I II ROLL CALL Members Present: Councilmen Anderson, Buck, Hordyk, Ross, Wray. Members Absent: Councilman Haguewood. Staff Present: Manager Whorton, Attorney Taylor, Clerk Parrish. J. Hill, P. Switzer, M. Matilla. II I' MINUTES Councilman Hordyk moved the minutes of the January 20, 1976 meeting be accepted and placed on file as received. The motion was seconded by Councilman Wray and passed by the Council. IV F I NANCE 1. Bid Call Authorization. I Councilman Hordyk moved the Council authorize the call for bids for chlorination equipment to alter existing Mt. Pleasant chlorinator to full compound loop control system. The motion was seconded by Councilman Ross and carried. A 1976 budget item. Councilman Ross moved the Council authorize the Park Department to call for bids for two commercial lawn mowers. The motion was seconded by Councilman Hordyk and carried by the Council, A 1976 Park Budget item, Councilman Anderson moved the Council authorize the Park Department to call for bids on turf management supplies and materials, namely, two tons'amonium sulfate 20.0.0; four and one-half tons urea 46'0'0; and fourteen tons of complete fertilizer 21.7.14. The motion was seconded by Councilman Hordyk and passed by the Council. A 1976 Park Budget item. Councilman Ross moved the Council authorize the Park Department to call for bids on turf management top dressing, 460 yards of washed sand, size 16 to 18 mesh.' I Councilman Wray moved the Council award the bid for thirty-three (33) FM radio tone alerting receivers to low bidder Alden Equip- ment Company at a total bid price including sales tax of $4,109.07, as recommended by Fire Chief Cameron. The motion was seconded by Councilman Hordyk and carried by the Council. L. N. Curtis and Sons submitted a bid in the amount of $5,425.36 including sales tax. 74 City Council Meeting February 3, 1976 I V FI NANC E 3. Truck Road at Marine Drive Signalization Project. The Council next took under consideration Progress Payment No. 1 on subject project. At Councilman Ross' request, Manager Whorton briefed the Council on the status of the project stating that the signal is currently on "blinking yellow" because the signal control box was severely damaged by a vehicle during December which compelled the Contractor to order a replacement controller and resulted in the granting of a four to six week extension to the Contract completion date of January 29, 1976. Councilman Ross then moved the Council approve payment of $15,674.40 to Signal Electric, Inc. Kent, Washington, as the first estimate of work done and material furnished by said contractor, sixty- five percent of project completion, on the Truck Road at Marine Drive Signalization project. The motion was seconded by Councilman Hordyk a~ passed by the Council. 4. Payroll. Councilman Hordyk moved the Council approve payment of $100,144.54 payroll for January 1 through 15, 1976. The motion was seconded by Councilman Wray and carried by the Council. V ITEMS FROM THE AUDIENCE NOT ON THE ~GENDA - None. VI LEGISLATION 1. Letters of recognition to the personnel of the Wastewater Treatment Plant, the Police Department and the Fire Department for achieving a perfect "personal SAFETY" record for the year 1975 were read by Mayor Olson. The Mayor also extended the Council's congratulations I to the involved Department Heads for their successful efforts toward achieving "SAFETY" as a goal, 2. Councilman Hordyk moved the Council accept and place on file the minutes of the Board of Adjustment January 27, 1976 meeting. The motion was seconded by Councilman Buck and carried by the Council. 3. Councilman Hordyk moved the minutes of the Planning Commission January 26, 1976 meeting be accepted and placed on file as read by Mayor Olson. The motion was seconded by Councilman Wray and carried by the Council. 4, Councilman Ross moved the "David Stephen's street right-of-way dedication" subject be taken from the table. The motion was seconded by Councilman Anderson and carried. After a brief discussion, Councilman Hordyk moved this matter be referred to Manager Whorton for discussion and negotiation with Mr. Stephens in an attempt to resolve this issue, with Manager Whorton presenting a recommendation report to the Council for their consideration prior to any final action being taken by the Council on this matter. The motion was seconded by Councilman Ross and carried with Councilman Wray voting "NO." 5. Agenda item No.5, "Itinerant Merchants Ordinance (tabled 1/20/76)" was passed over for delayed consideration. 6. Mayor Olson next introduced and read in full an Ordinance providing for the City Manager's salary. Continued. Councilman Hordyk moved to adopt the foregoing Ordinance as read by Mayor Olson, The motion was seconded by Councilman Wray and unanimously passed by the Council. 7. The council next took under consideration Resolution No. 3-76 entitled, RESOLUTION NO. 3-76 A RESOLUTION of the City Council of the City of Port Angeles adopting the Deferred Com- pensation Retirement Plan of the International City Management Association Retirement Corpora- tion. Manager Whorton briefly explained that the "Deferred Compensation Retirement Plan" is a supplementary retirement plan which would be available exclusively to management personnel, with contributions into the system being made by the employee only, and the City assuming the role of "Trustee" of the funds, with the International City Management Association Retirement Corporation serving in the capacity as Trust Agent, responsible for the investment of the funds. He also. explained the procedures by which the Deferred Compensation Retirement Plan would be implemented and described some of the basic provisions of the plan. Mayor Olson then read Resolution No. 3-76 by title. Councilman Hordyk moved the Council adopt the foregoing Resolution as read by title by Mayor Olson. The motion was seconded by Councilman Ross and passed by the Council . 