Roll call showed the following officers present: Mayor Beetle, Commissioners Beam and Lind~ Attorney Conniff and ! Clerk Hawkins. I The minutes of the previous session were read and approved. ! Caven, garage, Lot 5, Block 71, Townsite 500.00 SOD .00 1000.00 150.00 2000.00 425.00 700.00 300.00 Under the head of Reading and Passage of Ordinances the following Ordinance passed its third reading and was finally adopted: AN ORDINANCE defining "milk" and certain "milk products," "milk producer, tI "pasteurization," etc., pro- hibiting the sale of adulterated and misbranded milk and milk products, requiring permits for the sale of milk and milk products, regulating the inspection of dairy farms and milk plants, the examination, grading, I labeling, placarding, pasteurization, regrading, distribution, and sale of milk and milk products, pro- viding for the publishing of milk grades, the construction of future cairies and milk plants, the enforce- ment of this ordinance, the fixing of penalties, and declaring an emergency to make the ordinance immed- iately effective. It was moved by Mayor Beetle that the foregoing ordinance be placed on its final reading and adopted. Seconded by Commissioner Lind. On roll call all members voted aye. GUARANTY FUND Ci ty Trea sure r II II Assessments Lot 10, Block 122 " Lot 15 & W~ of 16,Block 3, Hartt & Cooke Subd. 65.25 lBO.55 / 'D'o u:;. _ '71' presented: Under the head of New Business, the following Petition for Va~ation of certain alley was PETITION TO THE CITY C01~IISSION OF THE CITY OF PORT ANGELES: property abutting upon ths portion of the alley extending of the l07msite of Port Angeles easterly to Lincoln Street, I vacate that portion of the alley running westerly ,through of Lots 17 and 2 in said Block 69 easterly to Lincoln Street. I Your petitioners agree that upon the passage of any ordinance vacating that protion of said alley they will \ execute and deliver to the City of Port Angeles an easement and right of way permitting ,said city'to main- 1 tain any sewer, gas line or water line in said alley and giving to the said city the'right to enter upon said vacated portion for the purpose of maintaining, repairing or renewing any such gas or water line. The undersigned, being all of the owners of the from the West line of Lots 17 and 2 in Block 69 do hereqy petition your Honorable Commission to said Block 69 extending from the westerly lines Your petitioners have also deposited a deed cOnveytgg to the City of Port Angeles an alleyway twenty feet in width running from the alley now existing in said Block 69 southerly to ,Fourth Street along the westerly side of Lot 16 and northerly along the easterly side of Lot 3 in said block so that all property owners now 11 ving in said plock will have complete access from both ends of said alleyway to their property as the same is now situated. After duly considering the foregoing petition the following resolution was introduced: RESOLUTION FIXING TIME WHEREAS, a petition has been filed praying for the vacation of that portion of the alley in Block Sixty- nine (69) of the Townsite of Port :4ngeles extending from the Wes t line of Lots 17 and 2 in said Blo ck easterly to Lincoln Strest, and of ~~REAS, said petition has been signed qy all/the property owners abutting upon that portion of the alley sought to be vacated, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COliMISSION OF THE CITY OF PORT ANGElES: That a hearing be had upon said petition and that the time of said hearing be and the same is hereby set as Wednesday, the 6th day of May, 1942, at the hour of 10 o'clock, a.m., and the place of such hearing is hereby fixed as the room where the City Commission meets in the F~re, Hall at Second and Lincoln Streets in the City of Port Angeles, and the Clerk is hereby directed to post noti~e of such hearing in three public places in the City of Port 'Angeles and one on the property or portion of the alley sought to be vacated. It was moved by Commi ssioner Lind that the foregoing resolution be approved and adopted. . Seconded by Commissioner Beam. On roll call all members voted aye. The Mayor declared tha motion carried. Under the head of Introduction of Resolutions the following resolutions were introduced: RESOLUTION WHEREAS, The City of Port Angeles is the owner of the following described real property, haying acquired the same as an investment for the Local Improvement District Guaranty Fund: I (~ I The East ~ of the North 120 feet of Lot Four (4), Block One (1), J ., Tidelands West of Laurel Street, in front of Port Angeles, Wash- r!. ington, and 'J~ ~ J WHEREAS, w. ~. McMahan has offered to purchase the above described real property from the City of Port N 1 Angeles for the sum of $300.00, and j~~l1 WHEREAB, Ths City Commission has viewed the said property and is of 'the opinion that the offsr is fair I ~ ~ value and that at this time it is the best interest of the City that it should be accepted and the sale l'(f made. 