III MINUTES
Councilman Quast corrected the minutes of the October 4, 1983 meeting,
Register Page 49, it~m III, deleting the word Downtown in reference to the
brochures.

Councilman Gerberding moved to accept the minutes of the October 4, 1983
meeting, with Councilman Whidden seconding. Councilman Gerberding
corrected the minutes as follows: Register Page 49, Item III, Councilman
Quast moved to correct the minutes; Register Page 52, Item VIII, paragraph
2, the amount of the grant application is $400,000. The motion to accept I
and place on file the October 4, 1983 minutes as corrected carried.
IV CONSENT AGENDA
Councilman Polhamus moved the Council accept the items listed under the
Consent Agenda as follows: (1) Request to advertise for bids on Aid
Vehicle; (2) payment of $1,393.90 to Harold Sargent for design on roof of
Vern Burton Memorial Gym; (3) Payment to Riddell Williams of $7,051.18; (4)
Correspondence from the Washington State Liquor Control Board; (5) Vouchers
of $256,886.43 and (6) Payroll of $191,117.49. Councilman Whidden seconded.
After some discussion on the status of the letter to the Washington State
Liquor Control Board supporting the issuance of A-C licenses, on call for
the question, the motion carried.
V FINANCE
None.
VI ITEMS FROM THE AUDIENCE TO BE PLACED ON THE AGENDA
Hattie Berglund commended the Light Department for the landscaping at the
substation located at the corner of Seventh and "I" Streets.

VII LEGISLATION
1. Recognition of former Planning Commission members.
Mayor Duncan presented plaques of appreciation to Mickey Ranta, Colin
Bennett, Patrick Downie and David Brewer, for their service on the Planning
Commission.

2. Peabody Creek Trail Dedication Ceremonies.
The City Council has been invited to attend the dedication ceremonies of
Public Trails, the new office of Platt, Irwin, Colley, Oliver and. Miller,
located at 403 South Peabody Street. The dedication will be Friday,
October 21, 1983 at 4:00 P.M. with an open house from 4:15 P.M. to 7:00
P.M.
3. Public Hearings.

Electric Rate Adjustment due to BPA Wholesale Power Increase -
Consideration of Rate Ordinance.
Following an explanation from Light Director Cosens on the proposed in-
crease, Mayor Duncan opened the public hearing and asked for comments.

B. Draft #8 of the Harbor Use Ordinance.
Mayor Duncan reviewed a background memo from the City Attorney and opened
the public hearing. Clay Betting of Port Angeles addressed the Council on
the wording of the Ordinance. He opposed the boundaries indicated in the
Ordinance and questioned the need for the Ordinance. He also questioned
the City's authority to regulate Harbor activity.
Barry Moore of Western Transportation Company voiced concerns. He also
opposed the location of the boundaries and stated that in his opinion, more
work is needed on the Ordinance. Hattie Berglund of 1834 West Seventh
Street stated that in her opinion this is a pro-people safety Ordinance.
She commended the City for getting it to this point. She suggested that
the City extend the boundary by either an annexation to the City or enter-
ing into a joint City/County Ordinance with the City as a lead agency in
the administration of the Ordinance. She requested that the City take
action in the near future. Mayor Duncan then closed the public hearing.
She referred the Council to a memo from'Councilman Gerberding suggesting a
work session with staff on the Harbor Use Ordin~nce.

Councilman Gerberding then voiced his concerns and moved to schedule a work
session for the fourth Tuesday in January, which is January 24, 1984.
Councilman Whidden seconded and the motion carried.

of Ordinance 2054 as most recently amended by
Section 3 of Ordinance 2260; amending Section 2
of Ordinance 2173 as most recently amended by
Section 1 of Ordinance 2267; amending Section 3
of Ordinance 2173 as most recently amended by
Section 5 of Ordinance 2232; amending Sections
13.12.060, 13.12.071 and 13.12.072 of the Port

Councilman Polhamus seconding. Councilman Gerberding noted that the new\
Section 13.12.073, Schedule MW1 - Municipal Water Pumping, of the PAMC will
in essence be shifting the load of the City's two major pumps to non-peak
hours and should generate a savings in excess of $20,000 a year. On call
for the question, the motion carried with Councilman Quast voting "No".

