CALL TO ORDER
Special meeting was called to order by Mayor Basom at 6:50 P.M.

Reconsideration of bids submitted April 21, 1975 on Peabody Heights
L. 1. D. No. 198
At the April 22, 1975 special meeting of the Port Angeles City Council,
the construction bid on L.I.D. No. 198 was awarded to J.D. Shotwell Co.,
the second lowest bidder at a firm price of $1,553,497.88. This decision
was contested in court by Del Guzzi Construction Company, the low bidder
at $1,541,019.08 but with a letter of escalation on oil prices. Kitsap
County Superior Court Judge Terence Hanley ruled that those bids which
did not include a letter of escalation were not responsive to the City's
bid call and therefore the City could not enter into a contract with
any contractors who did not submit a letter of escalation. As DelGuzzi
was the only bidder to submit a letter of escalation, he was the only
responsive bidder.
After briefly relating these facts, Mayor Basom read a short letter from
J. D. Shotwell wherein he urged the City Council to award the bid to
Del Guzzi Construction as Del Guzzi had agreed to award the asphalt items
in the project to J.D. Shotwell Company and in turn, Shotwell would
refrain from bringing suit against the City. After a brief discussion, the
City Council requested Mr. Del Guzzi and Mr. Shotwell to add and sign an
amendment to the original letter, "J .D. Shotwell Co. and Del Guzzi
Construction, Inc. guarantees there will be no escalation in the price of
oil and accordingly the DelGuzzi Construction, Inc. bid is a firm bid."
It was moved by Councilman Haguewood and seconded by Councilman Lukey to
award the bid for L.I. D. No. 198 to the low bidder, DelGuzzi Construction
Inc. at a firm bid price of $1,541,019.08. Councilman Haguewood then
commented that by accepting the low bid, four to six weeks would be saved
in getting the project started and if it were rebid there is no way of
assuring that the bids will not be higher. Councilman Lukey explained to
the audience that the City Council was considering the OelGuzzi bid because
it was now a firm bid and it is approximately 8% below the engineer's
estimate. Councilman Hordyk stated he favored the motion because the time
element is of utmost importance and the bid is within 10% of the engineer's
estimate. Upon the call for. the question, the amended motion to award
the bid for L.r.D. No. 198 to the low firm bidder, the Del Guzzi Construction
Co. at a bid price of $1,541,019.08 with the J.D. Shotwell Company as
subcontractor for the asphalt portion of the project was unanimously
passed by the City Council.
