The motion was seconded by Councilman Boardman and carried. The special meeting was then called to order by Mayor Pro Tem Suck at 8:00 P.M. The purpose of this joint special meeting between the Council and Planning Commission is to discuss the Home Occupation Guidelines, Zoning Enforcement, and appointment of Planning Commission members. II ROLL CALL Members Present: Mayor Pro Tem Buck, Councilmen Anderson, Boardman, Duncan, Hordyk, Wray. Dick Anderson, Colin Bennett, Dave Brewer, Pat bownie, Rusty LaFerney, Evelyn Tinkham, Chuck Whidden. Members Absent: Mayor Haguewood (arrived later). Staff Present: Manager Whorton, Deputy Clerk Caso. P. Carr. III MINUTES Suspended. IV LEGISLATION 1. HOME OCCUPATION GUIDELINES Planning Commission Chairman Pat Bownie advised the Council that the Commission has formally adopted the Home Occupation Guidelines, even though the guidelines were never approved by the Council. The only change in the guidelines since then has been the addition of Con- dition No. 12, which deals with physically handicapped applicants. The Council, Planner Carr, and members of the Planning Commission then discussed the proposed guidelines at length, with much of the discussion centering on violations and enforcement of the Zoning Ordinance. Councilman Boardman then moved the Council adopt the Home Occupation Guidelines as presented by the Planning Commission. The motion was seconded by Councilman Wray. During discussion on the motion, Councilman Hordyk questioned the Commission regarding Condition No. 5 and 6, and requested that they be more specific. On call for the question, the motion was passed by the Council with Councilman Hordyk voting "NO." 2. ZONING ENFORCEMENT The next item of business to be discussed by the Council and Plan- ning Commission was zoning enforcement, with the discussion on Home Occupation enforcement continuing. After several comments on various local violations of the Zoning Ordinance, Councilman Buck moved the home occupation guidelines be enforced with a $100 per day fine for violators. The motion died for lack of a second. R~ CITY COUNCIL MEETING October 10, 1978 IV LEGISLATION 2. Cont. Manager Whorton then explained that a violation of the home oc- cupation guidelines is actually a violation of the Zoning Ordinance and would be classified a misdemeanor with a $500 fine; however, a simpler legal procedure is needed, such as a system of citations, for enforcement, rather than time consuming court action. Councilman Boardman then moved the Council direct the City Manager to work with the Planning Department and City Attorney to develop better enforcement controls over home occupations, and return to the Council with their proposal. The motion was seconded by Councilman Duncan and carried. The discussion continued with Planner Carr suggesting an occupancy permit or business license be required of all City businesses; this would enable the City to keep track of where the businesses are located, therefore making it easier to verify compliance with the Zoning Ordinance. This suggestion was discussed at length by the Council and the Planning Commission, with Councilman Hordyk cautioning the Council against discouraging new businesses from locating in the City by too much regulation. Councilman Buck also suggested the Planning Com- mission analyze the situation, as they did with home occupations, and bring a recommendation back to the Council. The Planning Commission also expressed concern over the key-making business which is located in a small trailer on the Albertson Stores parking lot, and vehicles which are parked on the Pay-n-save parking lot with For Sale signs on them. 3. APPOINTMENT OF PLANNING COMMISSION MEMBERS Chairman Downie requested the Council adopt a general procedure, ,~ such as a brief interview with the Council or Planner Carr, for Planning Commission applicants; that way the Commission will have some background information on the applicant when an appointment is made by the Council. Furthermore, periodic advertising of present Commission vacancies and future vacancies would also help. The Council and Planning Commission discussed this matter briefly, with Mayor Haguewood commenting on the difficulty of finding citi- zens willing to serve on advisory boards. The discussion concluded with comments from various Council and Commission members, in ad- dition to several suggestions, on advisory board appointments.