C. Zoning Ordinance Amendment
Mayor Duncan opened the public hearing and asked for public comment. There
were no comments. Mayor Duncan then closed the public hearing and read the
Ordinance by title entitled
ORDINANCE NO.
AN ORDINANCE of the City of Port Angeles
amending Ordinance 2109, which amended
the Zoning Regulations, Ordinance 1709,
by adding the Office Commercial District,
to allow businesses selling medical
supplies, etc., as conditional uses, and
to allow beauty shops and barber shops
as conditional uses.
Councilman Quast moved to adopt the Ordinance as read by title, striking
beauty shops and barber shops as conditional uses. Councilman Gerberding
seconded. After considerable discussion with staff, on call for the
question, Councilman Gerberding voted "Aye" and all others voted "No". The
motion failed.
Councilman Quast then moved to refer the proposed amendment to the Zoning
Ordinance back to the Planning Commission for further consideration. Coun-
cilman Whidden seconded and the motion carried.
D. OVergrown Lots - Resolution.
Mayor Duncan reviewed a memo from the City Attorney and read the Resolution
by title entitled
RESOLUTION NO. 26-83
A RESOLUTION of the City Council of the
City of Port Angeles, Washington,
declaring the existence of a public
nuisance and requiring the elimination
of such nuisance.
Councilman Quast moved to adopt the Resolution as read by title. Manager
Flodstrom indicated the need for a public hearing. Mayor Duncan then
opened the public hearing and asked for comments from the audience. There
were no comments and the Mayor closed the public hearing.
Councilman Quast's motion to adopt the Resolution as read by title was re-
introduced and was seconded by Councilman Gerberding. Public Works Direc-
tor Pittis informed the Council that the property listed as Exhibit liD" had
been cleared up and could be removed from the Resolution. Councilman Quast
requested that the Park Department clean up the newly acquired City prop-
erty located at Fourth and Peabody, as much as is possible with the budget
limitations of that Department. On call for the question, the motion to
adopt the Resolution carried.
4. Planning commission Minutes of October 12, 1983.
No action was required of the Council and Councilman Quast moved to accept
and place on file as written the Planning Commission minutes of October 12,
1983. Councilman Gerberding seconded and the motion carried.
5. Utility Credit Policy Ordinance and Informational Memo.
After discussion, the Council set October 25, 1983 as the date for a Coun-
cil work session on the Utility Credit Policy. Councilman Quast moved to
establish a public hearing on November 1, 1983, following the October 25,
1983, Council work session. Councilman Gerberding seconded and the motion
carried.
6. Medic I Implementation Ordinance
Mayor Duncan read the Ordinance by title entitled

