CITY COUNCIL MEETING

I CALL TO ORDER
The special meeting was called to order by Mayor Haguewood at 7:00 P.M.
The purpose of this meeting is discussions relating to the Northern Tier
Pipeline Project.

Members Absent: Councilmen Buck, Polhamus.

Councilman Hordyk moved the Council accept and place on file as received the
minutes of the March 20, 1980 negotiating session. The motion was seconded by
Councilman Boardman and carried.

V LBGISLATION
1. ADOPTION OF NEGOTIATION GUIDELINES & MEETING PROCEDURES
The first subject discussed by the parties was adoption of the negotiation
guidelines and procedures which were discussed at the March 20th meeting.
Prior to any discussion or action on this matter, Attorney Miller stated
for the record that these discussions are taking place in the context of
the Northern Tier Pipeline Company's application for site certification
before the Washington state Energy Facility Site Evaluation Council, Ap-
plication No. 76-2. Therefore, for the purposes of the Open Public Me-
etings Act, any executive session or "caucus" held to discuss these
negotiations falls within either the pending litigation or attorney-
client privelege exceptions to the Open Public Meetings Act, and these
discussions may appropriately be held in executive session. After a
brief caucus, Attorney Miller, Manager Flodstrom and Bill Sage discussed
proposed amendments to the Guidelines, with the following conclusions:
4A. The Northern Tier Negotiating Issues Team and the Port Angeles City
Staff shall conduct discussions prior to the sessions between the
City Council and the Northern Tier Negotiating Committee. At these
meetings the parties shall attempt to either agree upon, or narrow
the scope of the issues for discussion in a negotiating session.
4B. The City Council hereby authorizes the City Staff to negotiate upon
its behalf at these staff level meetings, subject to a grant of
settlement authority by the Council and the. right of approval of
final agreements reached by the Council.
Councilman Hordyk then moved the Council accept the Negotiation Guidelines,
including amendments. 4A and 4B, the Negotiation Procedur~s, and the Meeting
Format. The motion was seconded by Councilman Boardman and carried. Bill
Sage then indicated that the Negotiation Guidelines and Procedures and the
Meeting Format were acceptable to Northern Tier.

SCHEDULE NEXT NEGOTIATION SESSION: AGENDA ITEMS

The next negotiation session was scheduled for Tuesday, April 15, 1980
at 5:00 P.M. The following issues were requested for discussion: (A)
Recovery of indirect and out-of-pocket costs incurred to date by the
City of Port'Angeles; (B) Land use fee and need for arranging impact
fees (Northern Tier's choice); (C) Community housing impact (City's
choice); '(D) water, Sewer and Solid waste requirements by the City
(Northern Tier's choice). The City held on its next choice because
of the time restriction at the next meeting.

ISSUE NO.2: RECOVERY OF COSTS
Final position papers on the recovery of costs incurred by the City were
presented by Bill Sage and Attorney Miller. Both positions were similar
in content, with Northern Tier proposing a sum of $150,000 for objective
review and analysis of their project, both past and present, and the City
proposing a sum of $160,000. In addition to that sum, the City and Northern
Tier both proposed that Northern Tier should agree to pay the cost of any
studies agreed to in support or as a result of the negotiation process.
Both parties then discussed at length the proposed language for appropri-
ating Northern Tier's financial assistance to the City, as well as the
payment mechanisms involved. Tentative agreements were reached on the
language and amounts to be paid, with final resolution of this issue to
be at the April 15, 1980 negotiation session.
