II ROLL CALL I Members Present: Mayor Duncan, Councilmen Gerberding, Haguewood, Hordyk, Polhamus, Quast, Whidden. Members Absent: None. Staff Present: Manager Flodstrom, Attorney Knutson, Deputy Clerk Anderson, P. Carr, M. Cleland, L. Glenn, J. Pittis, R. Orton, B. Myers. pubiic Present: J. Miller, Sr., J. Miller, III, D. Miller, G. Dickinson, L. Lee, J. Noonan, L. Crumpacker, P. Cofer, S. Fahnestock, L. Ross, K, Schermer, J. Bost. III MINUTES Councilman Gerberding moved the Council accept and received the minutes of the August 2, 1983 meeting. seconded, and the motion carried. place on file as Councilman Whidden IV CONSENT AGENDA Councilman Polhamus moved the Council accept the items listed under the Consent Agenda, including (l) Correspondencence from Washington State Liquor Control Board, including application for Special Occasion at Elks .I~ Naval Lodge; (2) Vouchers of $167,806.88. Councilman Hordyk seconded and the motion carried. V FINANCE Councilman Gerberding moved to authorize payment to Peninsula Landscaping and United Western Construction Company for Downtown Phase II in the amount of $4,064.25. Councilman Quast seconded and the motion carried. Councilman Quast moved to authorize payment to Tyee Construction for the street light retrofit in the amount of $4,524.04. Councilman Whidden seconded and the motion carried. Councilman Quast moved to authorize payment to Riddell, Williams for Utility Defense Group representation, in the amount of $4,982.16, with Councilman Whidden seconding. Councilman Quast then amended the motion: payment to be mailed upon the City's receipt of a written response to a letter from the City Attorney voicing the Council's questions and concerns. Councilman Polhamus seconded the motion. On call for the question, the amended motion carried. VI ITEMS FROM THE AUDIENCE TO BE PLACED ON THE AGENDA Bob Levin of the Economic Development Council reported that a Class "H" liquor license has been issued to Marino's Restaurant. He also reported on I. a letter he received August 11, 1983 from a development group interested in developing a facility in Port Angeles. Councilman Quast moved to authorize the extension of the time limit for the convention center development project until September 6th, noting that.a portion of the original hotel/motel tax funds may be committed to other projects, and suggested a joint meeting of the Convention Committee and development group in the interim to prepare a recommendation for the September 6th Council meeting. Councilman Gerberding seconded and the motion carried. I 'I I CITY COUNCIL MEETING August 16, 1983 Louise Colby addressed the Council. She recorrunended adoption of the blanket speed limit ordinance. She also mentioned establishing crosswalks and voiced concern over "Yield" signs. ITEMS FROM THE CITY COUNCIL TO BE PLACED ON THE AGENDA None. VII LEGISLATION 1. Presentation of Certificate of Appreciation to Lt. Bill Myers Mayor Duncan presented a plaque to Lt. Myers for outstanding service and contributions to the greater Port Angeles area for reorganizing the emergency radio communications system. Manager Flodstrom corrunended Bill and the Police and Fire Departments for their dedication, stating that their efforts have saved the City between $80,000 and $100,000. 2. Planning Commission Minutes of August 10, 1983 a. Conditional Use Permit - Noonan Application was for extension of a Conditional Use Permit to operate a day nursery as a Home Occupation located at 217 West Tenth Street. Councilman Hordyk moved to concur with the Planning Commission's recommendation to grant the extension for two years, subject to the original conditions. Councilman Whidden seconded and the motion caxrried. b. Shoreline Management Hearing - Port Angeles Waterfront Associates Port Angeles Waterfront Associates has applied for a substantial development permit for a mixed use conunercial complex - restaurant, office retail complex, located on the Port Angeles waterfront between Lincoln and Laurel Streets. For the sake of discussion, Councilman Hordyk moved to concur with the Planning Commission's recommendation to grant the permit subject to the following conditions: (1) The public access boardwalk, vista areas and riprap be provided and connect with the existing sidewalk and City Pier generally as submitted and described by the applicants; (2) the proposed buildings not exceed 35 feet in height, have a general north-south orienta- tion, and be evocative of buildings traditionally found on the Port Angeles waterfront; (3) any excavated materials be disposed of in an upland site approved by the City; (4) a final site plan be submitted to the City for review by appropriate City departments to assure compliance with applicable regulations and the conditions of approval, and to assure a design that is compatible with the City Pier, provision of public access, maximizes views with regard to trees, vista and park landscaping areas on the east and northeast sides, and general consistency with the proposal presented during the public hearing. He cited the following findings of fact: (A) The proposal substantially complies with the Clallam County Shoreline Master Program; specifically Regulations C.2 - C.7, D.l.b, D.2, D.4.a, D.6, E.l.a, F.l.a, F.1.b, F.9, F.17 and F.19.a; (B) the proposal substantially complies with the Shoreline Management Act, specifically: (1) Compliance