1709 as amended and Chapter 17.15 of the Port Angeles
Municipal Code are hereby amended by amending PAMC 17.15.040 to read as follows:
17.15.040 Conditional Uses.
A. Art galleries and museums.
B. Assisted living facilities.

F. Group Homes and hospices.
G. Hospitals.
H. Libraries.
I. Motels.

Section 4. Ordinance No. 1709 as amended and Chapter 17.94 of the Port Angeles
1 unicipal Code are hereby amended by adding a new section PAMC 17.94.180 to read as
ollows:
17.94.180 - Minor Deviations
A. A minor deviation from front, side. and rear yard setbacks, lot coverage, and
-' jit requirements established in this title may be granted by the Planning Director in accordance
ith the provisions of this section.
1L. A minor deviation may be granted if all of the following findings are made:
.L The granting of the minor deviation is consistent with the purpose of the
zone in which the property is located and the project is otherwise
consistent with the requirements of said zone.
2... Because of special circumstance. the strict application of the zoning
ordinance results in an undue hardship upon the applicant.
The minor deviation will not be materially detrimental to the public
welfare or injurious to property or improvements in the vicinity and zone
in which the subject property is located; and
4... The minor deviation is not greater than 10% of the requirement being
deviated from.
� The site has been posted and adjacent property owners notified fifteen
(15) days prior to approval of the minor deviation.
C.. Any applications that are not granted a minor deviation by the Planning
D irector pursuant to this section must obtain a variance through the City's normal variance
rocedure as set forth in Chapter 2.52 PAMC.
Section 5 - Severability. If any provisions of this Ordinance, or its application to any
person or circumstances, is held invalid, the remainder of the Ordinance, or application of the
provisions of the Ordinance to other persons or circumstances, is not affected.
Section 6 - Effective Date. This Ordinance shall take effect five days after the date
of publication.
PASSED by the City Council of the City of Port Angeles at a regular meeting of said
Council held on the 15th day of Apri 1 , 1997.

This Ordinance of the City of Port Angeles modifies the definition of "lot coverage"
in the Zoning Code, allows social service agencies providing 24 -hour residential care
as conditional uses in the RMD and RHD zones, authorizes the Planning Director to
grant minor deviations from set back, lot coverage, and height requirements, and
amends Ordinance No. 1709, as amended, and Chapters 17.08, 17.14, 17.15, and
17.94 of the Port Angeles Muncipal Code.
Ordinance No. 2957
This Ordinance of the City of Port Angeles establishes electronic home detention as
a means of confinement, provides for rules and procedures for its administration, and
amends Ordinance No. 2129, as amended, and Title 9 of the Port Angeles Municipal
Code.
The full texts of the Ordinances are available at City Hall in the City Clerk's office or will be mailed
upon request. Office hours are Monday through Friday from 8:00 a.m. to 5:00 p.m. These
Ordinances shall take effect five days after the date of publication of these summaries.
