AN ORDINANCE of the City of Port Angeles, Washington, vacating a portion
of the Grace Street (now more commonly known as Peabody Street) right -of-
way abutting Lot 14 of H. Maguire's Addition to Port Angeles.
WHEREAS, a petition is on file with the City of Port Angeles to vacate a portion of
Grace Street abutting Lot 14 of H. Maguire's Addition to the City of Port Angeles; and
WHEREAS, the petition was signed by the owners of more than two- thirds of the
property abutting upon the right -of -way sought to be vacated; and
WHEREAS, the City initiated said vacation by Resolution No. 18 -01; and
WHEREAS, street vacations are categorically exempt from the requirements of the State
Environmental Policy Act (SEPA) as set forth in WAC 197- 11- 800(2)(h); and
WHEREAS, a public hearing was held before the City Council following public notice
pursuant to Chapter 35.79 RCW; and
WHEREAS, the street vacation appears to be of benefit to and in the interest of the
public;
NOW, THEREFORE, THE CITY COUNCIL OF PORT ANGELES DOES HEREBY
ORDAIN as follows:
Section 1 - Vacation. Subject to the terms of this Ordinance, the following described
right -of -way is hereby vacated:
The Westerly 30 feet of the Northerly 270 feet of Grace Street (now more commonly
known as Peabody) abutting Lot 14 of H. Maguire's Addition to Port Angeles, recorded
in Volume I of Plats, Page 11, Records of Clallam County, Washington.

Section 2 - Compensation. Pursuant to RCW 35.79.030 compensation for the right -of-
way shall be the exchange of property as shown in the attached Exhibit A.
Section 3 - Quit Claim Deed. Upon satisfaction of the compensation in Section 2 of this
Ordinance, the owners of the abutting property entitled to that portion of the right -of -way vacated
by this Ordinance, pursuant to RCW 35.79.040. will receive a quit claim deed from the City of Port
Angeles for that vacated portion of right -of -way executed by the Mayor, who is hereby authorized
and directed to execute such quit claim deed. Such quit claim deed shall include all reservations,
conditions, or other qualifications upon the title established by this Ordinance.
Section 3 - Effective Date. This Ordinance shall be effective only upon the satisfaction
of the terms and conditions of this Ordinance, and shall be published upon that satisfaction. The
City Clerk is hereby directed to file a certified copy with the Clallam County Auditor and Clallam
County Assessor.
PASSED by the City Council of the City of Port Angeles at a regular meeting of said
Council held on the 16th day of October, 2001.

This Ordinance of the City of Port Angeles, Washington, vacates a portion of the
Grace Street right -of -way, legally described as the Westerly 30 feet of the
Northerly 270 feet of Grace Street (now more commonly known as Peabody
Street) abutting Lot 14 of H. Maguire's Addition to Port Angeles, recorded in
Volume I of Plats, Page 22, Records of Clallam County, Washington.
The full text of the Ordinance is available at City Hall in the City Clerk's office or will be mailed
upon request. Office hours are Monday through Friday from 8:00 a.m. to 5:00 p.m.
This Ordinance took effect upon the satisfaction of the terms and conditions of the Ordinance.