't NOW, THEREFORE, BE IT RESOLVED, that said offer be accepted and that the City of Port Angeles sell the . ~ f;;, . said property at private sale to the said W. D. McMahan for the sum hereinabove mentioned, Subject to any other valid liens against the same; that the City Attorney be instructed to prepare a quit claim deed con- .~ { veying said property to the purchaser, and th~t the City ulerk of the City of Port Angeles be and he is ~ hsreqy instructed to execute said quit claim deed, and that the Mayor of the City of Port Angeles be and he is hereby instructed to countersign said quit claim deed when the purchase price and all accrued inter- , est thereon has been paid in full. It was moved by Commissioner Beam that the foregoing resolution be approved and adopted. Seconded by Commissioner Lind. On roll call all members voted aye. The Mayor declared the motion carried. RESOLUTION CANCELLING THAT CERTAIN RESOLUTION AUTHORIZINC THE SALE OF REAL PROPERTY TO F. S. INGERSOLL WHEREAS, by the authority of that certain resolution adopted July 23, 1941, and recorded in Vol. 20, page 3],3 of Commissioners' Proceedings, the ility of l'ort Angeles entered into a sale with ~. 5. Ingersoll for the purchase from the City of Port Angeles the following described real property, to-wit: Lot One (1), Block Two Hundred Twenty-one (221), Townsite of Port Angeles, Washington, and WHEREAS, the said F. S. Ingersoll offered to purchase the said above described real property for the sum of $75.00, psyable as follows: '1,115.00 ss a down psyment and $5.00 on or before the 1st day of Beptember, 1941, and $5.00 on or before the 1st day of each and every month thereafter until paid in full. Interest to be computed at the rate of 710 per annum on the balance due andpaid with the monthly instalJments; ll... I I I I I Proceedings of the City Commission of the City of Port Angeles, Washington April 15. 1942 19_ ..... 403 which said offer was accepted by the City Commission and the sals authorized under the terms and condi- tions abova set forth, and WHEREAS, all payments on said contract of sale were made as provided therein, up to and including December, 1941, and thereafter on or about the 12th day of December, 1941, the said F. S. Ingersoll died and his wife, Mable M. Ingersoll, notified the City Treasurer that no further payments would be made on the con- tract, as she did not care to continue the payments and purchase the property. 1 NOW, TIJEREFORE, BE IT RESOLVED, that the said resolution above referred to be, and the same is hereby cancelled and set aside, and the sale of the above described real property to the said F. B. Ingersoll be and said sale is hereby revoked. It was moved by Commissioner Beam thst the foregoing resolution be approved and adopted. Seconded by Commissioner Lind. On roll call all members voted aye. Lhe Mayor declared the motion carried. RESOLUTION I WHEREAS, at a public sale of real property on the 12th day of March, 1938, pursuant to a real property local improvement assessment judgment entered in the ~perior Court of the County of Clallam, on the 4th day of December, 1957, in proceeding to foreclose local improvement assessment liens upon real property, the following described real property owned by Clara McUuire was included in the said Judgment and sale, to-wit: Lots Nine (9) and Ten (10), Block Three Hundred Ninetsen (319) of the Townsite of Port Angeles, Washington, and WHEREAS, the said Clara McGuire after the date of the sale, March 12, 1938, and prior to issuing the deed for said property to the City on March 25, 1940, as provided by law, appeared at the City Treasurer's office and paid all the assessments against the above described property and redeemed the same from the sale. and WHEREAS, the Treasurer's deed to the above described property among other property had already been prepared and was filed for record, without first removing from the deed the above described property, on which all assessments had been paid and redeemed from the sale by the said Clar", McGuire. NOW, THEREFORE, BE IT RESOLVED, by the City Commission that in order to correct the error of des ding the above described property to the City of Port Angeles, the City Attorney be instructed to prepare a deed conveying said property to the said Clara McGuire; and that the City Treasurer be and she is hereby authorized to execute said deed. It was moved by Commissioner Beam that the foregoing resolution,be approved and adopted. Seconded by Commissioner Lind. On roll .call all members voted aye. The Mayor declsred the motion carried.