8. In reference to Senate'Bill 1134 on Lincoln Park, dated March 11, 1975, it is noted that subject bill was introduced by Senators Magnuson and Jackson for the purpose of amending the wording in the 1904 legislation, Act of March 30, 19D4 (33 Stat. 154) granting certain lands to the City of Port Angeles, Washington, by. deleting the phrases "as a public park," "for park purposes," and~"for public park purposes" and inserting in lieu thereof the phrase "for public purposes," and thereby preserving the City of Port Angeles' owner- ship of Lincoln Park. Subsequently, on September 11. 1975, a Senate 'Interior Committee hearing on this legislation was held, to which the City submitted testimony, dated August 15, 1975, expressing the City Council's total support of Senate Bill 1134 as introduced. By letter dated January 15, 1976, Senator Jackson forwarded to the City a copy of a "staff draft bill" which resulted from information gleaned from the September public hearing in an attempt to improve the original March 11, 1975 bill, and requested the City again sub- mit their comments on the draft bill. This draft bill amends the original Senate Bill 1134 by changing the phrase "for public purposes" to read "for public park or public airport purposes." After briefly relating these facts, Manager Whorton recommended, as stated in a proposed letter to Senator Jackson dated January 30, 1976, that the City Council reaffirm their August 15, 1975 testimony by requesting the original language of Senate Bill 1134 75 76 City Council Meeting FebruiJ,ry 31 1976 VI LEGISLATION 8. Continued. designating the land "for public purposes" be retained as this classification affords flexibility and leaves the determination as to the future uses of the property to best serve the majority of the Citizens df Port Angeles to the discretion of the City's local elected legislative body, the City Council, Councilman Ross then moved the Council approve the letter and the forwarding of the letter to Senator Jackson. The motion was seconded by Councilman Hordyk and passed by the Council. Port of Port Angeles Manager T. Neal, was in attendance and stated the Port's con- currence with the contents of the letter. 9. Mayor Olson next introduced a letter received from Seattle Mayor Uhlman, dated January 28, 1976, requesting that the City Council join the City of Seattle in lending support to New Jersey Congressman E. B. Forsythe's proposed legislation to amend the Merchant Marine Act of 1936 in order to establish a National Marine Fire Fighting Program. Manager Whorton then briefly explained that the proposed program is a training pro- gram designed to improve the, level of marine fire fighting protection and that the City is currently participating to a limited degree in a pilot training program. As this legislation would benefit Port Angeles, Mr. Whorton recommended the Council authorize a letter supporting the proposed legislation. Council- man Hordyk then moved the Council authorize Manager Whorton to write a letter to the Washington Congressional delegation indicating the City's strong interest in Congressman Forsythe's legislation to establish a national marine fire protection program. The motion was seconded by Councilman Ross and carried by the Cou nc i l. 10. Councilman Ross moved the'Council authorize Mayor Olson to sign on behalf of the City the PROCLAMATION proclaiming the month of February as "American History Month." The motion was seconded by Councilman Hordyk and passed by the Council. Councilman Hordyk moved the Council authorize Mayor Olson to sign on behalf of the City the PROCLAMATION proclaiming February 8-14, 1976 as "Vocational Education Week." in the City of Port Angeles, The motion was seconded by Councilman Ross and carried by the Council. 11. Councilman Ross moved the Council appoint George Buck, Paul Martin, Dorothy Munkeby and Paul Saxton to the Publicity and Promotion Board. The motion was seconded by Councilman Anderson and passed by the Council. 12. Councilman Hordyk moved the Council accept and place on file the December 1975 and Annual 1975 C1allam County Humane Society Activity Reports. The motion was seconded by Councilman Buck and carried. 13. Councilman Wray moved the minutes of the Civil Service Commission January 15, 1976 meeting be accepted and placed on file. The motion was seconded by Councilman Hordyk and passed by the Council. VII STAFF REPORTS 1. A motion was made by Councilman Wray, seconded by Councilman Hordyk and carried to accept and place on file the 1975 Financial Reports for Equipment Rental, Light, Off-Street Parking, Sanitation, Sewer and Water Funds. Councilman Ross: Requested progress report on "L" Street Improvement project; was 60' adequate length? I 4. Counci lman Hordyk: Recommended as work session sub- ject the matter of gasoline spillage on City streets being washed into sewer system and possibility of penalty assessments; problems associated with north side of 5th Street fill and possibility of extension of cul- vert--Manager Whorton will explore problem. Sweeping of L.I.D. 198 Streets- Manager Whorton will arrange same; and enforcement of-"No Parking" area on Lincoln in front of the Eagles. 5. Councilman Wray: 6. Councilman Anderson: Regulations re: Logging Trucks parking on First and Front Streets- exploration of feasibility of "portable barricades," particularly ~uringadverse weather conditions. 7. Attorney Taylor: Expressed his legal interpretation re: the Deferred Compensation Retirement Plan of the Inter- national City Management Association Retirement Corporation.
