IV FINANCE Anderson moved the minutes of the February 16, 1977 meeting be accepted on file as received. The motion was seconded by Councilman wray and 1. Bid ,Call. ,Authorization., a. Councilman Hordyk moved the Council authorize the Light Department to rent and call for bids on a used forklift. The motion was seconded by Councilman Ross and carried. b. Councilman Hordyk moved the Council authorize the Light Department to call for bids on forty-five 40-foot cedar distribution poles to replenish stock. Councilman Buck seconded the motion and it carried. 2. Bid Awards a. Councilman Buck moved to authorize the Public Works Director to complete contract negotiations on the Landfill Operation with Mr. L. Carr for six months at $4.57 per ton. The motion was seconded by Councilman wray and carried. I b. Councilman Hordyk moved the Council award the bid for the sale of 120 surplus transformers, 2387.5 KVA, to high bidder Ross Electric Co., Chehalis, at a total bid price of $5,180.88. The motion was seconded by Councilman Buck and carried. Other bids received were $3,088.35, T. & R. Electric, Coleman, SD; $3,590.80, Northwest Transformer Sve., Everson. ~. Councilman Wray moved the Council award the bid for approximately 30,000 feet of 334.4 MCM Bare All Aluminum Conductor "Tulip" to low bidder Graybar Electric, Tacoma at a total bid price of $6,584.86. Councilman Hordyk seconded the motion and the motion carried. Other bids received were $7,442.72, Westinghouse Electric Corp., Tacoma; $7,272.60, Maydwell & Hartzell, Seattle; $6,903.47, North Coast Electric, Seattle; $6,736.28, Arnfac Electric, Aberdeen; $6,680.89, Anixter-Pruzan, Seattle; $6,678.05, Utility Supply, Tacoma; $6,621.30, General Electric, Tacoma. 248 CITY COUNCIL MEETING March 2, 1977 IV FINANCE 3. Payroll. Councilman Hordyk moved the Council authorize Payroll Transfers of $113,138.07. The motion was seconded by Councilman Buck and carried. v ITEMS FROM THE AUDIENCE NOT ON THE AGENDA None. I VI LEGISLATION 1. FINAL PUBLIC HEARING - L.I.D. 198 PEABODY As a starting point in the continued public hearing on the L.I.D. No. 198 Final Assessment Roll, the Council first took under consideration City Manager Whorton's report on issues raised or filed prior to or at the February 16, 1977 public hearing which require clarification or resolution prior to adoption of the Final Assessment Roll on L.I.D. No. 198. Mayor Olson asked Manager Whorton to explain Item No. 1 which related to disposi- tion of $32,000 which was turned over to the City in May, 1960 on Sewer Districts Numbers 1 thru 4. Manager Whorton stated that $32,425 was turned over to the City on Sewer Districts 1 and 2, or L.I.D. No. 181. In June, 1970, $31,251 of this $32,425 was transferred to the Street Fund for mainte- nance. The bonds were paid off on L.I.D. No. 181 and the cash balance as of December 31, 1976 is $1,174. On Sewer Districts 3 and 4, or L.I.D. No. 182, the December 31. 1976 cash balance is $11,510, with $17,650 remaining in bonds outstanding. The net deficit to the City on Sewer Districts No. 1 thru 4 is $4,966. Mayor Olson referred Item No. 2 to Attorney Walrath for clarification. This issue related to a question raised by certain property owners of a I potential conflict of interest among three Council members who reside or own property within the boundaries of L.I.D. No. 198. Attorney walrath explained that a difference does exist between conflict of interest and an appearance of fairness. A conflict of interest is a conflict which does exist and an appearance of fairness is one where it only appears that a conflict might exist whether one does or not. In this situation, all the Council should be concerned about is whether an appearance of unfairness or undue influence might exist. In Attorney Walrath's opinion, all the Council- members have a right to vote on certification of the final assessment roll, however, the validity of the certification could be subject to challenge. His recommendation to the Council was that the four Council members who do not own property within L.I.D. No. 198 participate in the evaluation of the final assessment roll and vote on certification of said roll, with the three Councilmembers who own property within L.r.D. No. 198 not participating in the evaluation of the assessment roll and not voting on certification of the assessment roll. Item No. 3 