The Commission met in regular session at 10 :00 A.M., and was called to order Qy Mayor Feeley. Officers present were: Mayor Feeley, Commissioners Robinson and Taylor, Attorney Trumbull and Clerk Law. Minutes of the previous session were read and approved. Motion Commissioner Taylor questioned the Attorney regarding necessity of publishing call for bids for oil to be used on Ediz Hook road. The Attorney informed that the Cit;r having called for bids for the project, which were rejected, no bids are necessary for oil, and the City may proceed with the construction. IMayOr Feeley announced that the term of Elizabeth Burt, Park Board member, will expire August 31st. The Mayor then announced the re-appointment of Mrs. Burt for a three-year tenn which was approved by the Commission. I'The Commission discussed petitions filed and proclamation fixing date of special election to decide for or against Council-Manager plan of City Government. The Attorney was instructed to ascertain what will be Iproper procedure and election date to be fixed. , ,Under the head of new business, the report of Police Judge Phillips for the month of June, showing $1,434.50: : fines collected, was approved and ordered filed. "Commissioner Taylor requested that,the Commission consider a sewer service charge and favor the same, ,thereby divorcing sewer maintenance from the Street Department and permit a better job on streets. Mayor 1 Feeley suggested letting the citizens petition for service charge. Commissioner Robinson a. dvised that the Commission will get together on proposed budgets submitted , and see what can be done. ,Earl Davidson requested the t the Commission fix minimwn price for which Lots 17 and 18 in Block 396 should Ibe sold and recommended e300.oo as minimum. It was moved by Mayor Feele,r that the recommendation be accepted and lots advertised. Seconded by Commissioner Robinson. All voted Aye. I'lotion carried. I Under the head of introduction of resolutions, the following was introduced: RESOLUTION I WHEREAS , 'K. O. ERICKSON has filed his petition with the City Commission of ' the City of Port Angeles, I'requesting the vacation of certain Streets in the United States Government Townsite of Port Angeles, to-wit: "R" Street from Eighteenth (18th) Street to the Southwest corner of Block No. 171; "Q" Street from Eighteenth (18th) Street to the Railroad right-of-way; and Twenty-Second (22) Street from the Railroad right-of-way west to the west City limits; and ' I ,mEREAS, a time and place should be fixed and a hearing had upon said petition, and notice thereof given in Ithe manner provided by law; now, therefore BE,IT RESOLVED BY THE CITY COMVllSSION OF THE CITY OF POllT ANGELES that Monday, the 10th day of September, j 1951, at the hour of 10:00 o'clock, A./1. at the regular meeting of the Commission of said,Cit;r on said date, at, the Commission Room of said City at 215 South Lincoln Street in said City be, and,are hereby fixed as the date, time and place of the hearing on said petition, and the City Clerk of .said City is hereby directed to ) give notice of said hearing by posting written or printed notices thereof in three of the most public places in said City and a like notice in a conspicuous place on the streets and alleys sought to be vacated which notice shall be in the form and manner and posted as provided by law. It was moved by Commissioner Robinson that the foregoing resolution be approved and adopted. Seconded'by Mayor Feele,r. All voted Aye. Motion carried. I NOTICE IS HEREBY GIVEN that a petihon has been filed to vacate the following streets in the United States Government Townsite of the City of Port Angeles, Clallam County, Washington, to-wit: , . I "R" Street from Eighteenth (18th) Street to the South'.-est corner of Block No. 171; "Q" Street from Eighteenth I' (18th) Street to the Railroad right-of-way; and Twenty-Second (22) Street from the Railroad right-of-way west to the west City limits. I Under the head of introduction and reading of Ordinances, the following were introduced and placed on first ~and second reading: I ORDINANCE 110. l;3:il fAn Ordinance of the City of Fort Angeles, providing for the improvement of Twelfth Street in the City of ~Port Angeles, by excavating, grading, ballasting and surfacing with asphaltic concrete certain portions lthereof, and constructing concrete curbs and gutters in connection therewith where needed, doing such other ~ork as may be necessary in connection with said improvement, all in accord with a Resolution passed by the ICity of Fort Angeles July 16, 1951; creating a Local Improvement District for such improvement; and pro- tviding