HomeMy WebLinkAboutMinutes 07/14/1972 28D PROCEEDINGS OF THE CITY COUNCIL OF THE CITY OF PORT ANGELES, WASH. July 14, 1972 The Council met in Special Session at 5:00 P.M. Officers present were Mayor Basom, Councilmen Haguewood, Hordyk, Lukey, Olson, Ross and ~'ay; Manager Puddy Attorney Moffett and Clerk McNeece. The purpose of this meeting was to give the Council the opportunity to re- consider the decision they made at the Council Meeting of July 5, concerning repairs of the street and railroad at the Crown Zellerbach mill, on the street leading to Ediz Hook. I Since the time of the decision, laws governing safety hazards of which the Council were not aware, had been learned about. The City Attorney explained that the safety aspect 0f.operating the railroad in this condition was in- volved with the Federal Occupational Safety Hazard Act. This is an Act where- in Congress has decided there were too many industrial accidents and made pro- vision for issueing citations and levying fines on employers who violate the safety standards set up by the Act. The City Attorney pointed out that if an inspection were made and a safety hazard were found to exist, and if the City had in effect said don't correct it until a certain date, the City could be exposing itself to the liability for reimbursing someone who is fined for having not repaired the hazard which exists. A letter from the Vice-President of the Chicago-Milwaukee Railroad was read agreeing to postpone the repairs with the understanding that lithe City shall -be exclusively liable for any claims arising out of the present conditions of this crossing". Mr. A. -B. Westerfield, Foreman in charge of maintenance and repair for the Milwaukee R R, explained that the street would be open to one-way traffic at all times during the construction and most of the time two-way. He stressed 'the need for the repairs at this time. I Mr. Donald Nadig, Manager of the Crown Zellerbach Mill, told of accidents which may have occurred due to the condition of the crossing. After further discussion, a motion was made by Councilman Hordyk and.seconded by Council~an Olson that the Council rescin~ their actio~ taken at the pr:vious meeting1'h~prove Milwaukee R R to go ahead wlth constructlOn at thlS crosslDg as scheduled. Councilmen Hordyk, Olson and Wray voted IIAye" and Councilwoman Ross and Councilmen Haguewood and Lukey voted "No". Mayor Basom voted in favor of the construction, breaking the tie vote.