related to the thirty-three written protests filed by property owners. Manager Whorton informed the Council that a majority of the protests have been resolved. The remaining protests have been grouped into categories according to the nature of the protest. Although the staff also met with these property owners, their concerns were unable to be resolved because of policy questions involved that will have to be decided by the Council. a. Property owners who did not receive preliminary notices: I Evert A. Carlson, 1514 W. 6th Georgia L. Phillips, Rt 3, Box 1646 Arthur L. Lannoye, Jr., 330 Forest Ave. Clallam County Theodore A. serr, 321 W. Park Ave. Art Haugstad, 131 Forest Ave. K. Isenberger, 135 Forest Ave. L. E. Attwood, 139 Forest Ave. Ray Robinson, 148 Park Ave. V. R. Wilson, 115 Apple Lane Recommendation - take them out of L.I.D. No. 198 and treat as if they were a new L.I.D. 249 CITY COUNCIL MEETING March 2, 1977 VI LEGISLATION 1. FINAL PUBLIC HEARING - L.I.D. 198 PEABODY (Cont.) 'I After Mayor Olson read the above list of property owners and the recommendation, Manager 'Whorton explained that rather than subject the final assessment roll to challenge because of an apparent improper notification procedure involving these property owners, it is recommend- ed a separate L.I.D. be created for the ten property owners whose total assessments amount to $7,267. The problem does exist however that should these property owners protest the new L.I.D. enmasse, the City would be obligated to assume this liability. Mayor Olson then invited comments from any of the involved property owners. There were no comments from the floor. b. Lack of proper Notice - DNR has protested because they were not notified in the proper fashion. State agencies have different notification requirements which DNR claims we failed to follow. Recommendation - Do nothing as the City Attorney is working to correct the situation. It is a gamble on our part, however, as they could sue and have the L.I.D. invalidated which means it would be necessary to go through a reassessment procedure. Manager Whorton commented that it is hoped that this matter can be resolved through communication with DNR and that DNR will withdraw their protest. c. Dissatisfaction with Zone and Termini Method of Calculating Assessments - Several protests were received wherein the property owners felt the results of the zone and termini computations resulted in an inequitable situation. The City Council, sitting as Board of Equalization, has the authority to relieve hardships; however, any action taken by the City Council must be considered as a class action, i.e., action taken, for example, to relieve problem on one dead-end street would affect all other dead-end streets in the L.I.D. in the same way. I 1. The following protests are all based on contention that assessments should be spread to other property owners on the same dead-end street: Frank Beutler, 346 Hillcrest Drive Darold Powell, 336 Hillcrest Drive Fred Bedford, 332 Hillcrest Drive Lee Berg, 3416 S. peabody (Lot 14 - Hillcrest) sharon Johnson, 620 E. Lopez 2. The protests by the following three property owners are based on the contention that all of the lots within Southwood should be assessed: Fred Wilson, 2504 Columbus Ron Wasnock, 224 Columbus Terry Ann Norberg, 316 Columbus 3. Several protests were received regarding higher assessments for corner lots. All protesters, except Richard Anderson, 331 E. Vashon, appear to have been satisfied after receiving explanation on the zone and termini method. I Recommendation - Deny all protests, otherwise it will mean recomputing all assessments and going through the entire hearing procedure and in the meantime the interest of $6,750 per month will continue to accumu- late. The issue before the City Council is whether the application of the zone and termini method was consistent throughout the L.r.D. 250 CITY COUNCIL MEETING March 2, 1977 VI LEGISLATION 1. FINAL PUBLIC HEARING - L.I.D. 198 PEABODY (Cont.) Mayor Olson read the above statement and then asked for comments from property owners in this category. A general discussion followed between the City Council, Manager Whorton, Attorney Walrath and property owner s. Johnson concerning the zone and termini method of calculating assessments. During the discussion Mrs. Johnson expressed the opinion that the zone and