CALL TO ORDER - Mayor Hallett called the special meeting of the Port Angeles City Council to order
SPECIAL MEETING: at 4:35 p.m.
ROLL CALL: Members Present: Mayor Hallett, Councilmen Braun, Nicholson, and
Ostrowski, Councilwoman Sargent, and Councilmen
Schueler and Wight.

Staff Present: Manager Pomeranz, Attorney Knutson, Clerk Upton, K.
Ridout, and J. Jimerson.
Public Present: S. Hoare.
Public Hearing on Mayor Hallett reported that the purpose of this special meeting was to conduct a
Request for Street public hearing and consider a request for the vacation of a portion of Peabody Street,
Vacation - north of Viewcrest. Mayor Hallett reviewed background information provided by
Ordinance No. 2711 the Planning Department and inquired as to whether the Real Estate Committee has
set a compensation amount for this vacation.
Councilman Wight indicated the Real Estate Committee had just met in this regard
and noted a slight difference in the square footage to be made a part of the vacation.
Original documents showed the square footage as being 1,477 square feet. That
figure should be corrected to reflect 1,562 square feet.
Property Manager Ridout reported the compensation recommended by the Real Estate
Committee was established at $1.40 per square foot, for a total of $2,187.00. With
the property owner responsible for the payment of fifty percent, the compensation
figure to be made a part of the Ordinance should be $1,093.00.
Mayor Hallett opened the public hearing at 4:40 p.m. There being no public
comment, the public hearing was closed at 4:40 p.m. Mayor Hallett then read the
Ordinance by title, entitled
ORDINANCE NO. 2711
AN ORDINANCE of the City of Port Angeles
vacating a portion of Peabody
Street abutting Lots 20, 21,
and 22, Block 26, Grant's
Addition to the Townsite of
Port Angeles.
Mayor Hallett also noted the correction of the square footage, as well as the
compensation of $1,093.00. Councilman Wight moved to adopt the Ordinance
as read by title, citing one Condition, Findings 1 - 7, and Conclusions A - B,
appropriately correcting Findings 1 & 2. The motion was seconded by
Councilman Braun.
After further discussion and with an expressed need to clarify the motion,
Councilman Wight withdrew the motion and subsequently moved to approve the
street vacation request STV 92(09)03, subject to the following condition, and
citing the following findings and conclusions: Condition: A minimum 35 foot
right-of-way from the center line of the improved street shall be maintained;
Findings: (1) The request is to vacate 1,562 square feet of the Peabody Street right-
of-way; (2) The construction of Peabody Street is skewed with respect to the right-of-
way, thereby creating 12 to 15 feet of unneeded right-of-way between the site and
the street improvements; (3) The property is zoned RS-7; (4) The site is located
along a designated school walking route; (5) There are several Comprehensive Plan
Policies encouraging the provision of safe pedestrian facilities including Residential
Policies 4 & 5 and Circulation Policies 7, 8 and 10; and (6) The easternmost house
appears to be non-conforming with respect to the required front yard setback.

Approval of the street vacation would reduce the degree of nonconformity, if not
eliminate it; Conclusions: (A) Vacation of this portion of the Peabody Street right-
of-way is in ~e' Public use and interest and would be a public benefit; and (B) As
conditioned, the street vacation is consistent with the Goals, Policies and Objectives
of the Comprehensive Plan, specifically those listed in Finding No. 5. Councilman
Braun seconded the motion which carried unanimously.
Councilwoman Sargent moved to adopt the Ordinance as read by title, including
the compensation in the amount of $1,093.00. The motion was seconded by
Councilman Braun and carried unanimously.
ADJOURNMENT: The meeting adjourned at 4:45 p.m.
