PROCEEDINGS OF THE CITY COUNCIL OF THE CITY OF PORT ANGELES, WASHINGTON
. May 2, 1972
The Council met in regular session at 7;30 p.m. Officers present were Mayor
Basom, Councilmen Haguewood, Hordyk, Lukey, Ross and Wray, Manager Puddy, At-
torney Moffett and Deputy Clerk Hobbs. Councilman Olson came in later.
A2motion was made by Councilman Hordyk, seconded by Councilman Wray and unani-
_ mously carried to accept and place on file, as receiveq the Minutes of April 18,
1972.
A motion was made by Councilman Hordyk, seconded by Councilwoman Ross and unani-
mously carried to concur with the recommendation of the Assistant Director of I'
Public Works and accept the low bid of Pacific States Cast Iron Pipe Company
_ for 10 ,000 1.f. of 2" cast iron pipe for a total amount of $9,600 plus tax;
and the low bid of H. D. Fowler Company for 15,000 1. f. of 8 TT Asbestos Cement
pipein'th~'amount.of'$2,9,550 plus tax, and fop 5,000 l.f. of 3/4" Copper Type
"K" Pipe in the amount of $2,562.50 plus tax.
A motion was made by Councilman Wr.ay, seconded by Councilman Hordyk and unani-
mously carried to accept the low bid of Airway Striping for the arterial street
striping in the amount of $1,983.00.
A motion was made by Councilman Hordyk, seconded by Councilman Wray and unani-
mously carried to approve for payment Claim Vouchers in the amount of $90,993.44
and Payroll Transfers in amount of $66,121.41.
A motion was made by Councilman Wray, seconded by Councilwoman Ross and unani-
mously carried to approve and pay to J. E. Work, Inc. the seventh (April) es-
.timate of work done and material furnished on L.I.D. #193, in the amount of
$44,000.00.
A motion was made by Councilman Haguewood, seconded by Councilman Wray and
unanimously carried to instruct the City Manager to wyit~ a letter to the
Hot Rod Association endorsing their request and to incorporate the following
statement, as read by Mayor Basom. "We support the concept of a trial hot
rod meet in the Port Angeles area to demonstrate its value to our community.
We encourage all participating, agencies to give it full consideration."

A motion was made by Councilman Wray, seconded by Councilman Lukey and unani-
mously carried to concur with the Planning CommissionTs recommendation and
approve the request of Mr. Alvin Olson, 816 South Race Street, for a variance
to allow enlargement of a pre-existing, non-conforming single family residence
by constructing a roof between the existing house and garage.
_A motion was made by Councilman Hordyk, seconded by Councilwoman Ross and unani-
mously carried to concur with the Planning CommissionTs recommendation and ap-
prove the request of Mr. J. W. Wolfe, 1337 West 5th Street, for a variance to
allow enlargement of a pre-existing, non-conforming, single-family residence
by constructing a double carport addition to the north side of the present house.
- A motion was made by Councilwoman Ross, seconded by Councilman Hordyk and unani-
mously carried to concur with the Planning Commission's recommendation and ap-
prove the request of Mr. John E. Kemp, 1735 West 5th Street, for a variance to
permit construction of an addition to the south side of a pEe-existing, non-
conforming single-family residence.

A motion was made by Councilman Hordyk, seconded by Councilwoman Ross and unani-
mously carried to concur with the Planning Commission's recommendation and ap-
prove the proposed location for the planned log scaling station on Tumwater
Access Road at approximately 3rd to 6th Streets.
A motion was made by Councilman Hordyk, seconded by Councilman Wray and unani- I
mously carried to accept and place on file the Planning Commission Minutes of
April 24, 1972. .
After considerable discussion on Mr. Peter Sedlar's request for relief from
the $3.00 per month sewer charge, it was decided that Mr. Sedlar would have to
pay the sewer charge as long as he was within 300 feet of a sewer line and he
could connect to the sewer line by using a pump.
A motion was made by Councilman Hordyk, seconded py Councilwoman Ross and unani-
mously carried to take from the table the request of Mr. Thomas P. Hodges per-
taining to the sewer charge. It was decided, as above for Mr. Sedlar, that the
charge should be paid for property within 300 feet of a sewer line.

,A motion was made by Councilwoman Ross, seconded by Councilman Hordyk and
unanimously carried to take from the table the request of Mr. Richard J.
Niichel for City water service to his property outside the city limits.

A motion was made by Councilman Lukey, seconded by Councilman Hordyk and
unanimously carried to deny Mr. Niichel's request for water as stated in
the following statement read by Mayor Basom: '~e appreciate the clear, con-
cise nnd forthright manner in which Mr. Niichel has presented his proposal.
~Mr. Niichel's property is not contiguous to our city boundary. It is sepa-
-rated by a substantial distance both horizontally and vertically. We must
reaffirm our, policy position of preserving the capacity of our utilities to
-serve our residents and tax taxpayers without unreasonably increasing our
financial burden for additional supply. Therefore, we believe that the best
interest of our community will,be served by our denying Mr. Niichel's appli-
cation. II
A motion was made by Councilman Lukey, seconded by Councilwoman Ross and unani-
mously carried to accept the recommendation of the City Attorney and notify
the authorities involved of this opinion in regards to the City's liability
in the landslide area behind the Port Angeles Post Office. The following is
~he City Attorney Opinion as taken from his letter of April 26, 1972:
"Contrary to the views expressed in the chronologically more demanding
and self-confident manner of the various reports and letters from Federal
officials, it is my opinion that the City has absolutely no legal or moral
duty to correct this situation which has been brought on by the owners of
the injured property; their predecessors in interest; or it has been
brought about by the natural phenomenon which causes the faces of sharply
defined earth banks to waste away in the presence of inordinate amounts
of rainfall or other moisture...."
No action was taken on the letter from the Mayor of the City of Seattle reo
Revenue Sharing as the City of Port Angeles has passed a resolution favoring
- this in the past.