termini method is totally inequitable and requested the City Council to lodge an official protest with the State Legislature against the zone and termini method of calculating L.I.D. assessments and requesting the law be changed. Councilman Hordyk commented that the most effective method would be to go through the Association of Washington Cities. I Councilman Ross then moved the Council direct City Manager Whorton to write a letter to the Association of washington Cities concerning this matter. The motion was seconded by Councilman Wray and passed by the four Councilmen voting on this motion. Mayor Olson asked if any other property owners in this category wished to make any comments. L. Berg of 3416 South Peabody (Lot 14 - Hill- crest) discussed with the City Council, Manager Whorton, Attorney Walrath and Public Works Director Flodstrom the method used for assess- ing involved property owners for Peabody Street. Mr. Berg was informed during the discussion that the application of the zone and termini method used for computing assessments for Peabody Street was consistent throughout the L.I.D. Mr. Johansen spoke about increased assessment at this time with Margaret Wood registering a complaint about a $700.00 increase in her assessment because of the improvement to Vine Street which was completed at the I request of Mr. Johansen and Mr. Garrison by letter. During discussion on this matter it was determined that the application of the zone and termini method used in computing Mrs. Woods assessment was consistent throughout the L.I.D. Public Works Director Flodstrom next explained the situation regarding protests received concerning higher assessments for corner lots. The Council discussed this matter with Mr. Richard Anderson and Manager Whorton. The Council decided that negotiations with Mr. Anderson should be continued. d. Property owners who had or need work done because of the conditions left by Contractor: 1. Viola Wickering, 2904 Maple - We have agreed to improve cut slope in front of her property to where she can plant and maintain landscaping. 2. Leo Konopaski, 214 E. Lopez - Car drags in driveway - City will try to reshape driveway so car and trailer do not drag. 3. Dorothy White, 2907 Maple Street - Tree damaged and no driveway opening left - City will prune damaged tree; possibly she could be compensated driveway opening that was not provided. I 4. Jesse Ringer, 142 Viewcrest - Had to spend $262.70 to make drive- way usable, should City reimburse all or a portion of this cost? 5. Norman pennington, 315 West 10th - Wants Boulevard fill behind house dressed up and is concerned that street is encroaching upon his property. 6. Art Lannoye, 330 Forest - City will attempt to improve steepness of driveway. Recommendation - Authorize Public Works Director to continue working with property owners. 251 CITY COUNCIL MEETING March 2, 1977 VI LEGISLATION 1. FINAL PUBLIC HEARING - L.I.D. 198 PEABODY (Cont.) I After Mayor Olson read the above category of protests, Councilman Ross moved the Council authorize Public Works Director Flodstrom to continue working with these property owners. The motion was seconded by Council- man Hordyk and passed by the four Councilmen voting on this motion. At this point the Council .referred back to Item No.3, Section A, concerning the removal of the ten property owners who did not receive preliminary notices from L.I.D. No. 198 and creating a new L.I.D. for these property owners. The discussion was continued on this matter between the Council, Manager Whorton, and Attorney Walrath. Following the discussion Councilman Ross moved the Council remove the ten property owners who did not receive preliminary notices from L.I.D. No. 198 and a new L.I.D. be created for these property owners. The motion was seconded by Councilman Hordyk and passed by the four Councilmen voting on this motion. Councilman Ross next moved that the Council deny the protests that were registered concerning dissatisfaction with the zone and termini method of calculating assessments as listed above under Item No.3, Section C, sub- sections 1, 2 and 3. The motion was seconded by Councilman Hordyk and passed by the four Councilmen voting on this motion. Mayor Olson then introduced and read by title Ordinance No. 1908 entitled, ORDINANCE NO. 1908 I AN ORDINANCE of the City of Port Angeles, Washington approving and