CITY COUNCIL SPECIAL MEETING

I CALL TO ORDER
Mayor Duncan called the special meeting of the Council to order at 6:04 PM.
This meeting is a continuation of the special meeting called Juen 28, 1983
to consider standards and operating conditions for miscellaneous types of
temporary or mobile commercial vendors operating in or along th~ public
way.
II ROLL CALL
Members Present: Mayor Duncan, Councilmen Gerberding, Hordyk, Polhamus,
Quast and Whidden.
Members Absent: Councilman Haguewood.
Staff Present: Manager Flodstrom, Attorney Miller, L. Cosens, J. Pittis,
G. Booth, D. Wolfe, D. VanHemert.
Public Present: J. Fairchild, B. Love, D. Sinnes.

1. Sidewalk Obstruction Permit - Lower Elwha Summer Youth Employment
Program and Conditional Use Permit - Morgan/ Sinnes
Mayor Duncan reviewed the discussion occurring at the June 28, 1983 meeting
at which Council specifically considered the Lower Elwha Tribe's application
for a sidewalk obstruction permit to operate pushcarts in Downtown Port
Angeles, and the Morgan/Sinnes application for a Conditional Use Permit to
operate a retail food stand on Railroad Avenue; and generally, standards
and conditions for temporary or mobile commercial vendors operating in or
along the public way. Council further discussed the Lower Elwha Tribe's
proposed operation and Mayor Duncan then opened the matter for public com-
ment. Jean Fairchild and Bob Love, downtown merchants, opposed a prolifera-
tion of this type of activity along the waterfront and Downtown Port
Angeles and called for orderly development of the area. Dan Sinnes, appli-
cant for the Conditional Use Permit to operate a retail stand on Railroad
Avenue, supported his proposal for locating a retail stand on undeveloped
property along Railroad Avenue. Councilman Whidden noted he supported per-
manent store front businesses and after further discussion moved the
Council deny the Morgan/Sinnes application to operate a retail food stand
at 131 East Railroad Avenue. Councilman Hordyk seconded and noted the
wishes of the citizenry of Port Angeles to beautify the waterfront and
Downtown. Councilman Polhamus objected to a Council change of policy in
mid-application for the Conditional Use Permit when permits have previously
been issued this year. After further Council discussion the motion was
called, with Councilmen Whidden and Hordyk voting "Aye" and Councilmen
Polhamus and Gerberding voting "No". Councilman Quast abstained. Mayor
Duncan, voting to break the tie, voted in opposition to the motion, thus
approving the Morgan/Sinnes application for a Conditional Use Permit.
Mayor Duncan noted the applicants had applied in good faith in accordance
with current City rules and regulations and though the rules are now
subject to change, it would be unfair to deny the permit this far into the
application stage.
Councilman Gerberding then moved the Council approve the Morgan/Sinnes
application for a retail food stand at 131 East Railroad Avenue per the
Planning Commission recommendations and conditions, subject to two condi-
tions: that (l) the applicant provide litter control in the immediate
vicinity of the stand and (2) final design of the stand be subject to ap-
proval of the Planning Department. Councilman Polhamus seconded. On call
for the question the motion carried with councilman Hordyk voting "No".

Councilman Gerberding then moved the Council deny the Lower Elwha Tribe
application for a Sidewalk Obstruction Permit to operate pushcarts in
Downtown Port Angeles. Councilman Hordyk seconded and after further
discussion the motion carried.
Councilman Gerberding then moved Council instruct staff to develop standards
and operating conditions for miscellaneous types of temporary or mobile
commercial uses operating in or along the public ways, and declare a mora-
torium on permitting such activity pending Council approval of such guide- 1-
lines and conditions. Councilman Hordyk seconded and the motion carried.
VIII ADJOURNMENT
Mayor Duncan adjourned the meeting at 6:50 PM.