ORDINANCE NO. 2274

AN ORDINANCE of the City of Port Angeles,
Washington, establishing a Medic I Program
and a utility charge for funding such
program; amending Sections 1 and' 2 of
Ordinance 2055; amending Sections 13.16.010
and 13.16.020 of the Port Angeles Municipal
Code; and adding a new Chapter 8.36 to the
Port Angeles Municipal Code.
Councilman Whidden moved to adopt the Ordinance as read by title with
Councilman Quast seconding. The motion carried.
7. Request from DOE to Use City's Landfill
Councilman Quast moved to grant the request of the DOE to dispose of
material collected in a County-wide clean up at the City's Sanitary Land-
fill free of charge. Councilman Gerberding seconded. After discussion,
Councilman Haguewood moved to table the matter. Councilman Whidden
seconded and the motion carried, with Councilman Quast voting "No".
8. Declaration of Surplus Property for Police Auction October 22, 1983
After discussion, Councilman Hordyk moved to declare items listed in an
October l3, 1983 memo from Finance Director Orton surplus property and
authorize the sale of these items at the October 22, 1983 Police Department
Auction. Councilman Whidden seconded and the motion carried.
VIII LATE ITEMS
Vern Burton Reroof
Public Works Director pittis informed the Council that the arch part of the
roof does not permit a hot mop roof, which had previously been specified.
He then presented to the Council a sample of a single-ply membrane roofing.
Installation of this roofing would cost an additional $7,500, with a 10
year warranty. After discussion, Councilman Quast moved to approve the
additional expenditure of up to $7,500 for the 10-year warranty roof, sub-
ject to the approval of Ellerbee and Associates. Councilman Gerberding
seconded for the sake of discussion. After further discussion, on call for
the question, the motion carried.
Soroptimist Club Invitation
Manager Flodstrom informed the City Council that they have been invited to
a November 4, 1983 function of the Jet Set Soroptimist International of
Port Angeles. Ruth Walsh will be the guest speaker.
Washington Centennial in the Olympic peninsula
Mayor Duncan reported on a recent meeting regarding this celebration. The
celebration will be in 1989. There will be a hearing in Port Townsend
Friday, October 2l, 1983, at 4:00 to discuss ideas and plans for the
celebration. Mayor Duncan stated that there are federal monies available
for some activities. councilman Quast will be representing us at the
hearing.
EPA Hearing Regarding Alaskan Mill Operations
Mayor Duncan informed the Council that there will be a hearing November 7,
1983 at 2:30 P.M. on the EPA's tentative decision to deny a request for two
Alaskan mills for a variance. ITT Rayonier has requested that the City
support the denial. Manager Flodstrom indicated that the EPA should sup-
port regulations uniformly for the sake of protecting the environment.
Councilman Quast suggested that Councilman Gerberding and one other member
appear at the hearing, and that staff prepare a letter to Congressman Swift
and the two Senators, showing the City's concern, supporting the tentative
decision to deny the request, and supporting uniform enforcement.

Navy Captain Ridge - Visit to Port Angeles
The Council provided the Mayor with information and requests to be
presented to Captain Ridge.
Convention Center Ballot Issue
Manager Flodstrom reported on the formation of the Citizens for a Port
Angeles Convention Center Group, on their progress and plans for supporting
the Convention Center ballot issue. He stated that with their efforts the 1-
issue is sure to pass.
IX ITEMS FROM THE AUDIENCE NOT ON THE AGENDA
Leo Sunny invited Mayor Duncan, members of the Council and the radio
audience to participate in a Peace Walk Saturday, October 22, 1983, to
support efforts to create a Nuclear Free Europe.
ITEMS FROM THE CITY COUNCIL NOT ON THE AGENDA
Councilman Whidden reported on complaints he has received regarding the
placement of plywood signs by the 24-hour grocery located at Eighth and
Lincoln Streets. The placement of crates of oranges less than 10 feet from
the gas pumps was also mentioned. Councilman Whidden discussed the proce-
dure for obtaining a building permit with staff.
Councilmen Whidden and Hordyk discussed with staff the possibility of in-
stituting an annexation program for the additional Harbor area to alleviate
the problem with the Harbor Use Ordinance.
Mayor Duncan stated that she had received complaints regarding the second-
hand store at Ninth and Lincoln and had also received complaints about the
establishment at Eighth and Lincoln.
Thank you to Lee Moore
Mayor Duncan read a letter from Park and Recreation Beautification Commis-
sioner Russell Hesserman and Park and Recreation Director John Marsh to Lee
Moore for installation of the horseshoe pits in Lincoln Park. The Council
joined in thanking Mr. Moore.
Veteran's Day wreath
Councilman Quast moved to allocate $40 for the purchase of the traditional
wreath for the Remembrance Day ceremonies in Victoria, B.C., in which the
City of Port Angeles participates. Councilman Whidden seconded and the
motion carried.
Councilman Quast stated that dirt dumping has been taking place at City
property located at Eighth and Eunice, which had been previously forbidden.
Manager Flodstrom indicated that Mr. Somers, under whose direction the
dumping had been taking place, had inquired about purchasing the lot.
Manager Flodstrom has requested more than once that the dumping cease until
the matter of the purchase of the property was resolved. Manager Flodstrom
indicated that the dumping has ceased since the last time he made the
request.

Mayor Duncan adjourned the Council to executive session at 9:50 P.M.

The Council returned to open session at approximately 10:30 P.M.
XII ADJOURNMENT