The City Manager was instructed to set up a joint meeting with the County in
regards to the Solid Waste Management Plan.
A motion was made by Councilwoman Ross, seconded by Councilman Lukey and unani-
mously carried to approve the hanging of a banner behind the fountain on 1st
and Laurel and to deiegate the responsibility of granting permission for hang4ng
banners to the City Manager. Banner is for National Hospital Week, May 7-13, 1972.
The community development training workshop in Community Betterment Through
Use of Federak Resources for Local Governments to be held on May 18 & 19 at
the SeaTac~ilton Inn in Seattle was mentioned, and City Manager to attend
along with any of the Council that can get away.
The letter from the Association of Washington Cities regarding the report
of Washington State Liquor Control Board and Initiative #261 was read and
discussed.
A motion was made by Councilman Wray, seconded by Councilman Hordyk and unani-
mously carried to approve the request of Michael E. Grooms for water to his
property in Block #7, Croft's Addition on the condition that he enter into
an agreement with the City to annex to the City on request of the City.
A motion was made by Councilman Wray, seconded by Councilwoman Ross and unani-
mously carried to approve the sale of and offer ,at public auction the follow-
I ing lots: Lots 1 & 2 Block 245 Townsite 1402 - 06 West 7th St.
Lots 5 & 6 Block 245 Townsite 1418 - 22 West 7th St.
Lots 9 & 10 Block 245 Townsite 1434 - 38 West 7th St.
Minimum price per lot to be $2,000, bid price will include L.1.D. assessment.
A motmon was made by Councilwoman Ross, seconded by Councilman Haguewood and
unanimously carried to refer to the Police Chief for recommendation the request
of Peninsula Plywood Corporation regarding the traffic situation of Marine Drive,
in the area of the Peninsula Plywood Plant.
A resolution from the American Public Works Association thanking the City of
Port Angeles, in making their Spring Conference the success it was.on April
5, 6, and 7th, was read in full.

A motion was made by Councilman Hordyk, seconded by Councilwoman Ross and
unanimously carried to approve the proclamation as read by Mayor Basom, pro-
claiming the week of May 8th as Clean-up - Paint-up - Fix-up Week.
A motion was made by Councilman Wray, seconded by Councilwoman Ross and unani-
mously carried to approve the proclamation as read by Mayor Basom proclaiming
the week of May 14th as National Transportation Week and Friday, May 19th as
National Defense Transportation Day.
Amotion was made by Councilman Lukey, seconded by Councilman Wray and unani-
mously carried to accept and place on file the Clallam Jefferson County Com- I
munity Action Council Minutes of April 19, 1972; and the out-of-town reports
by the Personnel Direc~or, Fire Chief, and Light Dept. delegates to the con-
ference in Portland, Oregon.

A motion was made by Councilwoman Ross, seconded by Councilman Lukey and unani-
mously carried to authorize Councilman Hordyk to attend the Northwest Public
Power Association meeting in Richland on May 17, 18, & 19th.
A motion was made by Councilman Hordyk, seconded by Councilman Haguewood and
unanimously carried to grant a ten day extension to Machinery Liquidators Co.
on their blasting permit and authorizing the City Manager to cancel the per-
mit if he felt it warranted due to weather conditions. Permit extended to
May 12, 1972.

A motion was made by Councilman Hordyk, seconded by Councilwoman Ross and
unanimously carried to refer to a work session with the City Attorney the
CATV franchise renewal. Work session to be Tuesday, May 9, 1972 at 7:30 p.m.
The City Manager was authorized to negotiate with the Port of Port Angeles on
the property they require for their proposed truck scaling station, and bring
recommendation back to the Council.
A motion was made by Councilman Wray, seconded by Councilman Olson and unani-
mously carried to approve the Liquor License Application of David Jenkins and
Amy Gail Jenkins - Mt. Angeles Grocery for a Type E & F Liquor License. I
A motion was made by Councilman Hordyk, seconded by Councilman Olson and unani-
mously carried to approve call for bids for codification of the City Ordinances,
to bring them up to date.
The following resolution was read in full:

A RESOLUTION amending Resolution No. 11-69
with reference to accumulated sick leave.

A motion was made by Councilman Hordyk, seconded by Councilwoman Ross and unani-
mously carried to adopt the foregoing resolution as read.
Other subjects of discussion were: The hours that City Dump is opened should be
published again, (large fine for dumping along roadway when dump is closed);
Large pipe sticking up about l' at corner of Park & Laurel; Gas Company closure'
Lions Club planning to develop park on Whidby Avenue, will start very soon; ,
Association of Washington Cities Convention in June; Alexander & Company Anal-
ysis of Downtown Port Angeles report presented to Council and Survey above the
Boulevard behind schedule.
