The CormnisGicn met in regualr session at 10 a .m. and was called to order by Mayor Robinson. Roll call
showed the following officers present: Mayor Robinson, Commissioners Beam and ~asters, Attorney Johnston
and Clerk Hawkins.
The minutes of the previous session were read and approved.
Under the head of ~.pplications for Building permits the following were granted:

Under the head of New frQsiness:
The Ur~ted States of America, through its corps of Engineers, presented and filed a petition for the
consideration of the City LbID~i5sion for the vacation of certain streets in the City of Port ~ngeles.
After due consideration the following resolution was adopted:
RESOLUTION rUING TIME OF H.Ef'RING
WHEREAS, the United States of America by its corps of engineers has made and filed its petition with the
Ci~ Cow~ission requesting the vacation of certain streets.and alleys within the Gity of Port ~ngeles,
Washir~ton, and the City Engineer of the Cicy of Port Angeles has filed a request for the vacation of cer-
tain streets in the City of Port Angeles, which streets are described as follows, to-wit:
(a) "<1" Street, from Luaridsen Boulevard to the right-cf-way of Chicago, Milwaukee, S~. Paul
and Pac~fic Railroad COffipany.
(b) An unnamed street 35 feet vride f~o~ 20th Street to West 18th St~eet, as laid out in plat
of Sub-division Lot 128, Suburban Lots Tovrnsite of Port Angeles, being the nortIT"esterly 55 feet of said

owning all of the property abutting upon both sides of those streets referred to in paragraph (u) above
described.

It was moved ~! Commissioner Beam that the foregoing resolution be approved and adopted. Seconded by
Commissioner ~aster8. On roll call all members voted aye. The Mayor declar3d the motion carried.
Under the head of Unfinished Business:
Commissioner Masters submitted the following appointments to fill the vacancies on the Park Board:' Mrs.
Theo~ Jensen, Mrs. Dan Provo and Fred G. Beale.
, It was moved by Mayor Robinson that the foregoing appointments be confirmed. Seconded by Commissioner
Hearn. On roll call all members voted aye. 1'he Mayor declared the motion carried.

PUGET SOU^~ POVffiR & LIGHT COMPANY FOR FURNISHING WHOLESALE ELECTRICAL
SERVICE FOR RESALE MID USE
WHEREAS, PUGET SOUND POWER & UGliT COIf-PAliY has o:'fered to furnish for a period of Five (5) Years,
upon the terms set forth in the following proposed form of contract, to-wit:
POWER CONTRACT
PUGET SOUNlJ POWER & LIGHT COMPANY, herein called .Ccmpany", and TOlE CITY OF PORT ANGELES, herein called
llPurchaserll, agree as foJlcws:
FIRST: This contract is for Wholesale Service for Resale as provided in and subject to the terns and
conditions of Schedule 43 of Tariff 1.
SECOND: DELIVERY. 1:1 consideration of the mutual prorr:ises, and subject to the lir.-.itatior.s herein con-
tained, the Company agrees for a period of Five (5) cO:1secu.tive ;rears, beginning January 1, 1942} to
reserve for and furnish to Purchaser, and Purchaser agrees during said period to ouy from the Company,
exclusively: at t.he ra--;;es herein fixed, all power required or used to operate P'lrchaser's plant or addi-
t.ions or renewals thereof in the same location, and to operate said plant only Viiith electrical energ;>r
purchased from the Company hereunder. Said plant is located and described as follows: The distribution
systeffi ow~ed and operated oy the Purctaser farnishi:1g lig~t and power service to the inhabitants of the
City 0: Port P:~eles, street lighting, water pumping and other miscellaneous municipal services and in
addition liEht and power service to the inhabit.nts of an area outside of the Ccty of Port Angeles but
inside of the boundaries as shm~TI on the attached map which is hereby made a part of this contract.
Said power shall be three-phase, sixty cycle, alte~nating electric current at approximately 66,000 volts, I
and Ccmpany agrees to furnish not exceedjng 3,000 kilowatts but will furnish any additional power available'
in blocks o~ 500 KW on six months' notice by the Purchaser, up to 8 maximum of 5,000 K.W. The point o~ J
delivery shall be: The Purchaser r s high tension line 'beginnir:g beyond t~le dead-ended insulatcrs on
Company's pole in Company's Oak Street Substation. An alternate point of delivery for emergency use Dnly
shall be at first pole in PurchBser's Substation on 14th Street located one span approximately 90 feet
west from 8ompany's pcle No.6 located on Broadvray BDulevard.
THIRD: EATES. Purchaser agrees to pay eAch ffionth for the electric service furnished, at the following
rates; as provided in ochedule 43 of Tariff I:

