A. Amendment to Environmental Policy Ordinance
Mayor Haguewood opened the public hearing on an amendment to the City
Environmental Policy Ordinance (SEPA Ordinance) and requested Comments
or questions £rom the audience or staff. There were no comments and
the public hearing was closed. Attorney Miller then explained the
intent of this amendment, which is to bring the City in compliance
with the State Environmental Policy Act, which was amended in 1977
to specify the circumstances under which a governmental unit may con-
dition or deny a permit under SEPA. When a non-elected official con-
ditions or denies a perm~i,t not requiring a legislative decision, the
action must be based upon an identified local policy; must be in writ-
ing; and must be appealable to the local legislative body. Building
permits and variances for non-exempt projects will be most affected '
as they do not require City Council action. Rezones, conditional use
permits, plats and major capital improvements do require Cauncil ap-
proval and therefore would be unaffected by the revisions. The..Council
will also need to decide which appeal procedure will be included in the
amendment; the public hearing procedure, or the direct appeal procedure.

15.04 of the Municipal Code.
Councilman Buck moved the Council adopt the foregoing Ordinance
by title by Mayor Haguewood, with the public hearing procedure
peals. The motion was seconded by Councilman Boardman and carr
unanimously.
Mayor Haguewood read in full the proposed final agreement with Northern
Tier Pipeline Company on Local Labor, Contractor, and Material Supplier
Preference, and opened the public hearing on this matter. There were
no comments from the audience or staff and the public hearing was closed.
Councilman Buck then moved the Council approve the final agreement with
Northern Tier for Local Labor, Contractor, and Material Supplier Preference.
The motion was seconded by Councilman Polhamus and carried.

Councilman Hordyk read in full Section 15.04.090 (Designation of Responsible
Official) of the SEPA Ordinance (No. 1890) and expressed his concerns re-
garding establishment of the City Manager or his designee as the responsible
official for making threshold determinations and requiring environmental
impact statements. Councilman Hordyk suggested that the City Council be
designated as the responsible body for making those decisions instead of
just one City staff member.
During discussion on this proposal, the Council and Manager Flodstrom dis-
cussed the Planning Department's present procedure for requiring environ-
mental impact statements and making threshold determinations (a SEPA en-
vironmental checklist is used); the legal recourse for appeals; and the
amount of developments in this area and the problems associated with de-
ciding which cases should be brought before the Council. The discussion
concluded with Councilman Hordyk suggesting the matter be reviewed further.
Councilman Hordyk also requested a copy of the 'SEPA Ehvironmental Check-
list be made available to all Council members.
Mayor Haguewood read a memorandum from Finance Director Orton outlining the
utility discount survey tabluations. Results of the survey show that 563
households meet the guidelines suggested by the senior citizens (retired
single person with income of $7,800 or less and two-person household with
income of $9,700 or less}. 305 of the eligible households are single person
while 258 are occupied by two or more persons; 426 of the residences are
owned, while 137 are rented. Mr. Orton also reported that ". at a
minimum, a 14~ discount extended to the eligible accounts will amount to
$31,000 in the first year (excluding administrative expense)." A 14~ dis-
count on average monthly billings for Water, Sewer, Solid Waste and Elec-
tricity translates to $4.32 per month ($52.00 annually} for a single person
dwelling; and $5.03 per month (.$60.00 annually) for a household with two
or more persons.
Mayor Haguewood then requested additional input from the senior citizens
were present at this meeting. Subjects discussed included rates paid by

industrial users; the need to consider discounts for those seniors who use
wood or oil heat; the possibility of a discount on water rates instead o£
electricity in order to reach more of the community; the need to look at
several different alternatives which could have far more benefits (i.e.
the BPA Weatherization Pilot Program) and the need to consider other low-
income groups in a discount program; various discount programs offered by '
other communities; and the scope of the BPA Weatherization Program. The
discussion concluded with the Council agreeing to continue this meeting
until September 4, 1980 at 2:30 P.M. in order to discuss this matter
further with the senior citizens.
5. PROJECT SCOPE: RENOVATION OF COMMUNITY CENTER
Manager Flodstrom pointed out that a request to call For bids on the renova-
tion of the Vern Burton Memorial Community Center was included in the Consent
Agenda. The Council then agreed that the proposed design scope, which was
submitted for-their review at the August 19, 1980 meeting, contained all of
the information needed for a call for bids.
6. AGREEMENT: CLALLAM COUNTY JAIL
Manager Flodstrom informed the Council that the City and County have not yet
reached an agreement on use of the County jail facility by City prisoners
(County prisoners were moved to the facility on September 2, 1980). Another
meeting with the County Commissioners and staff will be scheduled in the
near future to hopefully try and reach an agreement. The Council, Manager
Flodstrom and Police Chief Cleland then briefly discussed the language pro-
posed by the City; the possibility of several Council members also attending
the negotiations in an attempt to reach an agreement; and the future of the
City prisoners who cannot be moved into the new jail facility until an agree-
ment is reached. '
7. REQUEST TO PURCHASE PROPERTY: R. BURLILE
Councilman Hordyk reported that he has been unable to meet with Councilmen
Polhamus or Quast on this matter. However, because of recent delays, he
moved that the Council approve Mr. Burlile's request for purchase of City
property on Deer Park Road, and sell the subject property at 50~ of the
abutting property's assessed valuation. The motion was seconded by Council-
man Polhamus. During discussion on the motion, the Council and Manager
Flodstrom discussed whether an updated appraisal would be needed. On
call for the question, the motion was passed by the Council.
8. PURCHASE OF LOT: PEABODY-PARK SUBSTATION
Mayor Haguewood read a memorandum from Manager Flodstrom informing the
Council that Mr. Mike Libera, representing Rex Behrhorst, has contacted
the City to ask if the City is interested in purchasing Lot 45, Block 25,
Grants Addition, which falls immediately south of the City's Peabody-Park
Street substation.
The Council then agreed to refer this proposal to the City Manager and Plan-
ning Department to contact abutting property owners (Lots 1-13) in regard to
access; if access is acquired, perhaps the property can be developed.
9. ORDINANCE: AMENDMENT TO DRIVEWAY STANDARDS