that payment for said improvement be made by special assessments on the property in said District ~especially benefited, payable by the mode of payment by bonds, all in accord with maps, plans and specifi- ,cations prepared by the City Engineer and approved by the City Commission. C:l.2.f An Ordinance of the City of .Port Angeles, providing for the improvement of Vine ,Street, Peabody Street and ~enth Street, by constructing concrete curbs and gutters thereon and creating a Local Improvement District to provide for the payment of such improvement. !It was moved by Commissioner Taylor that the foregoing Ordinance be passed first and second reading. fSeconded by Commissioner Robinson. The Commission met in special session at 3:30 P.M., and was called to order by Mayor Feeley. Officers present were: Mayor Feeley, Commissionar Taylor, Attorney Trumbull and Clerk Law. Under the head of introduction of resolutions, the following was introduced: RESOLUTION WHEREAS, there has been filed with the City Clerk of the City of Port Angeles, a petition containing signatures of electors, equal. in number to twenty per cent of the vote cast for all candidates for Mayor of the City of Port Angeles at the last preceding general City election, which petition prays that a special election be held to determine whether the City of Port Angeles shall adopt the Council Manager Plan of City Government; and WHEREAS, Section 2 of Chapter 271 of the La>1s of Washington for 1943, being the statute providing for special elections to determine Whether such Council Manager Plan of Government shall be adopted provides that such election shall be not less than ninety (90) nor more than one-hundred and twenty (120) days before the next regular Kunicipal Election; and WHEREAS, Section 2 of Chapter 101 of the Laws of Washingto'n'"for 1951, provides that all city and t01llT11 elections, other than in class A Countys, Whether general or special, and whether for the election of officers or for the submission to the voters of such city or town of any questicn for their adoption and approval or rejection, shall be held on the second Tuesday of March in the year in which they shall be called; and \.JHEREAS, said Section 2 of Chapter 101 of the Laws of Washington for 1951, further provides, that >rhenever in the judgment of the governing board of any such city, town or school district, an emergency exists, such board may by Resolution call a special election at any time in such mgnicipalities or district; and 'WHEREAS, if the special election to detennine whether the voters of the City of Port Angeles shall adopt or reject the Council YlSnager Plah. of Government is, held on the second Tuesday in l1arch, 1952, and such, plan should be adopted by vote of the electorate at such election, no opportunity for electi,ng officers under such plan of government will be afforded for a period of three (3) years or until the next general municipal election, and such plan will therefore be inoperative for such period; now, therefore BE IT RESOLVED by the City Commission of the City of Port Angeles, that in the judgment of the City Commission, and by reason of the facts above stated, an emergency exists,. requiring the holding of a special election to detennine whether the City of Port Angeles shall adopt or reject the Council Manager Plan of Government, and that such special election shall be held on a date to be fixed by the proclamation of the Mayor of the City of Port Angeles, such date. to be not less than ninety (90) nor more than one-hundred twenty (120) days before the second Tuesday in March, 1952, such date being the date of the next general election of the City of Port Angele s. It was moved by Mayor Feeley that the foregoing resolution be approved and adopted. Seconded by Commissioner ~ Taylor. All voted Aye. Motion carried. PROCLAMATION j, I, FRANK A FEEIEY, Hayor of the City of Port Angeles, Washington, do by virtue of the authority vested in me by, the laws of the State of Nashington hereby proclaim as follows: That on Tuesday, the 27th day of November, there shall be held in the City of Port Angeles, a special electi n I to, determine by vote of the electorate of the City of Port Angeles, whether the City of Port, Angeles shall adopt or rej ect the Council Hanager Plan of Municipal Government, all in accord with Chapter 271 of the Laws lof the State of l'/ashington for 1943, and the petition signed by electors of the City of Port Angeles equal 'in, number to twenty per cent (20%) of the vote cast for all candidates for Hayor at the last preceding general election, and nm" on file with the Clerk of the City of Port Angeles.
