Roll call present: Mayor Beetle, Commissioners Bean and Lind, Attorney Conniff and The minutes of the previous session were read and approved: Under the head of Applications for Building Permits the following were granted: A. N. Williams, Build Work :!lhop, Lot 6, Block 289, 'l'ownsi te Louis Nelson, Construct Dry Hln on Port Fill at Foot of Pine St. Herman Olson, Construct Garage, Lot 1, Block 9, P.S.C.C. Subel. ~oo.oo 140.00 60.00 Under the head of Introduction of Resolutions the following resolutions were introduced: RESOLUTION TO SELL PROPERTY ACQUIRED BY FORECLOSURE WHEREAS, The City of Port ~eles is the owner of the following described property in the City of Port Angele s, to-wit: Lot Seven (7), Block Eighty-four (84) of the Townsite of Port ~ngeles, Clallam Coa~ty, Washington, , whicn said prop6"ty nas been acquired by the City on foreclosure of delinquent local improvement assess- ments under Cnapter 205 of the Session Laws of 1927, and WHEREAS, Gladys M. Buchello has offered to purchase the above described real property from the City of Port Angeles for the 51lm of $125.00, payable as follows: $25.00 as a down payment and $10.00 on or before the 25th day of May, 1940, and $10.00 on or before the 25th day of each and avery month thereafter until paid in full. Interest at the rate of 7% per armum to be computed on the balance due and paid with the monthly installment, and WHEREIIS, The City Conrr.ission has viewed the said property and is of the opw~on that the offer is fair value and is in excess of the amount paid by the City for said property, plus all L.LD. assessments, including interest and otner charges against the same. NOW, THEREFORE, BE IT RESOLVED, That the said offer be accepted and that the City of Port IIngeles sell the said property at private sale to tne said Gladys M. Buchello for tne sum hereinabove set forth, subject to any v!tiid liens against the same; that the City Attorney be instructed to prepare a deed conveying said property to the purchaser, and the City Treasurer be authorized to execute the said deed in accordance with the provisions of this resolution and Chapter 275, Session Laws of 1927, tnen the purchase price and all accrued interest thereon has been paid in full. It was moved by Commissioner Beam that the foregoing resolution be approved and adJ pted. Seconded by Commissioner Lind. On roll call all members voted aye. The Mayor declared the motion carried. RESa:;UTION BE IT RESOLVED by the City Commission of tne City of Port Angeles, Washington, that the Mayor and the City Clerk of the City of Port Angeles be, and they are hereby authorized to execute the contract between Rayonier, Incorporated, Port Angeles Division, and the City of Port Angeles, which said contract is incorpo- rated in the letter dated :April 24, 1940, from Rayonier, Incorporated, Port Angeles Division, to the City of Port 1l'ngeles, which is as follows: RAYONIER Incorporated Port Angeles Division Port Angeles, Washington April 24, 1940. BEETLE, MAYOR Gentlemen: This letter embodies our agreement with you whereby we will advance to you the necessary funds to cover the a cquisiti.op.fY you, as apart of your Elwha River Water Extension Project (as extended by Ord- inance No. 888) ,-':.\'1' the NE~ of Section 10 and the SEi of the SE~ of Section 3, all in Twp. 30 North, Range 7 West, W.M., excepting the ten-acre tract in Section 10 on which the headworks $re situated and subject to the existing rights-cf-way for the railroad and the coumty road and those earlier acquired by you for t he project, being the property offered for sale by the Administrator of the Estate of Susie Sampson, deceased, in Case No. 2754 in the Superior Court of the State of Washington for Clallam County, for which you bid on or about April 4, 1940. 1. You will acquire the property as a part of your Elwha River Water Extension Project (as extended I by Ordinance No. 888) and will retain the same in its entirety as a part of the project. 2. The amount to be paid by you for the proJR'lrty shall be the sum of Thirty-two Hundred and Fifty ($5250 .00), plus an amount sufficient to pay for an owner's policy of title insurance in the amount of the purchase price to be issued to you by Glallam Abstract Company. The purchase price will be turned over to you when needed for closing the transaction upon confirmation of sale and issuance of the policy. 5. The amount so advanced by us with interest at the rate of three per cent per annum, shall con- stitute a credit to us, our successors or assigns, payment of said advance, however, to be deferred until the expiration of the present contract, and at that time to be paid in water furnished by the City at a price to be agreed upcn at that time, or to be applied on the first payment or payments due upon any extension or renewal cf the present contract. Please note your acceptance upon one copy of this letter, which is addressed to you in duplicate, and return such copy to us, whereupon the foregoing will constitute an agreement between us to the above effect. Hawkins City Clerk BE IT FURTHER RESOLVED that the Mayor and City CIeri< of the City of fort Angeles, Washington, are hereQy authorized and instructed to do whatever is legally necessary to consumate the transaction or transactions referred to in said oontract to the end that the City of l'ort Angeles shall become the holder of the legal title to the real property referred to in said contract. It was moved by Commissioner Lind that the foregoing resolution be approved and adopted. Seconded by Commissioner Beam. On roll call all members voted aye. The Mayor declared the motion carried. Under the head of reading and passage of ordinances the following ordinance wa s read by title and placed on its third reading and finally adopted. AN ORDINANCE changing the name of that street in the City of Port Angeles, Clallam County, Washington, heretofore known as "Boulevard" to t he new name of "Lauridsen Boulevard'. It was moved by Commissioner Lind that the foregoing ordinance be placed on its final reading and adopted. Seconded by Commissioner Beam. On roll call all members voted aye. The Mayor declared the motion carried. Under the head of Unfinished BJ.siness: The City Clerk was instructed to issue a call for bids for the purchase of approximately 24,000 feet of cast iron pipe forthe Water department. Bids to be received until May 1, 1940. The City Commission reserves the right to reject any and all bids.
