PROCEEDINGS OF THE CITY COUNCIL OF THE CITY OF PORT ANGELES,' WASHINGTON (September 4, 1969) 99 The Co unci! met in regular session at 7:30 p.m. Officers present were Mayor Wolfe, Coun- cilmen Maxfield, Thorne, Bettger, Schroeder, Basom and Cornell; City Manager Herrman, Attorney Moffett and Acting Clerk Hobbs. A motion was made by Councilman Maxfield, seconded by Councilman Thorne and carried, to accept and place on file the Council Minutes of August 21, 1969 and corrections and ad- ditions to Council Minutes of July 10, 1969. 'I A motion wa s made by Councilman Thorne, seconded by Councilman Bettger and carried, that the Council concur with the Light Superintendent's recommendation to throw out all the bids on the 5,000 feet of conductor, as none- of the bids met the specifications. A motion was made by Councilman Bettger, seconded by Councilman Maxfield and carried, to concur with the Water Superintendent's recommendation and accept the low bid of Owens Brothers of $5.90 per ton for rock rip rap for Ediz Hook. A motion was made by Councilman Schroeder, seconded by Councilman Thorne and unanimously carried, to approve and pay to Del Guzzi, Inc. $11,670.10 for work done and material furnished on Lauridsen Boulevard Bridge, subject to cleanup of about two hours remaining undone. A motion was made by Councilman Bettger, seconded by Councilman Maxfield and unanimously carried, to approve and pay to Evergreen Landscaping $2,600.00 for 2nd estimate of work done and material furnished on Sewage Treatment Plant Screening. A motion was made by Councilman Maxfield, seconded by Councilman Bettger and unanimously carried, to approve and pay to McCray Marine Construction Company, Inc. the retained per- centage in amount of $1,933.25 for work done and material furnished on Submarine Outfall Construction. I A motion was made by Councilman Thorne, seconded by Councilman Cornell and unanimously carried, to approve and pay to Teeples and Thatcher, Inc. $7,089.38 for Pay Estimate No. 14 on work accomplished on Waste Water Treatment Plant. A motion was made by Councilman Basom, seconded by Councilman Schroeder and unanimously carried, to approve and pay to J. D. Shotwell Company the first (August) estimate of work done and material furnished on the East Lincoln Heights L.LD. No. 189-A in amount of $7,000.00 (Revenue warrants to be drawn against 1.I.D. No. 189-A bearing interest at the rate of 5.75% per annum, dated September 8, 1969, the proceeds from said warrants to be deposited in L.LD. No. 189-A Fund, and a Cash Warrant to be drawn on said fund in favor of the creditor in amount of $7,000.00 in payment for work done .) A motion was made by Councilman Thorne, seconded by Councilman Cornell and unanimously carried, to approve and pay to J. D. Shotwell Company the seventh (August) estimate of work done and material furnished on the East Lincoln Heights L.LD. No.189, in amount of _ $113,000.00. (Revenue Warrants to be drawn against L.LD. A motion was made by Councilman Easom, seconded by Councilman Schroeder and unanimously carried, to approve and pay to Del Guzzi, Inc. the retained percentage in amount of $4,225.73 for work done and material furnished on Lauridsen Boulevard, Race to Ennis. I A motion was made by Councilman Bettger, seconded by Councilman Cornell and unanimously carried, to approve for payment. Claims Vouchers in amount of $108,769.82; L.LD. No. 189-A in amount of $56.16; and L.LD. No. IB9 in amount of $7,953.63. A motion was made by Councilman Thorne, seconded by Councilman Eettger and unanimously carried, to concur with the Planning Commis sion' s recommendation and grant a Conditional Use Permit and variance to Mr. A. Ward Piercy, 914 South Race Street, to permit him to convert the ground floor of a pre-existing, non-conforming single family residence to an apartment, making the building a duplex. A motion wa s made by Councilman Eettger, seconded by Councilman Maxfield and unanimously carried, to table action on the item of Mrs. Eleanor Priest's questioning of description and 100 PROCEEDINGS OF THE CITY COUNCIL OF THE CITY OF PORT ANGELES, WASHINGTON (September 4, 1969 Continued) and price of alley vacation-Block IB6, West 240 feet, for a work session within a week to establish a price and obtain more information. A motion was made by Councilman Cornell, seconded by Councilman Maxfield and carried, to accept and place on file the Planning Commission Minutes of September 2, 1969. A motion was made by Councilman Eettger, seconded by Councilman Thorne and unanimously carried, to accept and refer to the Budget Committee the budget requests of Child Guidance Center-$3,218.00 and the Clallam County Mental Health and Retardation Board- $2,500.00. The following resolution was read in full. RESOLUTION NO. 17-69 I A RESOLUTION suspending the dance license of the Pieces of Eight Tavern. A motion was made by Councilman Maxfield and seconded by Councilman Thorne to adopt the foregoing resolution as read. Mr. Fidler, Attorney for Pieces of Eight Tavern presented the Council with a petition, of about 143 signatures, in favor of not sus- pending the dance license of this establishment. After consideration of the petition, the foregoing motion was carried unanimously and license suspended until January 1, 1970 Mr. Jones, co-owner of Pieces of Eight Tavern asked the Council that they be granted a temporary dance license to enable them to sell the establishment without taking a large loss. Request declined by Council. A motion was made by Councilman Bettger, seconded by Councilman Maxfield and carried, to refer the petition on Paving Chase Street between First and Second Streets to the City Manager and City Engineer to see what could be done about a walkway or sidewalk instead of paving the whole street. A motion was made by Councilman Cornell, seconded by Councilman Maxfield and unanimously carried to accept the offer of Atlantic-Richfield, to pay for one-third of the claim for damages re: petroleum saturated subsoil which resulted in an additional cost to the City in constructing an interceptor sewer, and have City Attorney prepare I release for this particular instance. A motion was made by Councilman Cornell, seconded by Councilman Thorne and unani- mously carried, to also accept Shell Oil CompanyTs similar offer to pay one-third of the claim for damages re: petroleum sa~rated subsoil. A motion was made by Councilman Schroeder, seconded by Councilman Thorne and carried, to accept and place on file the Olympic Regional Planning Council Minutes of Au- gust 30, 1969; the Olympic Air Pollution Control Authority Minutes of August 6, 1969; the Lincoln Park Camping Area Report; the corrected July Budget Report; and the out-of-town report of Assistant Finance Director. Other subjects of discusston were a report from the Art Commission re: City Beauti- fication for which a motion was made by Councilman Maxfield, seconded by Councilman Bettger and carried, to authorize the City Manager, with the Art Commission's help, to send letters to the downtown property owners offering assistance of the Art Com- mission for property improvements, and to be signed by the Mayor; Noise Surpression meeting set for Thursday, September 11, 1969 at 7:30 p.m.; Engineering Department to look into restoration of sidewalk use near stairway on Laurel; referral to Health Department of raw sewage in street at Craig and McDougal; dinner meeting set for Tuesday, September 9, 1969 at 6:00 p.m. at Harrington's with County Commissioners; and the hazard to school children in winter at "e" and West 8th Streets. A motion was made by Councilman Eettger, seconded by Councilman Basom and unani- I mously carried to have "3-way stop" signs posted on each of the Stop signs, and possibly beneath stop light, at the intersection of ItC" and West 8th Streets. _.