Minimum Charge
The demenJ cherge based on the highest previously established !:>Hling demand plus the demand charge
on additiD~al capacity requested in writing, hut unused.
All bills shall be payable within ten days ::rom their date.
FOURT'J: ADDITIONAL CAPACITY. Purchaser egrees that before making any i.ncreases in its connected load which
will result in increasing Purchaser's demand boyond 3,000 kilowatts it will give the Company six ~onths
written notice in order t~at the company may make the necessary preparation to teke care of the increased
load.
rIFTH: VOLTAGE ~E3ULATION. The Compeny agrees to regulate its voltage in accordance with the Rules and
Regulations of the Washington Departrcent of Public Service. I

SUTH: RATE CHANGES. Rates are subject to change in accordance with the laws of the State of WeshilOgton 1
and whenever a new schedule of rates fOT the 503me class of service under sir.:.ilar conditions is r..ade effect-
ive, the Purchaser shall t.:1ereafter pay the new rates; provided, if the new rates are higher than thcs e
therein fixed, the Purchaser shall be entitled to cancel this contract.
SEVENTH: MEASUREME; T. Maxinum demand, cons=ption and power factor Shall be meas\.Cred by commercially
accurate maxireum demand, watt hour md pcwer factor meters furnished and installed by Purchaser, provided,
however, that the Company may install its own ~etering equipment in suitable space furnished by Purchaser.
The CD:npany shall ha"e the right to inspect Purchaser's meters from time to tirr.e, and Furchaser agrees to
correct said meters if found to be inaccurate.
All power furnished hereunder shall be ~,etered on the 2500 volt bus in Purchaser's Su!:>station located in
Block 386~ Government Townsite of Fort Angeles.
The billing de~and shall be the average of the three highest fiteen minute demands estaolished during the
~onth for vrhich the bill is being determined.
EIGHTH: In order to permit the delivery of the electrical power and energy requi.red by tte Purcheser, the
right: privilege and authority is hereby granted to the Company fer the neriod ~eginning on the effective
date of this contract and expirine December 31, 1946, to construct.' reconstruct.' maintain, repair am

TENTH: The 'Comp8ny shall hold the Purchaser harmless iron: any and all d8m.?ge to t:ersons or to property
V{hich may reSelL fro:n. any negligent act or omission of the Company, its agents, servants or eOloloyees in the
cor:stn:ction, reconstruction, maintenarice, repair and/or operatio:1 of said lines and the equipment and
accessories thereof. The Purchaser shall hold the Company harmless from an.y and all damage to persons or
to property wmch ~ay result from any ~egligent act or o~ission of the Purchaser) its agents, servants or
emplnyeesj in t.i'E maintenance or operat..iofi of the Purchaser:s lines upon said pol<::s.
The electric power and energy supplies under thi.s contrect after it'passes the point of delivery shall be
,the property of the Perchaser, and the Co:npany shall not ;,e liable for any loss or damage to any person or
prcperty whatever, resulting directly or indirectly from the usej misuse or presence of said electric ellergy~
on the premises of the Purchaser~ J.nless such less or darr.age shall be caused by tte negligence of the Com-
pany, its servants, agents or enplo;yees.
ELEVEJTH: During the tern:. of this cotrtract the Company shall at all times m2intain its lines in a sat-
isfactory conditjon and comply with all laws of the Otate of Washington, and reasonable regulAtions of the
City of Port ,,,tngeles relating thereto.' and vmrk on said lines shall be performed in accordance with State
laws a!1d municipal ordinances. It shall construct and/or reconstruct its lines with such appliances as may
conform to standard modern practice for tne reduction and elimiation of interference with radio reception.
nTELFTH: All equipment maintained hI the Company under this contract shall be subject at all times to
inspection by the officers of the City of Port Al'lgeles.

SIITEENTH: SERVICE INTERRUPTIONS. Company shalJ use reasonable diligence to furdsh uninterrupced service

Flcts of God" or by any cause beyond the control of the Company; and no temporary interruption shall C31 eel
this contract. The monthly minimum charge shalJ be reduced in proportion to the pericd of any interruption
of service.
The Company shall have the ri ght to cancel this concract if any part of the Compar.y"s property used forthe J
rendit.ion of this service is taken by er.;ir...ent domain, or if such service can no longer be rendered by reason
of franchise expiration and the inablility of the Company to secure a renewal thereof.
The City of ?ort Angeles shall have ~~e right to cancel this contract in case the Pugct Sound Pcwer & light
Conpany shall cease to be the QTiTIer of the prope:-ty used for the rendition of this .service.
S3v~NTEENTH: PURCHASER'S SHUT-Cm~JS. Puychaser shall not oe required to accept service or pay the min-
imU.'ll charge when it is unable to operat.e its electricity using apparatus on account of strikes and/or o+..her

and he hereby is authorized and directed to attest such contract and to affix thereto the seal of the City
of Port Angeles.