with C.l, C.4, C.5, D.l.b, F.l.a, F.l.b, F.9.3, F.17.a, F.17.b, F.19.a, recognizes and protects the statewide interest; (2) compliance with C.l, C.4, C.5, C.7, D.1.b, F.9.a, F.9.d, F.9.3, and F.17.a preserves the natural character of the shoreline in the Urban Environment; (3) compliance with C.2, C.4, C.6 and F.l.c will result in long-term over short-term benefit for the shorelines in Port Angeles Harbor and for the City of Port Angeles; (4) compliance with Regulations C.4, C.5, C.6, D.1.b, D.6, E.1.a, F.1.b, F.9.a, F.9.b, F.9.e, F.17.b, F.17.c protects the resources and ecology of the shoreline; (5) construction of the riprap and boardwalk as presented would comply with F.9.c and increase access to publicly owned shorelines; (6) compliance with C.!, C.3; C.6, D.2, D.4.a, F.I.a, F.l.c, F.l.d, F.17.a, F.17.c and F.19.a would increase recreational opportunities for the public in the shoreline; (C) the proposal complies with the Comprehensive Plan and Zoning Ordinance; (D) the proposal complies with the Urban Waterfront Trail Plan. Councilman Whidden seconded. Councilman Hordyk questioned the location of the proposed boardwalk and the accessibility to the public. Pat Downie of Port Angeles Waterfront Asso- ciates informed Council that there will be 24-hour public accessibility. 27- 28. CITY COUNCIL MINUTES August 16, 1983 Councilman Polhamus commended the Waterfront Associates for their efforts. Council q~estioned staff and applicants in regard to a proposed bridge, par~ing',. excavation, and site preparation. On call for the question, the motion carried with Councilman Haguewood abstaining. City Attorney Knutson stated that the current site plan satisfies the stipulation that buildings be similar to those found traditionally on the Port Angeles waterfront and that the final plan should be similar to the one already proposed. J~m Going commented on the pleasant reception he and the project have received from all who have been involved. He stated. that 1- this is a fun community to corne to. c. Final Plat Hearing - Miller Council considered the request for approval of the final plat of the Uplands 4A, consisting of seven lots on approximately 1.5 acres, located on the north side of Melody Lane and west of Golf Course Road. Councilman Hordyk moved to concur with the Planning Commission recommendation to approve the final plat because it complies with the preliminary plat. Councilman Whidden seconded. Councilman Quast questioned staff on whether the sewer was private or city, and on the difficult accessibility to the sewer system for maintenance. Jack Miller then addressed the Council. He stated that the sewer is the City 's, and explained his request for approval. After considerable discussion and on call for the question, the motion carried. Councilman Quast made a second motion to declare that the sewers in the Upland Project as they were designed in 1973 and 1976 by the City be a part of the City sewer system, and the City's responsibility to maintain, whether or not there be an easement. On call for the question, the motion carried. d. Rezone Hearing - City Planning Commission - Public Hearing set The City Planning Commission has recommended the rezone from RS-7 (Single- Family Residential), to DC (Office Commercial) of an approximate 7-block I area surrounding Olympic Memorial Hospital, generally bounded by Francis Street on the west, the Georgiana/Front Street alley on the south, Jones Street on the east, Caroline Street between Jones and Chambers on the north, and Chambers on the east, north of Caroline. Councilman Whidden moved to set September 6, 1983 as the date for public hearing on the request. Councilman Quast seconded and the motion carried. Councilman Gerberding moved to remove the proposed Home Occupations Ordinance amendments from the table, with Councilman Quast seconding. The motion carried. ~. _ ~ouncilman Gerberding then moved to concur with the recommendations to ~~ ~ aadopt the amendments with changes in the wording of Section 7, Development ~~~ Standards, and Section 7-G. Councilman Whidden seconded. After consider- able discussion, and with suggested changes in wording, on call for the question, the motion carried, with Councilman Polhamus voting "No". Councilman Whidden moved to minutes of August 10, 1983. carried. adopt and place on file the Planning Commission Councilman Gerberding seconded and the motion 3. Public Hearing - Street/Alley vacation - Solledar, et al Mayor Duncan read the Ordinance by title, entitled ORDINANCE NO. AN ORDINANCE of the City of Port Angeles vacating the alley between Spruce and Hazel Streets in Block 9, all of Hazel Street between Blocks 9 and 10, all of the alley between Hazel and Madrona Streets in Block 10, all of Madrona Street between Blocks 10 and 15, and the alley between Madrona and Glenwood Streets in Block 15, all in the Pennsylvania Park Addition to the Townsite of Port Angeles. Mayor,Duncan'then opened the public hearing and asked for comments. There were no comments from the public. The public hearing was closed. I Councilman Hordyk moved to adopt the Ordinance. as. .read by title, with Councilman Polhamus seconding. After considerable discussion, on call for the question, the motion failed, with Councilmen Gerberding, Hordyk, Quast and Whidden voting "No" and Councilmen Haguewood and Polhamus voting "Aye". 