confirming the assessments and assessment roll of Local Improvement District No. 198, levying assessments against the several lots, tracts and parcels of land as shown on the assessment roll, fixing interest and penalties, and providing for the payment of such assessments, interest and penalties into the Local Improvement District No. 198 Fund of the City. Manager Whorton advised the Council that the amount of the assessment roll after deleting the aforementioned ten property owners is $1,547,715.69 and that the interest rate is 7.5%. Councilman Hordyk then moved the Council adopt Ordinance No. 1908 as read by title by Mayor Olson. The motion was seconded by Councilman Ross and passed by the four Councilmen voting on this motion. It is noted for the record that City Engineer Warder's Certification of Mailing of Hearing Notice and Final Assessments and Certification of Expenses used in Preparation of the Final Assessment Roll were filed with the City Council at the February 16, 1977 Public Hearing on the L.I.D. No. 198 Final Assessment Roll. 2. PUBLIC HEARING - COLVIN CONSTRUCTION REZONE REQUEST I At 9:05 P.M. Mayor Olson opened the public hearing on Colvin Construction's request for the rezone of a part of Block 1 Pennsylvania Park Addition from RS-7 to RMF. Mayor Olson then asked for comments from the audience. A general discussion followed with area residents G. Bettinger, H. Pollard, D. Bott, L. Smith, J. Baxter, and Mr. & Mrs. Perry speak~ng in opposition to the rezone. Testimoney supporting the rezone was presented by B. Colvin, M. Scarano and L. Jagger with Mr. Colvin and Realtors B. Philpott and D. Bott advising the Council of the need for apartments within the City. PUBLIC HEARING - COLVIN CONSTRUCTION REZONE REQUEST (Cont.) the need for apartments within the City, and the Council's moral obligation to provide adequate housing for its citizens in conjunction with planned development of the City. After listening to all the testimoney of the opponents and proponents of I the request, Mayor Olson declared the hearing closed at 10:10 P.M. Councilman Buck then moved the Council concur with the recommendation of the Planning Commission and Bill Colvin's application for rezone be granted by reason of its compliance with the Comprehensive Plan, its compatibility with the Community, and that it contributes to the general welfare. The motion was seconded by Councilman Haguewood. On call for the question, Councilman Buck voted "AYE", all other Councilmen voted "NO". The motion was denied. 3. PUBLIC HEARING - PINEBROOK SUBDIVISION The Public Hearing on the Preliminary Plat of pinebrook Subdivision located west of McDougal Street near Eckard Avenue was opened by Mayor Olson. On Mayor Olson's request for comments, Councilman Anderson made a favorable comment to the fact that the Preliminary Plat included two duplex lots. Mayor Olson asked if anyone from the audience wished to express their views on the Preliminary Plat. After receiving no response from the audience, Mayor Olson declared the public hearing closed. Councilman Hordyk moved the Council accept the Preliminary Plat of pinebrook Subdivision in concur- rence with the Planning Commission's recommendation. The motion was seconded by Councilman Wray and passed by the Council. 4. PUBLIC HEARING - VALLEY STREET IMPROVEMENT (L.I.D. No. 200) I Public Works Director Flodstrom presented the revised project plan for the improvement of Valley Street. The latest revision included an exten- sion to the 12th/13th alley. The total cost of the project to pave Valley Street with 2" asphalt to the alley between 12th and 13th Street will be $48,800.00, an increase of 16% in the number of assessible units, however this represents only three more property owners. This plan includes culverts being put in to correct the low spots that trap water at the end of Valley Street. Mayor Olson declared the public hearing open and asked for comments from the audience. Some residents of Valley Street were in the audience and expressed approval of the proposed plan using 2" paving. Mayor Olson declared the hearing closed after asking for any additional comments from the audience .and none were forthcoming. Mayor Olson then introduced and read by title Resolution No. 24-76 as amended entitled: IMPROVEMENT RESOLUTION NO. 24-76 AS AMENDED A RESOLUTION of the Council of the City of Port Angeles, Washington, declaring the intention of the City Council to improve a certain area within the City by grading, paving and draining the street's therein, and extending the water main and by doing all work necessary in connection therewith, and fixing a time, date and place for the hearing on this resolution of intention. 