Roll call showed the following officers present: Mayor Beetle, Commissioners Beam and Lind, Acting Attorney Taylor and Clerk Hawkins. The minutes of t he previous session were read and approved. Police Judge, W. F. Phillips reported 75 cases tried and $1,023.00 'collected in fines for the month of April, 1942. Report ordered filed. Under the head of Applicationa for Building Permits the following were granted: Max Stockinger, Build Garage, Lot 17, Block 65, P.S.C.C. Subd. of Sub. Lot 25 Mrs. George Proehmer,. remodel building, Lot 16, Block 15, Towns i te Calvary Penacostal Church, alter building, Lot 1 and 2, Bleck 195, Townsite 75.00 200.00 100 .00 Under the head of Unfinished Business: NOTICE OF HEARING NOTICE IS HEREBY GIVEN That a petition praying for the vacation of tha t portion pf the alley running through Block Sixty-nine (69) of the Townsite of Port Angeles from the West lines of Lots 17 and 2 in said block easterly to Lincoln Street and that Wednesday, the 6th day of May, 1942, at the hour of ten o'clock, a.m., before the City CommiSSion, in the room where said Commission meets in the Fire Hall on Second and Lincoln Streets in said city, has been fixed for the time and place for the hearing of said petition. Dated this 15th day of ~pril, 1942. N. M. AFFIDAVIT OF POSTING STATE OF WASHINGTON ss. COUNTY OF C1ALLAM Paul T. Poulsen, being first duly sworn, deposes and says that he is of full age, a resident of Port Angeles, Clallam County, State of Washington, and a citizen of the United States and of the Stete of Weshington; that on the 16th day of April, 1942, he posted four true and complete copies of the original notice of hearing on petition to vacate that portion of the alley described in the notice of hearing , hereto attached; One copy was posted at the front door of the Court House in Clallam County, Washington; one at the front door of the City Building at 140 West Front Street, Port Angeles; one on the bulletin board at the Port Angeles Evening News; also one at a conspicuous place on the alley abutting Lot 1, Block 69, Port Angeles, Washington, a portion of which is sought to be vacated in the petition in the above entitled matter. On request of Attorney Severyns, representing the petitioners, it was moved by Commissioner Lind that the hearing be continued to May 15, 1942, at 10 A.M. Seconded by Mayor Beetle. 'On roll call all members voted aye. The Mayor declared the motion carried. Under the head of Introduction of Resolutions the following resolution was introduced: RESOLUTION WHEREAS, The City of Port Angeles is the owner of the following descri1.:e d real property, having acquired the same by Treasurer's deed dated May 6, 1942, under and by virtue of the authority of Section 9593 of Remington's Itevised Statutes, Chapter 145 of the Laws of 1929, page 565, to-wit: All of Blocke, Four Hundred Four (404), Four Hundred Five (405), and Four Hundred and Thirty-eight (438) of the Townsite of Port Angeles, Washington, and WHEREAS, Angeles Gravel and .supply 'Company has offered to purchase from the City of Port Angeles the above described real property for the sum of $1,000.00, payable as follows: $250.00 as a down payment and $62.50 on or before the 1st day of June, 1942, and $62.50 on or before the 1st day of each and every month thereafter until paid in full, together with interest at the rate of 7% per annum, computed on m~nthly balances due and paid with the monthly installment, and WHEREAS, The City Commission has viewed the said property and is of the opinion that the offer is fair value and at this time it is to the best interest of the City that at should be accepted and the sale made~ NOW, THEREFOP~, BE IT RESOLVED, That said offer be accepted and that the City of Port Angeles sell the said property at private sale to the said Angeles Gravel and ~upply Company for the sum hereinabove set forth, subject to any other valid liens against the same; that the City Attorney be instructed to prepare a quit claim deed, conveying said property to the purchaser, and that the City Clerk of the City of Port Angeles be and he is hereby instructed to execute said quit claim deed, and that the Mayor of the tity of Port Angeles be and he is hereby instructed to countersign said quit claim deed when the purchase price and all accrued interest thereon has been paid in full. It was moved by CommisslOner Beam that the foregoing resolution be ap,lroved and adopted. Seconded by Commissioner Lind. On roll call all members voted aye.