6. Animal Trapping - Report Manager Flodstrom informed Council that representatives of the State Trapper's Association would like to meet with the City's Animal Control Officer and other concerned individuals to establish policies and regula- tions on trapping within the City. These rules would then be presented to the Council for approval. Councilman Quast moved to authorize the request, and with Councilman Whidden seconding, the motion carried. 7. Port Angeles Telecable Franchise Renewal Councilman Gerberding moved to instruct the Finance Director to initiate the agreement. Councilman Quast seconded, suggesting some additions to the wording of the agreement, requesting a. 24-hour, answering device to be monitored for repair service, and requesting that the City have some access for public service announcements. Councilman Gerberding moved to instruct the Finance Director to initiat.e. the agreement. with wording suggested by Councilman Quast. August 16, 1983 9. Request Approval - Jack Lawson's Travel Expense - Harbor Study Councilman Quast moved to approve payment of $500 travel expense to Mr. Lawson. Councilman Whidden seconded and the motion carried. 10. Street Closure - Kiwanis Derby Days Salmon Bake Mayor Duncan reviewed the request. Councilman Whidden moved to grant the request, and with Councilman Quast seconding, the motion carried. 11. Speed Limit Ordinance Memo I This item was informational.. The Ordinance will be presented September 6, 1983. Public Works Director pittis addressed the Council on the need for revisions in the City's speed limits and explained proposed changes. Council discussed the proposed revisions at length. Councilman Gerberding commended Public Works Director Pittis for the effort put forth in compiling the necessary information. 12. OPTA - Draft of Advertisement in 1984 Directory Mayor Duncan presented a draft of the City'.s advertisement in the 1984 OPTA Directory. Council decided that the ad was unacceptable, stating that it does not contain the City logo, "Where the mountains greet the sea." and reiterating that points of interest should be activities within the City. Councilman Whidden, Councilman Gerberding and other volunteers will meet to make necessary revisions and report back to the Council. The deadline for the project is approximately October 1, 1983. 13. Waterfront. Vandalism Prevention Program Councilman Quast described the extensive damage due to increased vandalism at the City Pier. He also mentioned that the Canadian flag at the Pier is worn and needs to be replaced, and that broken light fixtures need replac- ing. After discussion, Councilman Quast moved to hire reserve Police ,- officers, wearing Port Angeles blue windbreakers bearing the City logo, to patrol the City Pier. Councilman Polhamus seconded and the motion carried. 14. Utility Advisory Committee Meeting Set Upon request of Finance Director Orton, the Council set a meeting of the Utility Advisory Committee to discuss the City's credit policy and future deregulation of cable television. The meeting is scheduled for Tuesday, August 23, 1983 at 3:00 PM, in the City Light conference room. 15. Real Estate Committee Report - Behrhorst Property Councilman Quast announced that after two months.of negotiations, the City has entered into an earnest money agreement for the purchase of three par- cels of property from attorney Rex Behrhorst, legally described as Lots 1, 2 and 3, Block 170, Townsite of Port Angeles. The property is located at Fourth and Peabody Streets and adjoins the Vern Burton Memorial Community Center property. The City will assume the mortgage against Lot 3 with monthly payments of $165. Finance Director Orton then presented several financing options for Lots 1 and 2. After considerable debate regarding the various options, Councilman Quast moved to acquire financing through Sea-First Bank at 9~% interest. Councilman Polhamus seconded and the motion carried with Councilmen Hordyk and Haguewood voting "No". VIII LATE ITEMS Manager Flodstrom and the Council set a special meeting for August 30, 1983 at 7:00 P.M. in the City Hall Council Chambers to discuss 1984 Goals and Objectives and to meet with development representatives to discuss the facility proposal. I Manager Flodstrom presented the Council with samples of new stationery bearing the City logo, to be purchased as present supplies run out. I I I CITY COUNCIL MEETING August 16, 1983 IX ITEMS FROM THE AUDIENCE/CITY COUNCIL NOT ON THE AGENDA Lorraine Ross addressed the Council, suggesting a bypass on Fifth Street to intersect Golf Course Road. Councilman Gerberding mentioned that the flag over City Hall needs replac- ing. Councilman Hordyk suggested ordering flags in quantity at a reduced price. Mayor Duncan presented the completed Port Angeles Chamber of Commerce brochure for all to see. The Mayor also displayed new Derby Days brochures which will be on sale at various locations for $1 each. The Council and staff then discussed the following: The pine Hill slide; Old Mill Road (seal coating); worn Downtown banners; offering RV campsites for one night at Lincoln Park in appreciation to the Fair Toll Coalition; replacing the pump in the City fountain; the Hood Canal Bridge closure: a possible convention in Port Angeles in 1987, bringing approximately 400 people to the City; the recent baseball tournament held in Port Angeles, in which the City's team participated.