Councilman Hordyk moved the Council adopt the foregoing Ordinance as read
by title by Mayor Haguewood. The motion was seconded by Councilman Suck.
During discussion on the motion, Public Works Director Pittis explained
the intent of this ordinance, which gives the Director of Public Works,
or his designee, the authority to grant special permission to construct
' driveways deviating from the standards. On call for the question, the
motion was passed unanimously by the Council.
10. PROCLAMATION: CONSTITUTION WEEK
Mayor Haguewood read in full a Proclamation proclaiming the week of
September 17-23, 1980 as Constitution Week.
11. PROCLAMATION: DENTAL HYGIENISTS WEEK
Mayor Haguewood read in full a Proclamation proclaiming the week of
September 12-18, 1980 as Dental Hygienists Week.

VIII FINANCE
1. L.I.D. NO. 204
Councilman Buck moved the Council authorize the payment of $139,438.16 to
J. D. Shotwell Company, Tacoma, as the tenth, August estimate of work done
and materials furnished by said contractor on L.I.D. No. 204, 14th and "K"
Streets, as certified by City Engineer Andrew Rose in his Certification
' letter dated August 26, 1980. The motion was seconded by Councilman Duncan
and carried.
2. L.I.D. NO. 203
Councilman Hordyk moved the Council authorize payment of $6,087.30 to Clark
and Associates for engineering work on L.I.D. No. 203, the Downtown Renova-
tion Project. The motion was seconded by Councilman Polhamus and carried.
VIX LATE ITEMS
1. STATUS REPORT ON NORTHERN TIER HEARINGS
Mayor Haguewood read a letter from John Keegan updating the Council on the
status of the Northern Tier Pipeline proceedings. Mr. Keegan reported that
at the present time there is still no definite schedule for commencement of
testimony by the intervenor parties. Based upon Northern Tier's promised
date for submittal of new information on the submarine and terrestrial
pipeline portions of its Application, it appears that the earliest date
for submittal of testimony by the intervenors will be mid-November, 1980.
X CONSENT AGENDA
Councilman Hordyk moved the Council approve the items listed under the Consent
Agenda including Vouchers Payable of $78,045.88 and Payroll of $152,832.37.
The motion was seconded by Councilman Buck and carried. Items listed under
the Consent Agenda are as follows:
1. Authorize the Parks Department to call for proposals £or the design of
the Vern Burton Memorial Community Center.
2. Authorize payment of $17,666.14 to Davlin Construction as a progress payment
on the Ahivers Road sewer extension.
3. Authorize payment of $2,557,95 to Wes Rausal, developer of Galaxy Estates,
as a connection fee in conjunction with the Ahlvers Road sewer extension.

X CONSENT AGENDA
4. Authorize payments of $114,124.35 to 0. M. Hendrickson Company; $3,969.19
to URS Company; and $1,167.73 to Clark and Associates as progress payments
on the Tumwater Bridge Project.
5. Authorize the payment of retainage in the amount of $2,498.25 to Henkles
and P4cCoy for work done and accepted on the Marine Drive reconductoring.
6. Authorize payment of $3,716.00 to Leupold & Stevens Tnc. for traffic
counters (the State will be billed for $3,000 of this amount).
7. Notification has been received from the Washington State Liquor Control
Board that Skipper's Seafood and Chowder House's Class A, C license is
on file in Olympia with the Secretary of State.
XI COUNCIL REPORTS
Councilman Hordyk: Commented on one Planning Commission member's 50~ attendance
at meetings and suggested a letter be written to that member in regard to his
lack of attendance.
Mayor Haguewood: Questioned Public Works Director PittiS in regard to the
status of the paving of the Civic Field parking lot.
Councilman Duncan: Questioned Manager Flodstrom in regard to the October 21,
1980 Northern Tier negotiation session.
Councilman Polhamus: Announced that he will be out-of-town from September 8th
to October 1st.

The meeting adjourned at 9:00 P.M. to an Executive Session.