15. Councilman Ross moved the Council adopt the foregoing Resolution. The motion was seconded by Councilman Wray and passed by the Council with Councilman Anderson abstaining. I PUBLIC HEARING - MAGNUSON REZONE RECONSIDERATION Mayor Olson declared the public hearing open on the request of B. Magnuson that the Council reconsider his request for the rezone of property owned by himself on Lauridsen Blvd. off Pine Street from R$-7 and RS-9 to RMF and PBP. 2~2 CITY COUNCIL MEETING March 2, 1977 VI LEGISLATION 2. PUBLIC HEARING - MAGNUSON REZONE RECONSIDERATION (Cant.) I On Mayor Olson's request for comments from the audience, D. Adolphsen of 1906 S. pine Street protested the rezone expressing a concern regarding the additional traffic hazards in the area that would be created by multi- family dwellings. Mr. Magnuson was in attendance and explained to the Council and the audience exactly what his plans are for developing this area. During discussion on the proposed rezone, Mr. Whorton referred to the terms of the annexation agreement that Mr. Magnuson will abide by. As there was no further participation from the audience, Mayor Olson declared the hearing closed. Councilman Hordyk then moved that the Council approve Mr. Magnuson's rezone request. The motion was seconded by Councilman Buck and carried with Councilman Anderson voting "NO". Councilman Anderson expressed the opinion at this time that the City has the obligation to improve the substandard pine Hill Street going down to Highway 101. At this point, Manager Whorton referred back to the Annexation Agreement and recommended the Council take legislative action to approve the Annexation Agreement in conjunction with the rezone Ordinance. Councilman Hordyk moved the Council approve the Annexation Agreement and adopt the rezone Ordinance. The motion was seconded by Councilman Ross and unanimously passed by the Council. ORDINANCE NO. 1909 I AN ORDINANCE amending Ordinance No. 1709, the Zoning Ordinance of the Ci~y of Port Angeles by rezoning part of Block 2 of Cooper's Addition and a portion of vacated Leiser's Addition at the south end of pine Hill from RS-7 and RS-9 Residential zone, to RMF Residential MUlti-Family and PBP Public zone. 6. PLANNING COMMISSION Mayor Olson read the minutes of the Planning Commission February 28, 1977 meeting with the following action being taken by the Council. Councilman Wray moved to set a Public Hearing for April 6, 1977 on a street vacation request for a portion of Eunice Street between Rhodes Road and Rose Street. The motion was seconded by Councilman Buck and passed. A motion to hold a Public Hearing on March 16, 1977 on the Fisher Construc- tion request for rezone from RS-7 Residential Single Family to RMF Residential Multi-Family of the South half of Lot 2, Broadway Addition was made by Councilman Buck. The motion was seconded by Councilman Hordyk and it passed. I Councilman Buck moved to hold a Public Hearing on April 6, 1977 on the street vacation of Fountain Street within Pennsylvania Park Addition. The motion was seconded by Councilman Hordyk and passed. Councilman Hordyk moved the Council concur with the Planning Commission and issue a Conditional Use permit in the CAD-R Zone to John pickett to operate an ambulance service at 925 E. Front Street with the condition that the siren not be used in the alley. Councilman Hordyk made a motion to declare a moratorium on Conditional Use Permits on home occupations until the Planning Commission can establish guidelines for their use. The motion was seconded by Councilman Buck, with Councilman Ross recommending the motion be amended to include the phrase, I "except those Conditional yse Permits that come up for renewals". Councilman Hordyk moved to amend the motion to include this phrase, with Councilman Buck seconding the motion as amended. The motion as amended was passed by the Council. Councilman Anderson moved the Council accept and place on file the minutes of the Planning Commission February 28, 1977 meeting as read by Mayor Olson. The motion was seconded by Councilman Haguewood and passed by the Council. 