The purpose of this meeting is to consider a contract with the law firm which is representing the City at the oilport contested case hearings. I II ROLL CALL Members Present: Mayor Haguewood, Councilmen Anderson, Boardman, Buck, Duncan, Hordyk. Members Absent: councilman Wray. Staff Present: Manager Whorton, Attorney Miller, Deputy Clerk Caso. Guests Present: county commissioners Lotzgesell, Lydiard, and Richards, County Prosecuting Attorney Meiner, Deputy Prosecutor Knutson. III MINUTES Suspended. IV LEGISLATION 1. CONTRACT WITH LOGERWELL, COHEN & ANDREWS During the March 20, 1979 regular Council meeting, the Council re- submitted a draft contract between the County, the City, and Loger- well, Cohen and Andrews for reconsideration by the county. The I Council also included the following alternative as an explanation for the method of payment and participation in the EFSEC hearings by the City Attorney and County Prosecuting Attorney; request Loger- well, et al to keep three accounts, one exclusively County, one exclusively City, and one joint. The joint account would be paid on a 50/50 basis, and the City and County would bear the cost for fees exclusively devoted to representing each. At this meeting, City Attorney Miller and the County Commissioners submitted drafts on proposed method of payment and participation by City and County Attorneys. The County draft also included a pro- posed "Termination" clause. The Council and county Commissioners discussed both drafts at length with Attorney Miller, Prosecuting Attorney Meiner and Deputy Prosecutor Greg Knutson. Subjects dis- cussed included the need for immediate preparation for the EFSEC hearings, the advantages and disadvantages of postponing signing the contract with Logerwell, et aI, because of recent hearing delays, what protection the City would require, in the way of mitigating measures, in the event the federal government should pre-empt the decision on location of oil transshipment facilities; degree of participation by City and County Attorneys, use of the Oilport Task Force information by the oilport attorney, and the allocation of costs by the oilport attorney. councilman Anderson then moved the Council adopt the draft submitted by the County on "Method of Payment for participation by City and County Attorneys" and "Termination." The motion was seconded by Councilman Duncan. During discussion on the motion, Mayor Haguewood read the proposed draft and a few minor changes were made to the language.
