AN ORDINANCE of the City of Port Angeles
vacating a portion of Sixteenth Street between `B"
and "C" Streets.
WHEREAS, a petition is on file with the City of Port Angeles to vacate a portion
of the Sixteenth Street right -of -way adjacent to Lots 11 - 15, Block 429 and Lots 7 - 10, Block
442, Townsite of Port Angeles; and
WHEREAS, the petition was signed by the owners of more than two- thirds of the
property abutting upon the right -of -way sought to be vacated; and
WHEREAS, the City initiated said vacation by Resolution No. 10 -97; and
WHEREAS, street vacations are categorically exempt from the requirements of
the State Environmental Policy Act (SEPA) as set forth in WAC 197- 11- 800(2)(h); and
WHEREAS, a public hearing has been held before the City Council following
public notice pursuant to Chapter 35.79 RCW; and
WHEREAS, the street vacation appears to be of benefit to and in the interest of
the public;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT
ANGELES DOES HEREBY ORDAIN as follows:
Section 1 - Vacation Subject to the terms and conditions of this Ordinance, the
following described right -of -way is hereby vacated:
That portion of the Sixteenth Street right -of -way between `B"
and "C" Streets, adjacent to Lots 11 - 13 and the west 45' of Lot 14,
Block 429, and Lots 8 - 10 and the west 45' of Lot 7, Block 442
Townsite of Port Angeles.

Section 2 - Gonditions
Conditions of Approval.
1. A standard City cul -de -sac or other turnaround as approved by the Fire
and Public Works Departments shall be constructed at the property
owner's expense, and any additional rights -of -way necessary to
accommodate the chosen alternative shall be donated to the City.
2. Sixteenth Street shall be closed and barricaded at the eastern end of the
vacated right -of -way.
3. City standard curb, gutter, and sidewalk shall be constructed where the
western end of the vacated right -of -way abuts "C" Street, and, if used as
an entrance to the property, a City standard driveway shall be constructed,
all at the property owner's expense.
4. An overhead and underground power transmission utility easement shall
be provided, which shall be 17 feet wide along both sides of the existing
power line in order to provide proper clearance between buildings and
utility facilities and unobstructed access to utility facilities and to trees in
the easement that may need to be trimmed or removed.
5. Utility easements shall be required for the six inch water main and for the
sewer main and two inch water main unless a sewer clean out and two
inch cross tie are constructed adjacent to the east end of the vacated right -
of -way.
6. A fire hydrant shall be riveted adjacent to the east end of the vacated right -
of -way.

Pursuant to RCW 35.79.030 compensation for the
right -of -way is hereby set at $22,893.75
Section 4 - Quit Claim Deed. Upon satisfaction of the compensation amount in
Section 2 of this Ordinance, the owners of abutting property entitled to the vacated street,
pursuant to RCW 35.79.040, may present a quit claim deed to the City of Port Angeles for
execution by the Mayor, who is hereby authorized and directed to execute such quit claim deed.
Such quit claim deed shall include all reservations, conditions, or other qualifications upon the
title established by this Ordinance.

Section 5 This Ordinance shall be effective only upon the satisfaction of the
terms and conditions of this Ordinance, and the City Clerk is hereby directed to file, record, and
publish this Ordinance upon that satisfaction.
PASSED by the City Council of the City of Port Angeles at a regular meeting of
said Council held on the 5th day of November , 1997.

This Ordinance of the City of Port Angeles vacates that portion of the Sixteenth
Street right -of -way between "B" and "C" Streets, adjacent to Lots 11 - 13 and the
west 45' of Lot 14, Block 429, and Lots 8 - 10 and the west 45' of Lot 7, Block
442, Townsite of Port Angeles.
The full text of the Ordinance is available at City Hall in the City Clerk's office or will be mailed
upon request. Office hours are Monday through Friday from 8:00 a.m. to 5:00 p.m.
This Ordinance took effect upon the satisfaction of the terms and conditions of the Ordinance.