7. PARK AND BEAUTIFICATION CpMMISSrON Councilman Anderson moved the Council accept and place on file the minutes 'of the Park and Beautification Commission Meeting of January 22, 1977. The motion was .seconded by Councilman Haguewood and carried. 8. LETTER FROM CLALLAM ART LEAGUE The Council next considered a request from the Clallam Art League to use the ticket office on the CPR dock as a gallery for sales of works of art by area artists. After discussing the request with Manager Whorton, Council- man Hordyk made a motion to deny this request. This motion was seconded by Councilman Wray and passed by the Council. 9 LETTER FROM DOWNTOWN MERCHANT"S ASSOCIATION A request from the Downtown Merchant's Association for the use of Laurel I Street between 1st and Front'Streets, for a display of boats on March 26 and 27, 1977 was considered. A motion was made by Councilman Buck to approve this request. Councilman Ross seconded the motion. During discus- sion on the motion, it was determined that Manager Whorton will check into having proper insurance coverage for these types of displays for the City. On call for the question, the motion was passed by the Council. 10. HANGING FLOWER BASKET PROGRAM FOR 1977 City Manager Whorton is requesting permission to contact merchants and others in supporting the Hanging Flower Basket program. Councilman Ross made a motion granting permission to Mr. Whorton to proceed on the Hanging Flower Basket Program as outlined in his Memorandum. The motion was seconded by Councilman Anderson and passed by the Council. 11. WATER AND POWER CONSERVATION PROGRAM REPORT Councilman Ross moved to accept City Manager Whorton's Report on Water and Power Conservation for the City. The motion was seconded by Councilman Buck and the motion carried. 12. TRIP TO WALLA WALLA The dates of March 13-15, 1977 were tentatively set for the first visit to Walla Walla by Public Works Director Flodstrom and some Councilmembers to view the operation of the Rapid Rail method of garbage collection. I 13. SPECIAL CITY COUNCIL MEETING A motion to. set a Special Meeting of the City Council for Wednesday, March 9, 1977, as requested by Manager Whorton, was made by Councilman Buck. The motion was seconded by Councilman Hordyk and approved by the Council. 255 CITY COUNCIL MEETING March 2, 1977 VI LEGISLATION 14. CHAMBER OF COMMERCE REQUEST I The request from the Chamber of Commerce asking the Council to set a sign moratorium until such time as a new ordinance is adopted was discussed with members of the Chamber of Commerce and the Council. Manager Whorton stated that the variance procedure outlined in the Chamber's letter would not work because the Board o~ Adjustment could not use proposed guide- lines. He recommended an interim ordinance containing the proposed guide- lines or a warning system to individuals preparing to install signs. After further discussion it was decided to set a Public Hearing on March 16, 1977 to receive public input on the possibility of a moratorium on signs. 15. LATE ITEMS 1. Manager Whorton requested permission to write the State Highway Dept. on behalf of the Council regarding the revised schedule on the work on the East Front/First Intersection. Manager Whorton would urge the Highway Dept. to cut their processing time down and move the work schedule ahead so as not to conflict with the tourist season. Council- man Ross made a motion to have the City Manager write the State Highway Dept. for a work revision. The motion was seconded by Councilman Buck and carried. 2. Councilman wray made a motion to authorize the City Manager to write a protest letter to the State House of Representatives against HB 10, regarding Civil Service and collective bargaining. The motion was seconded by Councilman Hordyk and carried. VII STAFF REPORTS I Councilman Hordyk moved the Council accept and place on file the following staff reports: Police Dept. 1976 Report, Municipal Judge, January Report, Report on Traffic and Parking Revisions. The'motion was seconded by Councilman Buck and carried. Councilman Hordyk: Commented on UPS - double parking and driving on wrong side of the street. Requests a letter be written to the local UPS Manager. Police should be setting examples of traffic control in the City. Cited number of deaths ~n Clallam County this year.
