CITY COUNCIL MEETING
Port Angeles, Washington

I CALL TO ORDER
The special meeting was called to order by Mayor Haguewood at 5:00 P.M.
The purpose of this meeting is discussions relating to the Northern Tier
Pipeline Project. ,

Polhamus, Ouast.
Members Absent: None.

TIT MINUTES
Councilman Boardman moved the Council accept and place on file as received
the minutes of the April 15, 1980 negotiating session. The motion was
seconded by Councilman Buck and carried.

V LEGISLATION
1. STGNTNG OF AGREEMENT: ISSUE NO. 2, RECOVERY OF COSTS ,
Prior to any further consideration of this matter, Manager Flodstrom proposed
that, due to the need for additional public input, and in light of recent com-
ments attributed to Gary Smith of Northern Tier Pipeline Company to the Daily
News concerning the City's reduced opposition to the pipeline project, final
approval of this issue will be continued until the May 13th negotiating session.
Bill Sage concurred with this proposal, and pointed out his response letter to
Manager Flodstrom and Attorney Miller in which he apologized for Mr. Smith's
comments. Manager Flodstrom will make both letters regarding Mr. Smith's com-
ments-available to the press.
Attorney Miller, Mr. Sage and the Council then discussed the various utility
services which the City will make available to Northern Tier, and whether the
City has the capability to provide these services, especially fire protection.
Both parties then preliminarily agreed on the following language for Item No.
1, paragraph 4 of the agreement on this issue: "In consideration of this pay-
ment, City and Northern Tier agree to take the necessary legal steps to make
available electrical, water and sewage services to Northern Tier, if certified,
subject to separate negotiated agreements for such utility services, with re-
gard to availability, facilities, rates and levels of service."
Bill Sage then read Northern Tier's proposed Preamble to Agreement on Issue
No. 2, which, in effect, is a restatement of the City's and Northern Tier's
positions on this issue. Northern Tier's contention of "no liability" for ,
the costs incurred by the City in the past for this project was discussed at
length, with both parties preliminarily agreeing on the following language:
"WHEREAS, the City contends it has incurred in the past, and will incur in
the future, certain costs for review and analysis of this application, and
contends that Northern Tier has liability for such costs; and Northern Tier
contends it has no liability for such costs; and The City then pre-
liminarily agreed to the remaining language in the preamble. The discussion
on this item concluded with Manager Flodstrom reiterating that the public will
have an opportunity to speak on this issue at the May 6, 1980 regular Council
meeting.

2. SCHEDULE NEXT NEGOTIATING SESSION: ESTABLISH AGENDA ITEMS
The next negotiating session was scheduled for Tuesday, May 13th at
5:00 P.M. No additional agenda items were requested for discussion
by either Northern Tier or the City.
3. ISSUE NO. 4: LAND USE & IMPACT FEES
' Bill Sage indicated that Northern Tier has nothing more to add in regard to
this issue. Manager Flodstrom and Mr. Sage then discussed the Council and
staff's proposed trips to Valdez, Alaska and Portland, .Maine, which Northern
Tier has agreed to fund. During this discussion Manager Flodstrom indicated
that the City has not yet reached a final agreement on who should go where.
However, it may be more appropriate to send fewer City officials to Portland
than to Valdez since Mr. Clark Neily, Director of Community Development for
Portland will be meeting with City officials in June and will be able to
answer many of the questions the Council and staff may have. The trip .to
Portland is tentatively scheduled first (approximately late May) with a
schedule provided to Northern Tier of the agencies which will be visited.
Manager Flodstrom also proposed that Northern Tier agree to fund other trips
to oilport sites i.e. Galveston, and that no member of Northern Tier accompany
the City officials on these trips and no reports be made to Northern Tier
following the trips. Manager Flodstrom then suggested that any further dis-
cussion on this issue be deferred until after the trips to Valdez and Portland.
Bill Sage concurred, but also expressed the hope that discussions could pro-
ceed on a staff level on various .areas which need more analysis and several
legal matters connected with this issue.
4. ISSUE N0. 3: HOUSING IMPACTS
City Planner Paul Carr read in full the four section of the Housing Agreement
between the City and Northern Tier. Briefly, the proposed agreement covers
' the initiation of a housing inventory survey, the issues which need to be
covered by the survey, the amounts provided by Northern Tier and the City for
the study, and the implementation of a temporary housing plan following the
housing survey. Bill Sage then stated that Northern Tier accepts the language
submitted by the City in the Housing Agreement, with some clarification of
Section 3 which deals with funds provided by Northern Tier (520,000 plus costs
in excess of $23,000). The Council and Mr. Sage also discussed the consultants
which will be used for the housing survey, the need to keep the information
in the survey current, and the "temporary" housing plan which will be developed
(Planner Carr suggested that this plan be re-termed "construction" housing plan
instead of "temporary"). The discussion concluded with Mayor Haguewood noting
that no final decisions will be made on this issue until after additional
public input is received.
5. ISSUE NO. 6: WATER, SEWER AND SOLID WASTE
Final position papers on Issue No. 6, Water, Sewer and Solid Waste Requirements
were discussed at length by Manager Flodstrom, Bill Sage and Ken Berryman.
~• Northern Tier concurred with the language submitted by the City on Sewer and
Solid Waste requirements, but disagreed with the City's proposal of allowing
not more than 3,000 gallons of water per hour .to each berth. Northern Tier's
language did not include an amount per berth, only ."a maximum of 9,000
gallons per hour to the facilities." After a lengthy discussion on this sub-
ject, both parties agreed that additional work needed to be done at the staff
' level in regard to water requirements.
6. ISSUE NO- 7: LOCAL HIRE PREFERENCE
Manager Flodstrom read the City's position on Issue No. 7, Local Hire Preference,
which proposed that Northern Tier Pipeline Company institute a local hire
preference program to help minimize the housing impacts and influx of tran-
sient workers in Port Angeles. Bill Sage then `stated that Northern Tier is
firmly committed to a local hire preference, and are proposing various training
programs for construction and operation of the pipeline facility. Mr. Sage
also cautioned the City against non-compliance with the regulations for hiring
minorities, and suggested additional input on the existing local hiring practices

before proceeding further with this issue. After a brief discussion on
the criteria needed for establishing local preference, and restricting
the outside manpower recruitment efforts, further negotiation on this
issue was deferred until the May 13th session.
7. FIRE PROTECTION
Draft position papers on the issue on Fire Protection were exchanged by
both parties and Ken Berryman briefly outlined Northern Tier's preliminary
position which included a section on local input to fire system design;
impacts on fire insurance rates; and availability of equipment and future
coordination. Mr. Berryman also noted Northern Tier's opening statement
in their draft position paper that "Northern Tier Pipeline Company plans
to provide its own fire protection facilities at the Tanker Unloading
Facilities in Port Angeles Harbor." This statement concurred with the
City's opening statement that "The City of Port Angeles' review of its
fire protection facilities indicated that they are wholly inadequate to
provide any level of fire protection to either the Northern Tier facilities
on Ediz Hook, if constructed, or to vessels which might use those facilities.
Any fire protection facilities and capabilities for use in fighting fire at
the Northern Tier facilities must be provided by Northern Tier itself."
Other subjects discussed on this issue included the fire protection equip-
ment which Northern Tier will provide use of independent consultants in
this matter; the fireboats used in the Seattle area; and fresh water versus
sea water as the water supply source for fire protection.
8. ISSUE N0. 5: OILSPILL CONTINGENCY PLAN
